Charlottesville,VA 22903 www•timmons.com August 9, 2019 Christopher Perez, Senior Planner County of Albemarle 401 McIntire Rd Charlottesville,VA 22902 RE: SUB2019-92 Lighthouse Instruments—Easement Plat—Various easements on ASTEC Partnership TMP 77-9A Comment Response Letter Dear Mr. Perez: We have reviewed all of your comments from July 26, 2019 and made the necessary revisions. Please find our responses to the comments below in bold lettering. 1. [Recommendation] As currently proposed there are four plats each with multiple pages all depicting various portions of the necessary easements over multiple properties. This methodology of platting the various required easements increases the likelihood of error and is difficult to review. In the next submittal, please include a locator map, as an inset map, to indicate which areas of the development are shown by each sheet. Rev.1: Comment addressed. 2. [14-302(B)5, 30.7.4(b)] Preserved Slopes. The private utility easement for the sanitary sewer lateral is depicted through preserved slopes. This use is not permitted in preserved slopes, revise the easement and the improvement to be outside of the preserved slopes. Please coordinate with ACSA and Jonathan Showalter of Timmons Group. Rev.1: Pending ACSA review and approval of the modified easement width. ACSA has recognized lateral and easement are private and width is acceptable for construction and maintenance. 3. [14-302(A)5] Public Easements. Depict, label, and dimension the existing sewer easement on TMP 77-9A. Also label the owner of this easement. Rev.1: Comment addressed. 4. [14-302(A)3] Existing or platted streets. County records depict TMP 77-9A extending to the centerline of the road. Ensure the lot line and right-of-way are accurately depicted. Rev.1: Comment addressed. 5. [14-302(A)11] Instrument creating property proposed for subdivision. The recordation information provided on the easement plat for TMP 77-9A appears to be incorrect, DB 1369 PG 427. Revise the plan to provide the correct recordation information. Rev.1: Comment addressed. 6. [14-302(A)4] Private Easements. Ensure the new 20' utility easement is centered on the new water line. The proposed easement location depicted on the plat does not match the waterline depicted on the final site plan. Revise to ensure they match. Rev.1: Comment addressed. 7. [14-302(A)5] Public Easements. The site plan depicts a new gas line originating on TMP 77-9A, ensure an easement is provided for the new gas line. Rev.1: While a gas line easement has been provided.The easement shall not be dedicated to the County for public use; rather, it shall be dedicated to Charlottesville Gas. Please revise the plat accordingly. Revised 8. [14-302(A)5] Public Easements. Provide the new gas line with an easement throughout the prescriptive right-of-way for Avon Court. Rev.1: Comment addressed. 9. [14-303(L)] Drainage Easements. Ensure the drainage easement depicted on TMP 77-9A is large enough to encompass the entire drainage facility. Please relocate the dimension label of"25.91" from the easement to clearly depict the easement. Rev.1: Comment addressed. 10. [14-302(A)5] Public Easements. Revise note#6 as follows: "This plat hereby dedicates to public use the temporary construction easements, sight distance easements, ACSA waterline easements, drainage easements shown hereon."This note shall reference the correct easement labels if they are modified. Rev.1: When an easement is dedicated to public use it is conveyed to the County; however,there are a couple easements lumped into note#6 that are not being dedicated to the County; rather,they are being dedicated to various agencies other than the County, such as ACSA& Charlottesville Gas. Omit the ACSA waterline easement from note#6 as all public water easements shall be dedicated to the Albemarle County Service Authority, and not to the County. Also, omit the gas line easement from note#6 and revise the easement label throughout the plat to no longer label it as "public" and instead dedicate it to the Charlottesville Gas. Also, revise note #6 to omit the temporary construction easement from being dedicated to public use.The temporary construction easement shall be granted to the property owner who is responsible for constructing the improvements within the easement,the owner of TMP 77-9, Lighthouse Land, LLC. Revised 11. [14-302(A)5] Public Easements. For all proposed easements provide the name of the public owner of record. Rev.1: Comment addressed. 12. [14-302(A)3] Existing platted streets. Label the existing portion of Avon Court as State Route 1101. Rev.1: Comment addressed. 13. [14-302(A)4, 14-302(A)5] Easements. Dimension all easements. Rev.1: Comment addressed. 14. [14-302(A)2] Vicinity Map. Revise the vicinity map to be 1" = 2,000'. Rev.1: Comment addressed. 15. [14-302(B)10] Stream Buffers. Depict and label the 100' stream buffer. Provide the following note on the plat: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." Rev.1: Comment addressed. 16. [14-303(0)] Signature Panel. Revise the approval block to: "Agent for the Board of Supervisors". Rev.1: Comment addressed. 17. [14-302(B)8] Yards. Revise the setbacks as follows: Front: Minimum — 10 feet from the right-of-way or the exterior edge of the sidewalk is outside of the right-of-way; for off-street parking or loading spaces, 10 feet from any public street right-of-way. Maximum — None. Side: Minimum —Primary structure shall be constructed and separated in accordance with the current edition of the Building Code. Maximum —None. Rear: Minimum —Primary structure shall be constructed and separated in accordance with the current edition of the Building Code. Maximum—None. Rev.1: Comment addressed. 18. [14-302(B)(5)] Zoning Classification. Under the zoning of the property list the following overlay district: - Steep slopes: managed slopes and preserved slopes overlay district. - Entrance Corridor overlay district. - State and Federal dam inundation zones. - Airport Impact Area. Rev.1: Comment addressed. 19. [14-302(6)(1)] General Information. Provide the date of the last revision. Rev.1: Comment addressed. 20. [14-433, 14-303L, 14-317, 14-431, 14-428, 14-434, 14-435, 14-435.1] The required deed of dedication and easement associated with the public drainage easements shall be approved by the County Attorney prior to final plat approval. Please submit an unsigned draft of the documents to staff and we will distribute it to the County Attorney's office for review/approval. See attached template. Rev.1: Comment not addressed. Acknowledged,to be provided by the owner 21. [14-434, 14-435, 14-435.1, 14-431, 14-311, 14-428] Multiple plats have been submitted which depict the public right-of-way dedication, associated public drainage easements, temporary construction easements, and all other required easements for the construction and use of the public road. Prior to final plat approvals, all improvements necessary for the construction, use, and maintenance of the public road shall be approved on a road plan and built or bonded pursuant to Section 14-434, 14-435, and 14-435.1 of the Subdivision Ordinance. Rev.1: Comment not addressed. Acknowledge,all required elements are shown on road plan and will be bonded. Additional review comments on the revision: 22. [14-302(A)4] Private Easements. Prior to site plan and subdivision plat approval, either provide a new easement over the existing sewer line on TMP 77-9A which connects to the existing RWSA easement or provide a maintenance agreement with RWSA and the owners of TMP 77-9A&TMP 77-9 to permit the owners of TMP 77-9 to conduct maintenance of the existing line and for the connection to be made. Per coordination with ACSA Maintenance Agreement will contain language granting owner of TMP 77-9A access to maintain or replace lateral.Therefore, an easement is not required beyond the connection point. 23. [14-302(A)5, 14-311] Public Easements. The drainage easements being dedicated to public use shall be labeled as follows:"_feet wide public drainage easement hereby dedicated to the County of Albemarle for public use." Revised 24. [14-302(A)5, 14-311] Public Easements. Ensure all drainage easements required for the public right-of-way are labeled as commented on in the previous review comment. Revised 25. [14-302(A)4] Private Easements. The previous plat depicted a new temporary construction easement (685 SF) on TMP 77-9A associated with the drainage easement, depicted on Sheet 4; however, this plat no longer provides it. Please explain why it is no longer needed/required.The temporary construction easement shall be granted to the property owner who is responsible for constructing the improvements within the easement,the owner of TMP 77-9, Lighthouse Land, LLC. Temporary construction easement was previously provided for mitigation plantings fir WPO Buffer Disturbance. Because existing channel is being improved and is not new disturbance, mitigation plantings are no longer necessary and easement is no longer necessary. 26. [14-302(A)4, 14-302(A)5] Easements. While all proposed easements on Sheet 3 appear to match the site plan, it is very hard to read. Please revise the scale of this sheet so it is easier to read and distinguish the various easements being platted. Added detail, Sheet#4 27. [14-302(A)5] Public Easements. Why does the sight distance easement depicted on Sheet 3 have a lower arrow? Is this needed? Revised ACSA Comments (Richard Nelson): 28.Add note that ACSA easements are to be centered on as-built locations. Note#10 29.Sheets 2 and 4- Call out ACSA waterline easement.
