Reasons for this disapproval are identified below, citing applicable sections of the Albemarle County Code. In accordance with Albemarle County Code § 14-231, the subdivider at its sole option may appeal the disapproval to the Planning Commission and, if the Commission disapproves the plat, to the Board of Supervisors. The appeal shall be in writing and be filed with the agent within ten (10) days after the date of the disapproval by the agent or by the Commission, as the case maybe. The action by the Commission and the Board shall comply with sections 14-230(C) and (D). Reauired changes prior to final plat approval: 1. [14-302(B)(7), Sec. 3-202] Agricultural -Forestal District Limitations. Per comments received from the Rural Areas Planner, Scott Clark, TM 71-29C and 71-29D are each enrolled in the Batesville Agricultural/Forestal District, and are subject to the limitations on development to a more intensive use listed in section 3-202 of the County Code. While section 3-202(A)(3)(d) permits boundary line adjustments in the Districts where all resulting parcels are 21 acres or more, there is no allowance in section 3-202 for boundary line adjustments for parcels under 21 acres. Therefore, this proposed boundary line adjustment cannot be approved. 2. [14-302(A)(9)] Building site. Add a note to the plat stating that "Lot land Lot 2 each contain a building site that complies with Sec.4.2.1 of the Albemarle County Zoning Ordinance'. 3. [14-302(A)(10)] Development Rights. Revise plat Note 6 to state that: "Lot land Lot 2 are each assigned 1 development right. Neither lot may not be further subdivided." 4. [14-302(A)(15)] Parcel owner. Revise plat Note 1 to provide the owner(s) name(s), in addition to the owner's address. Albemarle County GIS records indicate that both parcels are owned by a Trust. 5. [14-302(B)(2)] Plat preparer. The plat must be signed and sealed by a licensed professional. 6. [14-302(B)(4)] Burial areas. Provide a note on the plat confirming whether any grave, object, or structure marking a place of burial is located on the property. 7. [14-302(B)(5)] Zoning district. Provide a note on the plat stating the zoning classification of the property, including all applicable zoning overlay districts, proffers, special use permits, and variances. (Note: The subject property is zoned "Rural Areas" and is not subject to any zoning overlay districts, proffers, special use permits, or variances.) 8. [14-302(B)(6)] Tax map and parcel number. Provide the full, unabbreviated tax map and parcel numbers for W W W.ALBEMARLE.ORG 401 McIntire Road, North Wing, I Charlottesville, VA 22902-4579 both parcels included in this subject property. 9. [14-302(B)(7)] Water supply watershed. Provide a note on the plat stating whether the land is within an Albemarle County and/or City of Charlottesville water supply watershed. (Note: The subject property is within the Upper Mechums River water supply watershed.) 10. [14-302(B)(7)] Agricultural -Forestal District identification. Provide a note on the plat stating whether the land is within an agricultural -forestal district. (Note: The subject property is within the Batesville Agricultural - Forestal District.) 11. [14-302(B)(10)] Stream buffers. Both parcels are subject to the Water Protection Ordinance buffers, or stream buffers. Please locate and label the stream buffer on the plat and include the following note: "The stream buffer shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." 12. [14-303(C)] Exterior boundary lines. Provide the exterior boundary lines of the property with bearings in degrees, minutes and seconds. Curvilinear data shall include radius, central angle, arc length, and tangent distance. All dimensions shall conform to the standards set forth in this chapter. 13. [14-303(H)] Monuments. Label the material of all permanent reference monuments shown on the plat. 14. [14-303 (I)] Monuments. Provide a definite bearing and distance tie between not less than two (2) permanent monuments on the exterior boundary of the property and further tie to existing street intersection where possible and reasonably convenient. 15. [14-400, Sec.10.4] Lot frontage. Provide bearing and distance measurements along the St. Rt. 637 for both subject parcels. Please be aware, each lot must have a minimum lot frontage of 250 feet along the existing public road to meet the minimum lot requirements established in Sec 10.4 of the Albemarle County zoning ordinance.
