RE: Berkmar Overlook Grading Easement
This document is to memorialize the agreement between Berkmar Development LLC and the
Foundation Child Development Center regarding the grading easement for the Berkmar Overlook Project. The
Foundation Child Development Center will give Berkmar Development LLC access to their property to modify
the grades as shown on the attached exhibit entitled Berkmar Overlook — Final Site Plan. In return, Berkmar
Development LLC shall provide the following
• (6) 3" Willow Oak trees for the Foundation Child Development Center
o Trees shall be provided by Berkmar Development LLC
o Trees to be planted within 30 days of the completion of the fence replacement so long as it is an
appropriate time to plant trees
o Trees shall be planted along the fence line
• Mulch the disturbed upper playground associated to the grade adjustments.
o Mulch shall be 2" in depth and shall be "tinder turf'
• Replace the fence section that is removed to adjust grades
o Fence shall be replaced within 24 hours after the completion of the grading
• Grade flat pad for a pre -manufactured shed to be provided by Foundation Child Development
• Access to the parking lot shall be maintained throughout the course of construction
• Grading on Child Development's property shall be completed within one week after the fence is
removed
This document shall also serve as the acceptance of the Berkmar Overlook — Final Road & Utility
Plans by the Foundation Child Development Center. By signing below Foundation Child Development Center
acknowledges and accepts these plans.
