Thanks. I just had the Dillards in the office and they signed eight copies of the plat. I have a runner heading your way
now. Please confirm once you have signatures on your end, as our next step will be to shepherd them over to Fluvanna
for signature on Monday.
I saw that you mentioned Albemarle needs to keep one copy of the plat. Will you just keep one of the copies we drop
off today (unsigned by Fluvanna) or will you want us to get Fluvanna's signature on a copy and return it?

Two things:
1. The callout on sheet 3 for the vacation of the 30' access easement recorded in DB 3998 shouldn't reference the
Note on Sheet 2. As I mentioned in my earlier email, use of that entrance must cease as it violates Section 14-
404 of the Subdivision Ordinance. The easement label should just state "hereby vacated." *The callout on all
sheets no longer reference Note on sheet 2.*
2. Revise the note on Sheet 2 so that it states that the 30' access easement recorded in DB 904 page 308 is a
private street. It is now the private street providing frontage and access to Tract 2.

comments addressed. Please see the Albemarle County notes on sheet 2,
fourth from the bottom concerning the access easements.
Our client is trying to close at the end of this month and we do currently have approval in Fluvanna, so in help in
expediting the Albemarle county review would be greatly appreciated.

Hi Jeff,
Yes, I have some answers on what needs to be done in order to proceed. First, let me outline the background on
everything.
1. The plat recorded in DB 3998, pages 606-613 was not reviewed, approved, or signed by Albemarle County. That
plat "vacated" a segment of the existing private street that served as the frontage and access to TMP 106-13C,
which was recorded originally in DB 904, page 38. The DB 3998 plat also showed a new 30' access easement
serving TMP 106-13C as its access from State Route 618.
a. Vacating the existing private street was a violation of the County's Subdivision Ordinance since the
County did not approve and sign that plat prior to recordation.
2. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Creating that easement
gave TMP 106-13C two points of access (the original private street going out to State Route 53, and the 30'
access easement going to State Route 618).
a. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street
created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have
approved the DB 3998 plat that created the 30' access easement because it does not comply with
Section 14-404.
Revisions to SUB202100028 plat needed in order to proceed:
• Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2
(Chris' comment #1).
*DB.904 p.308 now shown and referenced as the legal access to TMP.106-13C(Tract 2).*
• Add a callout to the plat stating that the 30' access easement created in DB 3998 page 606 is hereby
vacated OR submit a waiver to Section 14-404 (A) to request to allow the 30' access easement to
remain. I cannot say that the County would approve the waiver request, because it needs to be
reviewed for compliance with the information and findings specified in Section 14-404 (D) and I don't
currently have that information. The easiest route would be to just vacate that 30' access easement.
*Callouts have been added Vacating DB.3998 p.606 and a note added to sheet 2 "Albemarle
County Notes" stating the legal access to Tmp.106-13C per DB.904 p.308 and the Vacation of
DB.3998 p.606*

Yes, I have some answers on what needs to be done in order to proceed. First, let me outline the background on
everything.
1. The plat recorded in DB 3998, pages 606-613 was not reviewed, approved, or signed by Albemarle County. That
plat "vacated" a segment of the existing private street that served as the frontage and access to TMP 106-13C,
which was recorded originally in DB 904, page 38. The DB 3998 plat also showed a new 30' access easement
serving TMP 106-13C as its access from State Route 618.
a. Vacating the existing private street was a violation of the County's Subdivision Ordinance since the
County did not approve and sign that plat prior to recordation.
2. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Creating that easement
gave TMP 106-13C two points of access (the original private street going out to State Route 53, and the 30'
access easement going to State Route 618).
a. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street
created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have
approved the DB 3998 plat that created the 30' access easement because it does not comply with
Section 14-404.
Revisions to SUB202100028 plat needed in order to proceed:
• Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2
(Chris' comment #1).

Yes, I have some answers on what needs to be done in order to proceed. First, let me outline the background on
everything.
1. The plat recorded in DB 3998, pages 606-613 was not reviewed, approved, or signed by Albemarle County. That
plat "vacated" a segment of the existing private street that served as the frontage and access to TMP 106-13C,
which was recorded originally in DB 904, page 38. The DB 3998 plat also showed a new 30' access easement
serving TMP 106-13C as its access from State Route 618.
a. Vacating the existing private street was a violation of the County's Subdivision Ordinance since the
County did not approve and sign that plat prior to recordation.
2. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Creating that easement
gave TMP 106-13C two points of access (the original private street going out to State Route 53, and the 30'
access easement going to State Route 618).
a. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street
created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have
approved the DB 3998 plat that created the 30' access easement because it does not comply with
Section 14-404.
Revisions to SUB202100028 plat needed in order to proceed:
• Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2
(Chris' comment #1).
*DB.904 p.308 now shown and referenced as the legal access to TMP.106-13C(Tract 2).*
• Add a callout to the plat stating that the 30' access easement created in DB 3998 page 606 is hereby

Hard copies of the plat may not be submitted for final County signatures and approval. The County Attorney does not
need to review the plat, so the last step is to get me the hard copies and I will have them signed. There are designatec
staff members who can sign the plats, so I will need to coordinate that on my end. In the interest of time, please send
me an email once the plats have been dropped off.
Our offices are open MWF from 9 AM-4 PM. If you can get the copies of the plat to me tomorrow, I can have them

Thanks very much. Just so you know, one of the reasons for my call and my email — and the urgency of the request — is
that the approval and recordation of this plat is tied to a pending real estate transaction, and so I want to emphasize
how much I appreciate your speedy response. I know Jeff Powell understands and appreciates the urgency based on his
conversations with Trey, but I wanted to mention it to you as well.
If/when the changes you requested are made, are there any others at the County (including the County attorney's
office) who would still need to review? If so, would it be their first review or just a blessing of revisions?

More generally, can you give us your best guess on how much time we should expect between now and the County's
formal approval and signature? I understand that any answer you may provide will depend on some variables that are
beyond your control, and I am not looking to tie down a specific date or deadline. As much as anything, we are hoping
to get a ballpark idea or a range of dates that will help us manage expectations of the various parties involved in the

Yes, I have some answers on what needs to be done in order to proceed. First, let me outline the background on
everything.
1. The plat recorded in DB 3998, pages 606-613 was not reviewed, approved, or signed by Albemarle County. That
plat "vacated" a segment of the existing private street that served as the frontage and access to TMP 106-13C,
which was recorded originally in DB 904, page 38. The DB 3998 plat also showed a new 30' access easement
serving TMP 106-13C as its access from State Route 618.
a. Vacating the existing private street was a violation of the County's Subdivision Ordinance since the
County did not approve and sign that plat prior to recordation.
2. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Creating that easement
gave TMP 106-13C two points of access (the original private street going out to State Route 53, and the 30'
access easement going to State Route 618).
a. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street
created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have
approved the DB 3998 plat that created the 30' access easement because it does not comply with
Section 14-404.
Revisions to SUB202100028 plat needed in order to proceed:
• Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2
(Chris' comment #1).
*136.904 p.308 now shown and referenced as the legal access to TMP.106-13C(Tract 2).*
• Add a callout to the plat stating that the 30' access easement created in DB 3998 page 606 is hereby
vacated OR submit a waiver to Section 14-404 (A) to request to allow the 30' access easement to
remain. I cannot say that the County would approve the waiver request, because it needs to be
reviewed for compliance with the information and findings specified in Section 14-404 (D) and I don't

1. The callout on sheet 3 for the vacation of the 30' access easement recorded in DB 3998 shouldn't reference the
Note on Sheet 2. As I mentioned in my earlier email, use of that entrance must cease as it violates Section 14-
404 of the Subdivision Ordinance. The easement label should just state "hereby vacated."
Revise the note on Sheet 2 so that it states that the 30' access easement recorded in DB 904 page 308 is a
private street. It is now the private street providing frontage and access to Tract 2.

Our client is trying to close at the end of this month and we do currently have approval in Fluvanna, so in help in
expediting the Albemarle county review would be greatly appreciated.

Yes, I have some answers on what needs to be done in order to proceed. First, let me outline the background on
everything.
1. The plat recorded in DB 3998, pages 606-613 was not reviewed, approved, or signed by Albemarle County. That
plat "vacated" a segment of the existing private street that served as the frontage and access to TMP 106-13C,
which was recorded originally in DB 904, page 38. The DB 3998 plat also showed a new 30' access easement
serving TMP 106-13C as its access from State Route 618.
a. Vacating the existing private street was a violation of the County's Subdivision Ordinance since the
County did not approve and sign that plat prior to recordation.
2. The 30' access easement recorded in DB 3998 is also a Subdivision Ordinance violation. Creating that easement
gave TMP 106-13C two points of access (the original private street going out to State Route 53, and the 30'
access easement going to State Route 618).
a. Section 14-404 (A) requires a single point of access to be provided for parcels. The private street
created in DB 908 page 38 was that single point of access for TMP 106-13C. The County would not have
approved the DB 3998 plat that created the 30' access easement because it does not comply with
Section 14-404.
Revisions to SUB202100028 plat needed in order to proceed:
• Show the original private street recorded in DB 908 page 38 and make sure it extends to the new Tract 2
(Chris' comment #1).
