Under section § 17-900 of the Albemarle County Code, this is your NOTICE TO COMPLY with
the requirements of the Land Disturbance Permit (or Agreement in Lieu of a Plan) for the
referenced project and to immediately take corrective measures to address erosion and sediment
control deficiencies on this property. This Notice to Comply is being issued because of the
following deficiencies:
Deficiency: Seed all denuded areas as required by program
Corrective Action: Seed and mulch as required by program
Deficiency: Silt fence and seed all piles
Corrective Action: As required, install proper controls
Deficiency: No vegetative ground cover over majority of site
Corrective Action: Seed and much denuded areas.
Deficiency: Townhouse sites not contained as required. Install controls and mark on plan
Corrective Action: Install standard alone controls to contain runoff from construction of
Townhomes and prevent issues within development area
Deficiency: Trap and existing basin near capacity. Maintain as required and direct all runoff into
approved controls
Corrective Action: Maintain and repair as needed, continue use as project advances. Size as per
plan and current active phases, direct all runoff towards control
Deficiency: Stabilize as required by program.
Corrective Action: Seed and mulch
Deficiency: Structures failing
Corrective Action: Maintain all perimeter controls, install additional as needed to contain
building envelopes and active work zones
Deficiency: All inlets within and downstream of active Townhouse construction must be

Unless subsequently amended in writing by this office, it is expected all of these corrective
measures will be completed by.
Re -inspection of this notice to verify corrective measures will incur a $150 for land disturbing under
VESCP and single-family dwelling units (§ 17-207) or a $250 fee for land disturbing under VSMP (§ 17-
208). Failure to take effective corrective measures will result in a Stop Work Order upon re -inspection.

seed/mulch. Contain and stablize as much of the upstream site as possible prior to
installation of underground detention.
