In addition to containing all of the information required to be on an initial site plan, as provided in section 32.5, a final
site plan shall contain the following:

Request for Waiver of Street Standards
Dear Ms. Yaniglos,
In accordance with Section 14-233 of the Albemarle County Code of Ordinances,we are requesting the authorization
of private streets in Block 22 of Old Trail Village,using the information below as justification,providing satisfaction
of the requirements of Section 14-234(C).
• Section 14-233(A)(1)(i)(ii)
The proposed Block 22 private streets would provide a streetscape that is more consistent with the
Westside neighborhood model. The use of a private streets on the western side of Old Trail Village
mirrors the overall road design of the development on the eastern side of Old Trail Drive. The
subdivision design would also allow it to better achieve the density goals of the comprehensive plan.
The proposed design eliminates the larger Right-of-Way so that more space can be utilized for
housing and lots,which in turn,will allow for a development with a higher density.
In accordance with Section 14-234(C),the proposed private streets in Block 22 satisfy each of the five requirements
stated in this section.
(1) These private streets will be adequately constructed to carry the traffic volume expected. The traffic
volume on expected in Block 22 were designed using ITE trip generation calculations(9"ed.).The
pavement designs for these private streets were calculated to VDOT standards for public roads and are
shown with acceptable travel widths.
(2) The master plan for Old Trail does not show guarantee of public streets in the approximate location of
these proposed private streets.Upon analyzing the internal streets in Block 22,the development density
goals provide more feasibility with the use of private streets.
(3) The fees associated with these private streets will be owned by the Old Trail Homeowners Association.
(4) These private streets will not serve through traffic nor intersect the state highway system. These private
streets are only intended to provide adequate frontage and vehicular access to the houses in Block 22.
(5) The flood hazard overlay district requirements are not applicable for these private streets.

In accordance with Section 14-422 of the Albemarle County Code of Ordinances,we are requesting a waiver for the
requirement of planting strips between the curb and sidewalk as well as the requirement of sidewalk along both sides
of the streets within the proposed development in Block 22 of Old Trail Village.
• Section 14-422(D)(2)(v)(viii)
The use of alleys and private streets was anticipated in the rezoning of Old Trail Village.The design
proposes the position of the sidewalk and planting strip to be reversed to better achieve density goals of the
comprehensive plan. Including the planting strip behind the sidewalk rather than between the curb and
sidewalk would enable more use of lot size and the number of units,which in turn,will allow for a
development with a higher density.
• Section 14-422(E)(2)(v)(vi)(vii)
Firstly,the lower density provided in this area does not show the necessity for sidewalks along both sides of
the streets, as they would not provide a reasonable purpose to the residents within the proposed development
area. Secondly,the proposed sidewalks in Block 22 were designed to easily connect into existing and future
pedestrian sidewalks that are currently used as a benefit to the public.The proposed sidewalks in Block 22
would be also be privately maintained.
