DILLARD, III, and PATRICIA DILLARD, jointly and severally referred to herein as Dillard; and ALAN G. DILLARD, JR., Trustee of the Alan G. Dillard, Jr. Trust under Declaration of Trust dated June 27, - 2000, and DAPHNE P. DILLARD, Trustee of the Daphne P. Dillard Trust under Declaration of Trust dated June 27, 2000, jointly and _- _ -, severally referred to herein as the Trustees, and provides: _ Dillard is the fee simple owner of Albemarle County, Virginia, Tax Map Parcel 106-13C, which is referred to herein as the Dillard Property having taken title thereto by a deed :_. recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in Deed Book 2193, page 587. The Trustees are _. _ the fee simple owners of Albemarle County, Virginia, Tax Map Parcel 106-13 and Fluvanna County, Virginia, Tax Map Parcel 8-A- A5, which are jointly and severally referred to herein as the Trustee Property, having taken title thereto by deeds recorded in the Clerk's Office of the Circuit Court of Albemarle County, in Deed Book 5674, page 567, and in the Clerk's Office of the Circuit Court of Fluvanna County, in Deed Book 782, page 50. Ingress to and egress from the Dillard Property is currently had by means of a thirty foot (30') wide easement of right of way across the Trustee Property as shown and described on a plat dated September 30, 1986, prepared by Roudabush, Greene & Gale, Inc. , a copy of which is recorded in the Clerk's Office for the Circuit Court of Albemarle County, in Deed Book 1155, page 245, and in the Clerk's Office for the Circuit Court of Fluvanna County, in Deed Book 222, page 863. The parties hereto desire to simultaneously abandon and terminate the cited existing right of way, and to establish a new thirty foot (30') wide easement of right of way for the benefit of the Dillard Property across the Trustee Property as shown and described on the attached plat dated January_28, 2011, prepared by Roudabush, Gale & Associates, Inc., captioned, "Plat Showing New 30' Access Easement And The Abandoned 30' Right-of-Way Crossing Parcel 13, Albemarle County And Parcel A5, Fluvanna County To Serve Parcel 13C, Albemarle County Located On State Routes 53 and 618 Albemarle/Fluvanna County," which is referred to herein as the Plat. Therefore, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledge, Dillard hereby abandons, vacates and terminates all of their right, title and interest in and to the easement of right-of-way heretofore connecting the Dillard Property with State Route 53. For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Trustees hereby Grant, Bargain, Sell and Convey unto Dillard a perpetual, exclusive thirty foot (30') wide easement of right-of-way providing ingress to and egress from the Dillard Property to State Route 618 as shown and described on the Plat. Dillard shall be solely responsible for the construction, maintenance and repair of the driveway and improvements to be located within the easement granted hereby. The Trustees reserve the right to put the property which is the subject of the easement established hereby to such other uses as they deem appropriate provided that any such use shall not unreasonably interfere with the use of the easement as set forth herein. The easement established hereby shall run with the land and shall be binding upon the personal representatives, successors and assigns of the parties.
