Rasmussen, III VS13#40694 250 East High Street Charlottesville, VA 22902 Tax Map # 06000-00-00-03800 & 03900 EXEMPT FROM RECORDING FEES AND TAXES PURSUANT TO VIRGINIA CODE 58.1-811(3) DEED OF DEDICATION THIS DEED OF DEDICATION is made this 2- day of April, 2021, by and between 2246-2248 IVY ROAD, LLC, a Virginia limited liability company, and WEST END SHOPS -EAST, LLC, a Virginia limited liability company, Grantors; and the COMMONWEALTH OF VIRGINIA, acting by and through the VIRGINIA DEPARTMENT OF TRANSPORTATION, Grantee. WITNESSETH: WHEREAS, Grantors are the Owners of certain real property situated in Albemarle County, Virginia, as shown on the plat attached hereto and incorporated herein by reference, dated December 7, 2020, last revised March 5, 2021, and entitled "Plat Showing Public Drainage & ACSA Waterline Easements On The Lands Of 2246-2248 Ivy Road, LLC & West End Shops - East, LLC, Tax Map Parcel 60-38 & 60-39, SDP 201900072, Jack Jouett Magisterial District, Albemarle County, Virginia," prepared by Timmons Group, being the same Property acquired by 2246-2248 Ivy Road, LLC by Deed dated January 27, 2020 and recorded in Deed Book 5271 at page 779 and by West End Shops -East, LLC by Deed dated February 26, 1991 and recorded in Deed Book 1805 at page 664 among the land records of Albemarle County, Virginia; and WHEREAS, it is the desire and intent of the Owners to dedicate, grant and convey a portion of the Property for public use in accordance with this Deed of Dedication and the Plat recorded herewith; NOW, THEREFORE, in consideration of the premises and the sum of ONE DOLLAR ($1.00), cash in hand paid, the receipt and sufficiency of which are hereby acknowledged, the Grantor does hereby dedicate and convey in fee simple with general warranty and English Covenants of title to the Commonwealth of Virginia, acting by and through the Virginia Department of Transportation, for public street purposes, shown as (i) "20' Public Drainage Easement Dedicated To Commonwealth Of Virginia, Area = 236 SF (0.005 Ac.)" and (ii) "Var. Width Public Drainage Easement Dedicated To Commonwealth of Virginia, Area = 955 SF (0.022 Ac.)" on the aforesaid Plat. Grantors warrant that the land hereby conveyed is free of hazardous materials and other contaminants. The GRANTORS covenant and agree for themselves and their successors and assigns, that the consideration hereinabove mentioned shall be in lieu of any and all claims to compensation for land, and for damages, if any, to the remaining lands of the GRANTORS which may result by reason of the use to which the GRANTEE will put the land being conveyed, including such drainage facilities as may be necessary.
