At your request, we have examined our records with respect to the above -
referenced parcel of land in the County of Albemarle, Virginia (the "Property"), and we are
pleased to advise you that:
(a) The Property is zoned under the zoning ordinance of the County of
Albemarle (the "County "). The zoning district permits the use of the property for
multi -family residential apartments specifically three hundred and eighteen (318) residential
units (including parking) as a matter of right without the necessity of obtaining a conditional or
special use permit, variance, special exception or other authorization or approval. In the event of
casualty or destruction to some or all of the improvements on the property, the improvements
could be rebuilt to their current specifications, subject to building code requirements. [If the

copy.]
(b) The Property is not subject to any regulations or conditions or other
special limitations imposed by the County in connection with the zoning or rezoning of the

(c) The Property and the current use, occupancy, operation and improvements
thereof comply with the applicable requirements of the zoning ordinance of the County and
applicable rules and regulations of the zoning district, including, but not limited to, compliance
with respect to the following: (i) setback of the buildings from the property lines, (ii) height of
the buildings, (iii) parking requirements, and (iv) area, width or depth of the land as a building

(d) The Property is recognized as one or more separate parcels of land under
the subdivision ordinance of the County, may be conveyed, leased, or mortgaged as one or more
separate parcels and currently complies with such subdivision ordinance and other applicable
subdivision laws. The Property is not subject to any conditions or special limitations imposed by
the County in connection with any subdivision approval of the Property. [If the Property is

(e) The Property lies within the boundaries of the municipal authority's
zoning district.
(f) The existing Property contains no outstanding zoning violations, housing
code violations, building code violations or fire code violations.
(g) The proffers which apply to the property are copies
of which are attached.
(h) All governmental permits and approvals necessary for the construction,
use, operation and occupancy of the property have been issued and are in full force and effect.
