Please find our responses to the comments below in bold lettering. 1. [Recommendation] As currently proposed there are four plats each with multiple pages all depicting various portions of the necessary easements over multiple properties. This methodology of platting the various required easements increases the likelihood of error and is difficult to review. In the next submittal, please include a locator map, as an inset map, to indicate which areas of the development are shown by each sheet. Rev.1: Comment addressed. 2. [14-302(A)14, 14-428, 14-434, 14-435, and 14-435.1] Provide the required temporary construction easement dedicated to public use on TMP 77-9 to construct the public road. Rev.1: Comment addressed as discussed in the July 10th, 2019 email between staff and the applicant. 3. [14-302(A)15] Identification of all owners and certain interest holders. If the plat seeks to vacate the VEPCO easement,then the easements holder's signature shall be provided on the plat. VEPCO must authorize and be part of this vacation. Rev.1: While the easement is to be vacated through a separate instrument, until it is vacated the existing easement shall be depicted, labeled, and provided recordation information on the plat. Easement confirmed as released and quitclaimed in DB.5192 PG. 234. Easement reference/delineation has been removed. Revise note#6 as follows: "This plat hereby dedicates to public use the ACSA Waterline Easements,the site distance easements, the fire truck turn around easement, and the drainage easements shown hereon."This note shall reference the correct easement labels if they are modified. Rev.1: When an easement is dedicated to public use it is conveyed to the County; however,there are a couple easements lumped into note#6 that are not being dedicated to the County; rather,they are being dedicated to various agencies other than the County, such as ACSA& Charlottesville Gas. Omit the ACSA waterline easement from note #6 as all public water easements shall be dedicated to the Albemarle County Service Authority, and not to the County. Also, omit the public gas line easement from note#6 and revise the easement label throughout the plat to no longer label it as "public" and instead dedicate it to Charlottesville Gas. Additionally, the plat does not label or depict any sight distance easements. Please remove reference to sight distance easements from #6. Revised,sight distance easement added to sheet#5.Only easements for public use (to County of Albemarle are listed). 5. [14-302(A)14, 14-428] Land to be dedicated in fee. On the plat provide the following note for the right-of-way dedication: "21.5' Wide Public Right-of-Way Area Hereby Dedicated to the County of Albemarle for Public Use." Rev.1: Comment addressed. 6. [14-303(D)] Acreage of lots. On the plat label the acreage of TMP 77-9 prior to the right- of-way dedication and after the dedication. Rev.1: Comment addressed. 7. [14-429] Reservation of land for streets. Revise the right-of-way reservation notes as follows: "21.5' wide area hereby reserved for future dedication for public use." And "10' wide area hereby reserved for future dedication for public use (for grading purposes)." Rev.1: Comment addressed. 8. [14-302(A)3] Existing platted streets. Label the existing portion of Avon Court as State Route 1101. Rev.1: Comment addressed. 9. [14-302(A)5, 14-3111] Public Easements. The site plan depicts a new gas line through the site. Provide an easement for the gas line. Rev.1: While a gas line easement has been provided.The easement shall not be dedicated to the County for public use; rather, it shall be dedicated to Charlottesville Gas. Please revise the plat accordingly. Revised,Sheet 3 and 6 easements labeled as 15'gas line easement to Charlottesville Gas. 0 • 10. [14-302(A)5] Public Easements. For all proposed easements provide the name of the public owner of record. Rev.1: Comment addressed. 11. [14-302(A)4, 14-302(A)5] Easements. Dimension all easements. Rev.1: Comment addressed. 12. [14-302(A)2] Vicinity Map. Revise the vicinity map to be 1"=2,000'. Rev.1: Comment addressed. 13. [14-302(B)10] Stream Buffers. Depict and label the 100' stream buffer. Provide the following note on the plat: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." Rev.1: Comment addressed. 14. [14-303(0)] Signature Panel. Revise the approval block to: "Agent for the Board of Supervisors". Rev.1: Comment addressed. 15. [14-302(B)8] Yards. Revise the setbacks as follows: Front: Minimum —10 feet from the right-of-way or the exterior edge of the sidewalk is outside of the right-of-way; for off-street parking or loading spaces, 10 feet from aby public street right-of-way. Maximum —None. Side: Minimum — Primary structure shall be constructed and separated in accordance with the current edition of the Building Code. Maximum — None. Rear: Minimum —Primary structure shall be constructed and separated in accordance with the current edition of the Building Code. Maximum— None. Rev.1: Comment addressed. 16. [14-302(B)(5)] Zoning Classification. Under the zoning of the property list the following overlay district: - Steep slopes: managed slopes and preserved slopes overlay district. - Entrance Corridor overlay district. - State and Federal dam inundation zones. - Airport Impact Area. Rev.1: Comment addressed. 17. [14-302(B)(1)] General Information. Provide the date of the last revision. Rev.1: Comment addressed. 18. [14-433, 14-303L, 14-317, 14-431, 14-428, 14-434, 14-435, 14-435.1] The required deed of dedication and easement associated with the public drainage easements shall be approved by the County Attorney prior to final plat approval. Please submit an unsigned • draft of the documents to staff and we will distribute it to the County Attorney's office for review/approval. See attached template. Rev.1: Comment not addressed. Acknowledged,to be provided by owner. 19. [14-434, 14-435, 14-435.1, 14-431, 14-311, 14-428] Multiple plats have been submitted which depict the public right-of-way dedication, associated public drainage easements, temporary construction easements, and all other required easements for the construction and use of the public road. Prior to final plat approvals, all improvements necessary for the construction, use, and maintenance of the public road shall be approved on a road plan and built or bonded pursuant to Section 14-434, 14-435, and 14-435.1 of the Subdivision Ordinance. Rev.1: Comment not addressed. Acknowledged,all required elements are shown on road plan and will be bonded. 20. [14-435, 14-435.1, 14-434, 14-311, 32.7.5] Street Trees. Street trees were previously approved to be located behind the sidewalk, they may remain in this location. On this plat provide a 6' wide landscape and maintenance easement for these trees, ensure the easement and the tree locations coincide. Provide a maintenance agreement for this landscape easement. Rev.1: Comment partially addressed. Ensure the easement is dedicated to the County for public use, as these street trees are required with the public road. Label the easement as follows: "6 feet wide landscape maintenance easement hereby dedicated to the County of Albemarle for public use."The required deed of dedication and easement associated with the landscape easement shall be submitted. The applicant is responsible for the development and recordation of this document. The County Executive shall sign the deed once ready for approval. The deed shall be recorded with the plat. Provide recordation information on the site plan. Revised Additional review comments on the revision: 21. [14-302(A)5, 14-311] Public Easements. The drainage easements being dedicated to public use shall be labeled as follows: "28 feet wide public drainage easement hereby dedicated to the County of Albemarle for public use." Revised 22. [14-302(A)5, 14-311] Public Easements. Ensure all drainage easements required for the public right-of-way are labeled as commented on in the previous review comment. Revised 23. [14-302(A)5, 14-311] Public Easements.The alignment and layout of the public drainage easement depicted on sheet 4, near L27, appears to cross TMP 77-7; however,the site plan does not depict this alignment for the easement; rather, it cuts to the ease onto TMP 77-9A and avoids crossing TMP 77-7. Revise to ensure the easement does not cross TMP 77-7 and is clearly depicted and,matches the site plan. This easement matches the site plan and does not cross into 77-7 24. [Comment] Revise the title of the plat as follows: "Plat showing various easements, and the dedication and reservation of public rights-of-way on the lands of Lighthouse Lands, LLC TMP 77-9." Revised ACSA Comments (Richard Nelson): 1. Add note that ACSA easements are to be centered on as-built locations. Note#8 2. Call out ACSA waterline easement. Revised 3. Provide ACSA easement in prescriptive ROW. Prescriptive ROW within the 21.5'Right-of-Way dedicated for public use on this plat for TMP 77-9.
