THIS DEED OF GIFT IS EXEMPT FROM RECORDATION TAX PURSUANT TO SECTION
58.1-811 (D) OF THE VIRGINIA CODE, 1950 AS AMENDED.
THIS DEED OF GIFT is made as of rA,Coe. S 2021, by and between HUGH
N. CLARK, III and CHARLOTTE B. CLARK, husband and wife, Grantors, and JOSEPH H.
CLARK, whose address is 3446 Tucked Away Farm, Crozet VA 22932, Grantees.
WITNESSETH:
That for and in consideration of the love and affection of the parties hereto, the Grantors
do hereby GRANT and CONVEY, with GENERAL WARRANTY AND ENGLISH
COVENANTS OF TITLE, unto Joseph H. Clark, the following described real property (the
"Property"):
All that certain parcel or tract of land situated in the White Hall Magisterial
District of Albemarle County, Virginia, containing 3.00 acres, more or less, and
identified as Lot I on a plat prepared by Roger W. Ray & Assoc, Inc., entitled
"Family Subdivision Plat Lot 1, Containing 3.00 Acres A Portion of the Property
of Hugh N. Clark, III and Charlotte B. Clark Located on Tucked Away Farm and
State Route 674 (Clark Road)," dated November 12, 2020, attached hereto and
recorded herewith as Exhibit A (the "Plat").
BEING a portion of the same property conveyed to the Grantors by deed from
Hugh N. Clark, III and Charlotte B. Clark (a/k/a Charlotte Gail Clark), dated June
29, 2011, recorded July 13, 2011, in the Circuit Court Clerk's Office for the
County of Albemarle, Virginia in Deed Book 4053, Page 264.
TOGETHER WITH a perpetual, non-exclusive, 30' private street easement for ingress
and egress to and from the Property shown and labeled on the Plat as "New 30' Private
Street Easement," said easement intended to run with the land and be subject to a Private
Improvement Maintenance Agreement recorded immediately hereafter.
This conveyance is made subject to easements, conditions, recorded liens and restrictions
contained in duly recorded instruments constituting notice in the chain of title to the property
conveyed which have not expired by a limitation of time contained therein or otherwise become
ineffective.
