A copy of the Trust Agreement mentioned herein shall be filed in the offices of Richmond and Fishburne, 0 Court Square, Charlottesville, Virginia. The interest of every beneficiary hereunder and under the Trust Agreement and of all persons claiming under any of them shall be only in the earnings, avails and proceeds arising from the rental or sale or other disposition of the property. such interest is hereby declared to be personal property, and no beneficiary hereunder shall have any right, title or interest, 3 legal or equitable, in or to the property, as such, but only in the earnings, avails and proceeds thereof as provided in the Trust Agreement. In the event of the resignation, death, incapacity, removal or absence from the state of a Trustee, a successor trustee may be appointed by the unanimous written consent of the beneficiaries by an instrument duly executed, acknow.edged, and recorded in the Clerk's Office of the Circuit Court of every jurisdiction in which property is situated; or such successor trustee may be appointed in accordance with Section 26-49 of the Code of Virginia.
