DEED OF EASEMENT
(for Private Drainage)
THIS DEED OF EASEMENT is made as of this I 170 day of f i
20 1 by and between Thomas Zakielarz, Kimberly Garrison and Jeffrey Ange.
Trustees of MAPLE GROVE CHRISTIAN CHURCH (the "Grantor"), and
ALBEMARLE LAND DEVELOPMENT, LLC, a Virginia limited liability company (the
"Grantee").
WITNESS:
WHEREAS, the Grantor is the owner of that certain real property (the "Grantor's
Property") located in the County of Albemarle, Virginia, containing 3.0 acres, more or less, and
shown as "TMP 32-29D, Maple Grove Christian Church", on Exhibit "A" attached hereto and
incorporated herein (the "Exhibit"); and
WHEREAS, the Grantee is the owner of that certain real property located in the County
of Albemarle, Virginia, containing 3.2 acres, more or less, and shown as "TMP 32-35, Albemarle
Land Development LLC" on the Exhibit ("Grantee's Property"); and
WHEREAS, it is the desire and intent of the Grantor to grant and convey a private
drainage easement in the area shown as "New 20' Drainage Easement" on the Exhibit (the
"Easement Area") to the Grantee for the purpose of installation, maintenance, replacement and
service of drainage pipe that extends from the Grantee's Property through the Grantor's
Property, as further detailed on the Exhibit.
NOW, THEREFORE, the Grantor does hereby GRANT and CONVEY unto the
Grantee, its successors and assigns, an exclusive and perpetual easement over the Easement
Area (the "Easement") for the installation, maintenance, replacement and service of drainage

pipe. Reference is made to the Exhibit for the exact location and dimensions of the Easement
Area as it crosses the Grantor's Property.
The Easement shall be subject to the following:
1. Right of ingress and egress. The Grantee, its successors and assigns, and associated
authorized agents and employees shall have the right and easement of ingress and egress over
the Grantor's Property to perform all acts to which the Grantee, its successors and assigns, may
need and/or reasonably desire to perform in the course of maintenance of the drainage pipe in
the Easement Area, which such maintenance shall include replacement of such pipe should such
replacement be reasonably necessary.
2. Ownership of the facilities. The drainage pipe and any additional facilities that may
be constructed by the Grantee, its successors and assigns, in the Easement Area shall be and
remain the property of the Grantee, its successors and assigns.
3. Binding effect. The Easement and the rights and obligations established herein shall
run with the land in perpetuity and shall be binding upon the Grantee, and its successors and
assigns. All references herein to the "Grantee" and "Grantor" includes their respective
successors and assigns.
4. Termination of Easement. If the parties hereto, or their successors or assigns, desire
to alter or vacate a portion or all of the Easement Area, the Easement Area may be adjusted
accordingly. Upon termination of any portion of the Easement Area, any residue of the
Easement Area shall remain subject to this Deed of Easement. The termination of any portion
of the Easement Area shall be recorded, at the sole expense of the parties hereto, their
successors or assigns, in the Clerk's Office of the Circuit Court of the County of Albemarle,
Virginia.
5. Accentance by Grantees. By recordation of this Deed of Easement, the Grantee does
hereby evidence their acceptance of the conveyance of this Easement by the Grantor to the
Grantee, its successors and assigns, on the terms and conditions herein.
