Board of Directors and ARB Board RE: Cascadia Commercial Construction—Lot 259 Dustin: On June 4th you asked for a letter regarding construction easements that you show on the plans for Cascadia Lot 259,the commercial parcel. The items as outlined in your June 4th e-mail are as follows: • The work to be done in the open space in the forebay and the trail system are shown on your site plan page 3. There is a doghouse manhole that will be installed and wing walls for the outlet area. • A temporary construction easement will include the entire area shown within the easement in the open space. • You don't believe that there will be a need any temporary E&S measures as everything is flowing to the sediment basin, but the owners of the commercial parcel are amenable to providing some external measures to help with rill and gully erosion, if needed. • The long term maintenance of the forebay will be the responsibility of the POA while the 2' maximum height retaining wall along with the wing walls and end of the storm sewer outfall, including the doghouse to the end of the storm sewer will be maintained by Cascadia Commercial. • The suggested benefit to the HOA is getting a free forebay built on HOA property. • RGA will work with the contractor to ensure that the forebay is built properly so that long term maintenance will be minimal. In that same June 4th e-mail,you outlined the proposed Construction Sequences as follows: In Open Space 1. Construct forebay for permanent stormwater management facility 2. Excavate and Install 2' maximum height retaining wall and bring site up to final grade where possible. Onsite Construction 3. Begin excavation for Building foundation and interior basement walls on eastern and southern sides along with retaining walls adjacent to these walls. 4. Bring site up to final grade once building foundation and retaining walls are completed. 5. Any landscaping disturbed on HOP open space shall be replaced per county standards. June 11,2019 Via E-mail: DGreene@roudabush.com Dustin Greene @ Rouda bush, Gale&Associates Page 2 of 2 While the above concepts are agreeable in theory to the Cascadia POA Board and ARB, this letter that you requested is ONLY an acknowledgment that the concepts in your June 4th e-mail, as summarized above, are agreeable. More information will need to be provided, including the actual final plans. More importantly,a final recorded easement agreement will have to be drafted and recorded by your client. The easement needs to include the perpetual part of the easement for completed improvements into the Cascadia common area, but it also needs to include the temporary construction easement terms as well. Lastly, you should anticipate that added terms and conditions in the proposed easement will need to include insurance and bond requirements for the benefit of the POA,to assure the proper completion of all the work proposed. I hope this letter is helpful in your process, but there will be quite a few details to hammer out in the formal documents before these easements are in any way assured.
