Subject: SLTB202100038 W4 Express Car Wash - Easement
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once
the following comments have been addressed: [Each comment is preceded by the applicable reference, which is
to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [General Comment] As this is an easement plat, any proposed improvements associated with
development of the site, including buildings, parking, dumpster pads, landscaping islands, etc. should not
be shown. On the plat, the property boundaries and any existing or proposed easements are the only things
that should be drawn within the parcel on Sheet 2. Please revise. The Easement Plat on Sheet 2 has been
updated accordingly.
2. [14-302 (A)(3)] Provide the width of each road and include their recorded instrument number as a label
or callout on Sheet 2. This comment has been addressed.
3. [14-302 (A)(5)] Please name the proposed easement over the shared use paths as "new permanent
access easement." This will not be a public easement dedicated to the County, but simply an easement
over a private sidewalk and travel way granting public access to use those improvements for bicycle and
pedestrian access purposes. This comment has been addressed.
a. A declaration of maintenance and easement will need to be provided and recorded with this plat.
An example of a declaration of maintenance and easement for a similar easement on another
project is attached. Please revise the document so that it correctly identifies the new access
easement in Presidio, states the correct Tax Map Parcel number, who will maintain the
easement, etc. Portions of the declaration that need to be revised are highlighted in yellow. The
applicant may adjust other sections as they see fit. Once submitted, the County Attorney will
review the declaration.
Please see Andy HerricWs su¢¢ested revisions to the Declaration of Maintenance and
Public Access for sidewalks sent on 4/23/2021. This declaration will need to be updated
and reviewed prior to approval. As mentioned above this asreement will be recorded
aloe¢side the Plat.
4. [14-203 (D)] The public access easements will require a deed of easement. Therefore, the applicable fee
for this easement plat application is $817.00. Only $215.00 has been paid, please submit the outstanding
balance. This comment has not been addressed.
5. [14-302 (A)(11)] Please state the deed book and page number for the most recent recorded instrument that
applies to TMP 45-93C. Albemarle County GIS indicates that the most recent deed for this property
was recorded in Deed Book 5201 page 133. Please include this information on the Plat. This
information can be included under the owner information in the project notes box.
6. [14-302 (A)(15)] Please provide a note stating the names and addresses of any easement holders of
easements affecting the property. This comment has been addressed.
7. [14-302 (B)(5)] Please remove reference to SDP2019-52 from the Zoning note.
a. Please remove the proposed building height and maximum building height notes on the plat.
These comments have been addressed.
8. [14-302 (B)(7)] Please provide a notation as to whether the land is within an Albemarle County and/or
City of Charlottesville water supply watershed or an agricultural -forestal district. Please revise the
Easement Notes box to state, "Site is not within an Albemarle County Water Supply Watershed or
an A¢riculturaVForestal District." The property is within the Sourth Fork Rivanna Watershed, but
this is not a Water Supply Watershed.
9. [14-302(B)] Provide the appropriate signature panel for the agent. A signature line should be provided on
the first page, with the words "Agent for the Board of Supervisors" beneath the line. This comment has
been addressed.
10. [14-302 (A)(1)] Amend the title so that it is clear this is an Easement Plat and not a Site Plan. This
comment has been addressed, but it may be useful to clarify Sheet 1 as being the existing conditions
whereas Sheet 2 is the Easement Plat.
11. 114-303 (A)] Please add a statement of consent to division to the plat. Use the wording as follows: "The
platting or dedication of the following described land [insert a correct description of the land subdivided]
is with the free consent and in accordance with the desire of the undersigned owners, proprietors and
trustees, if any." This comment has been addressed.
12. [14-303 (0)] Please provide a signature panel for the property owner directly under the statement
mentioned in comment #11 above. This comment has been addressed.
13. [14-303 (P)] Please provide notary panels for the notary to acknowledge the signature of the owner. This
comment has been addressed.
14. Please see the comments for SDP202000021. The conditions of the special exception for the initial site
plan SDP201900052 have been partially met, the shared use paths along Woodbrook Drive and Route 29
meet the required dimensions, but the required buffers have not been met. There should be a minimum 6
foot landscape strip buffer between the shared use path and Woodbrook Dr. The location of the public
access easement along Woodbrook Drive needs to be revised so that there is a 6' buffer between the path
location and the right-of-way. Staff will be making this same comment on the next site plan review
comment letter for SDP202000021. This comment has been addressed.
15. The Revision Block should only reflect this Easement's revisions. The Revision Block includes revisions
to the Site Plan which are not needed on this Easement Plat.
