Yancey Lumber Company TAX MAP/PARCEL: 55/112 ZONING: (HI) Heavy Industry ACREAGE: 12.5 acres LOCATION: South side of Route 250, +/- .3 miles east of its intersection with Interstate 64 The applicant seeks a variance from Section 30.5. 6.2 . 1 of the Albemarle County Zoning Ordinance, which states: "30.5.6.2 SA-Highways 30.5.6.2.1 No buildings or structures other than permitted under section 4. 11, except as hereafter provided in the case of certain signs, shall be constructed within any SA-highways overlay district. . . . " The Scenic Highway District is established in Section 30.5.2.2, which states: "30.5.2 .2 SA-HIGHWAYS SA-highway overlay districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way: a. U.S. Route 250 from the western corporate limits of the City of Charlottesville to the western Albemarle County border. " The applicant proposes to construct an addition to the rear of the existing office building and seeks a reduction of the scenic highway setback from the minimum requirement of one hundred fifty (150) feet to forty (40) feet. The applicant states that additional office space is needed and it is impractical to construct a new structure in compliance with the one hundred fifty (150) foot setback requirement. RECOMMENDATION The application should be approved for cause: 1) The applicant has demonstrated that the SA-highways setback requirements do create a hardship in the reasonable use of the property. The proposed addition will not decrease the existing setback and is the only practical solution to the applicant's expansion needs. 2) The hardship is not generally shared by other properties in the general vicinity. 3) The authorization of the variance will not be of detriment to the adjacent properties nor will the character of the district be altered. Effective May 5, 1982 - The actual cost of any notice required under the code shall be taxed to the applicant, to the extent that the same shall exceed the applicable fee set forth in this section.
