First, let me outline the background on everything. 1. The plat recorded in DB 3998, pages 606-613 was not reviewed, approved, or signed by Albemarle County. That plat "vacated" a segment of the existing private street that served as the frontage and access to TMP 106-13C, which was recorded originally in DB 904, page 38. The DB 3998 plat also showed a new 30' access easement serving TMP 106-13C as its access from State Route 618. a. Vacating the existing private street was a violation of the County's Subdivision Ordinance since the County did not approve and sign that plat prior to recordation. 2. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Creating that easement gave TMP 106-13C two points of access (the original private street going out to State Route 53, and the 30' access easement going to State Route 618). a. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have approved the DB 3998 plat that created the 30' access easement because it does not comply with Section 14-404. Revisions to SUB202100028 plat needed in order to proceed: • Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2 (Chris' comment #1). *DB.904 p.308 now shown and referenced as the legal access to TMP.106-13C(Tract 2).* • Add a callout to the plat stating that the 30' access easement created in DB 3998 page 606 is hereby vacated OR submit a waiver to Section 14-404 (A) to request to allow the 30' access easement to remain. I cannot say that the County would approve the waiver request, because it needs to be reviewed for compliance with the information and findings specified in Section 14-404 (D) and I don't currently have that information. The easiest route would be to just vacate that 30' access easement. *Callouts have been added Vacating DB.3998 p.606 and a note added to sheet 2 "Albemarle County Notes" stating the legal access to Tmp.106-13C per DB.904 p.308 and the Vacation of DB.3998 p.606* I know this is a lot of information, so please let me know if anything I wrote is unclear or if you have further questions. First, let me outline the background on everything. 1. The plat recorded in DB 3998, pages 606-613 was not reviewed, approved, or signed by Albemarle County. That plat "vacated" a segment of the existing private street that served as the frontage and access to TMP 106-13C, which was recorded originally in DB 904, page 38. The DB 3998 plat also showed a new 30' access easement serving TMP 106-13C as its access from State Route 618. a. Vacating the existing private street was a violation of the County's Subdivision Ordinance since the County did not approve and sign that plat prior to recordation. 2. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Creating that easement gave TMP 106-13C two points of access (the original private street going out to State Route 53, and the 30' access easement going to State Route 618). a. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have approved the DB 3998 plat that created the 30' access easement because it does not comply with Section 14-404. Revisions to SUB202100028 plat needed in order to proceed: • Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2 (Chris' comment #1). *136.904 p.308 now shown and referenced as the legal access to TMP.106-13C(Tract 2).* • Add a callout to the plat stating that the 30' access easement created in DB 3998 page 606 is hereby vacated OR submit a waiver to Section 14-404 (A) to request to allow the 30' access easement to remain. I cannot say that the County would approve the waiver request, because it needs to be reviewed for compliance with the information and findings specified in Section 14-404 (D) and I don't currently have that information. The easiest route would be to just vacate that 30' access easement. 21 *Callouts have been added Vacating DB.3998 p.606 and a note added to sheet 2 "Albemarle County Notes" stating the legal access to Tmp.106-13C per DB.904 p.308 and the Vacation of DB.3998 p.606* I know this is a lot of information, so please let me know if anything I wrote is unclear or if you have further questions. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have approved the DB 3998 plat that created the 30' access easement because it does not comply with Section 14-404. Revisions to SUB202100028 plat needed in order to proceed: • Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2 (Chris' comment #1). *136.904 p.308 now shown and referenced as the legal access to TMP.106-13C(Tract 2).* • Add a callout to the plat stating that the 30' access easement created in DB 3998 page 606 is hereby vacated OR submit a waiver to Section 14-404 (A) to request to allow the 30' access easement to remain. I cannot say that the County would approve the waiver request, because it needs to be reviewed for compliance with the information and findings specified in Section 14-404 (D) and I don't currently have that information. As I mentioned in my earlier email, use of that entrance must cease as it violates Section 14- 404 of the Subdivision Ordinance. The easement label should just state "hereby vacated." Revise the note on Sheet 2 so that it states that the 30' access easement recorded in DB 904 page 308 is a private street. It is now the private street providing frontage and access to Tract 2.
