County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any VSMP
permit by issuing a project approval or denial. This plan is denied for reasons outlined, below. The application may
be resubmitted for approval if all comment items are satisfactorily addressed
A. Stormwater Pollution Prevention Plan (SWPPP)
(Rev. 1) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. This SWPPP is
disapproved for reasons listed, below.

2. Please ensure PPP Exhibit labels Aists Area of Land Disturbance (sq.ft. /Ac.).
3. Sec. 3 /Nature ofAcfivity: Provide brief narrative that clarifies project purpose.
4. Sec. 6A: PPP Exhibit: Include linework Aabels for typical PPP measures:
a. Small depression for collecting detaining vehicle wash waters
b. Solid waste dumpster, covered
c. Portable sanitary facility (ports John)
d. Concrete wash -out
e. Rain gauge
5. Sec. 6.E.: Provide Name of individual responsible for PPP. Required to list a named individual prior to
scheduling preconstruction meeting. A named individual is not required for VSMP/WPO Plan approval.
6. Please include reference to WPO201500063 on SWPPP cover.
7. Additional comments are possible.
B. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This
plan is disapproved for reasons listed, below. The stormwater management plan content requirements can
be found in County Code section 17-403.
1. Label Cl. 1 riprap apron dimensions, L x W (2' depth is shown). Str. Al. (Rev. 1) Persists. As follow-up:
Recent site visits by Erosion Control staff and photos indicate cast-off asphalt material debris occupies the
existing channel. This circumstance is described with plan labels reading: `Ex. swale lined with rubble,'

and `Ex. rubble -lined channel' (ref. highlight/sheet I image below). This is misleading in that it suggests
rubble is similar to riprap, or reflects deliberate placement of material to attenuate velocity, etc., and is
suitably designed for a storm conveyance channel. Labels should accurately describe channel condition.
Photos indicate material placed is equivalent to a waste disposal operation. A storm conveyance channel
cannot be buried beneath material that is not riprap that may impede flow in the channel. In this instance,
material lies in the path of storm runoff that may wash downstream. Clean stone riprap sized to resist
displacement is suitable channel lining, spent asphalt that belongs in a permanent landfill (or approved
disposal site) is not. Please clear channel of accumulated asphalt debris. If riprap is proposed, provide
armor detail. Storm conveyance may not be buried beneath debris or waste, for the following reasons:
a. Runoff may convey debris downstream (this appears to have occurred elsewhere on this site).
b. Conveyance cannot be evaluated or maintained, if buried.
c. Conveyances are required to be maintained clear of debris.
d. Debris (other than properly sized clean stone) impedes channel performance.
e. Nuisance habitat: rodents, snakes. Asphalt waste dumped over a slope may develop as repository
of viral or bacterial or fecal matter upstream of Moore's Creek.
f, Asphalt debris limits conveyance capacity, since not by deliberate design.
g. Past state /DEQ inspection is fair predictor of future state inspection. Note: DEQ has expressed
concern with this site. Specifically, area of Moore's Creek downslope of the failed level spreader
is identified (by DEQ) as requiring removal of broken concrete or other debris from the stream.
Please update Engineering on removal progress at this site.

2. Show /label VDOT anchors for 12" HDPE at 20% (profile view), since grade >16%. (Rev. 1) Addressed. Note:
Label on Storm Drain `A' profile indicates 16 LF 12" HDPE pipe (15.19%) requires VDOT standard concrete
anchors. Engineering commends this approach given past slope erosion issues at this site.
3. Provide VDOT storm pipe anchor detail. (Rev. 1) NA. Design relies on std. VDOT concrete anchors. Applicant
must ref. VDOT 2016 Road and Bridge Standards for specific anchor details during construction since std. concrete
anchor detail is not provided.
4. Provide 12" HDPE V2-year, Q10-year. Ensure Q10 does not exceed 5 cfs. (Rev. 1) Addressed.
5. Provide VDOT PB-1 pipe bedding detail. (Rev. 1) Persists. NyloplastT proprietary system was discussed with
Albemarle County Engineer. Applicant is requested to provide Mfr. installation guidance, provide bedding detail.
6. Provide VDOT ST-I deta ' eteps' MH >4'), or equivalent, for Nyloplast. Consider access to Sir. A2, A3. (Rev.
1) Withdrawn. Albemarle accepts Nyloplast on this project. Applicant must rely on Mfr. technical details and
system installation guidance concerning access since vertical riser access detail is not provided
7. Provide /label 12" HDPE pipe end section. Provide HDPE end section detail. (Rev. 1) Addressed. Note: ADS
Flared End Section specification /detail provided.
8. Provide 2-3 sentence Narrative description of project. (Rev. 1) Not Addressed. Provide brief narrative that
clarifies rationale for plan Amendment #2.
9. Provide on this (sheet 1, or separate) sheet: ESC details, symbols, legend, sequence that address slope erosion
and transition of runoff from eroded bank to the new proposed 12" HDPE storm system. (Rev. 1) Addressed.
10. Clarify label 'temporarily remove trees': specify number and type to be removed, number and type that will
replace trees removed, and when replacements will be planted. (Rev. 1) Addressed. See construction sequence
Note 6.
11. Depict existing armored channel. Evaluate Ex. armored channel capacity, i.e., it will accept additional flow
with proposed amendment. Demonstrate existing armored channel can accept additional runoff. (Rev. 1) Partially
addressed. Also, please see item #1 above.
12. Revise plan to reference WPO201500063. (Rev. 1) Addressed.
13. Revise sheet title to include Amendment #2. (Rev. 1) Addressed.
14. Amendment may not discharge to TMP 77-10 without permanent drainage easement across TMP 77-10.
Fumish copy of recorded permanent (private) drainage easement across TMP 77-10. (Rev. 1) NA. Design revised
to confine runoff to Applicant -owned parcel, except that channel conveyance across a different adjacent parcel may
be required. Please see item 18 below.
Alternatively, provide design that avoids discharge to TMP 77-10. Inertia /momentum -direction of discharge appear
to assure discharge will cross onto TMP 77-10.
15. Provide digital PE seal signature /date (for digital approval). (Rev. 1) Addressed.
16. New /sheet 2: Revise structure ID that reads A2-A3 to read SD A2 consistent with Storm Drain `A' profile.
17. New /sheet 2: Revise structure ID that reads A2-Al to read SD Al consistent with Storm Drain `A' profile.

18. New /sheet 2: Provide VSMP Channel Protection to limits of analysis. Limit of analysis is not the end of the
rubble -lined channel, but OIIW, Moore's Creek. There is a gap between the end of the existing manmade channel
(rubble -lined ditch) and ordinary high water, or WSE of Moore's Creek. In this section, before site DA constitutes
<1.0% of receiving stream DA, energy balance applies. Either extend a properly designed armored manmade
channel from end of Ex. rubble -lined channel to OIIW, Moore's Creek (across portion of TMP 76M2-1-D), or
demonstrate energy balance at endpoint of Ex. rubble -lined channel. Note: extending a manmade channel to
Moore's Creek would require permanent deeded /platted easement across 076M2-01-00-000130, a parcel owned by
Willoughby Property Owner's Association Inc. (c/o Real Property Inc.).
19. New /sheet 2: Please coordinate 0.12 lb. Nutrient credit purchase from an eligible Nutrient credit bank (IIUC
02080204, or adjacent I UC). Please coordinate purchase document review with Ana Kilmer, county Management
Analyst prior to executing purchase since specific information is required to be included on nutrient purchase

C. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan
is disapproved for reasons listed below. The erosion control plan content requirements can be found in
County Code section 17-402.
1. Provide paved wash rack detail on the plan. See ACDSM, p. 8.
2. Show CE /vehicle wash waters draining to a shallow catchment.
3. Silt fence proposed for slopes is problematic. SF appears to be the only downslope perimeter measure that
limits runoff. Please provide alternative measure/s: a diversion dike, for example, located cross -slope to
direct runoff away from slopes known to be steep and prone to erosion. DD must lead to a temporary
trapping measure. Note: It appears this Amendment is required to correct unstable site conditions, so
attempt must be made to ensure (both during and after construction) that slopes that have experienced
storm runoff and eroded or failed in the past (necessitating altemative design) remain stable.
D. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404. This plan is disapproved, for
the reasons provided below.
1. Please see review item A.(SWPPP) 2.,4., above.
The VSMP permit application and all plans may be resubmitted for approval when all comments have been
addressed. Engineering encourages digital resubmittel.
Engineering plan review staff is available 2-4 PM Thursdays, should you require a video -meeting to discuss this
review.
Process:
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request
form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and
check parcel and easement information based on the approved plans. The County's Management Analyst will
prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash,
certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County
Attorney and County Engineer. This may take 24 weeks to obtain all the correct signatures and forms.
A Stormwater Management Facilities Maintenance Agreement may also need to be completed and recorded if SWM
facilities or forest /open space easement is proposed. The County's Management Analyst or other staff will prepare

the forms and check for ownership and signature information. The completed forms will need to be submitted along
with court recording fees.
After bonding and agreements are complete, depending on area of land disturbance, county staff may need to enter
project information in a DEQ database for state application processing. DEQ will review the application information
based on local VS W authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the application.
DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the application, they will
issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, and nutrient credit purchase documents (Affidavit(bill of sale)
are approved by Albemarle, the County can hold a pre -construction conference. Applicants will need to complete
the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies
the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff,
and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -
construction conference, should everything proceed satisfactorily, a joint VSMP and grading permit will be issued
by the County so that work may begin.
