SECOND SUPPLEMENTAL DECLARATION OF
COVENANTS, CONDITIONS,RESTRICTIONS AND EASEMENTS
This Second Supplemental Declaration is made as of this 5th day of June, 2020, by
GLENMORE PARTNERS, LLC, a Virginia limited liability company, hereinafter referred to as the
"Declarant",
RECITALS:
Whereas, the declaration of Covenants, Conditions and Restrictions for Glenmore
Highlands, Section K2C-II Phase 1 Glenmore Subdivision, Scottsville District, Albemarle County,
Virginia (the "Declaration") is recorded in the Clerk's Office of the Circuit Court of Albemarle
County,Virginia(the"Clerk's Office) in Deed Book 4946 page 11; and
Whereas, a First Supplement to the Declaration was recorded on February 12, 2019 in Deed
Book 5136 page 573 in the Clerk's Office in order to impose the easements, covenants, conditions
and restrictions of the Declaration on those lots shown on a plat of Roudabush, Gale & Associates,
Inc., dated August 30, 2018 and last revised February 6, 2019, entitled Subdivision Plat, Section
K2C-II,Phase 2, Glenmore Subdivision, Scottsville District, Albemarle County,Virginia; and
Whereas, it is the desire of the Declarant to impose the Declaration's easements, covenants,
conditions and restrictions on that certain parcel or parcels (the "Additional Property") shown on a
plat of Roudabush, Gale & Associates, Inc., dated March 9, 2020 and last revised May 15, 2020,
entitled Subdivision and Easement Plat, Section K2C-II, Phase 3, Glenmore Subdivision,
Scottsville District, Albemarle County, Virginia (the "Phase 3 Plat"), said Phase 3 Plat being
attached hereto, recorded along with, and made a part hereof; and that the Additional Property shall
be held, conveyed, acquired and encumbered by the easements shown on the Phase 3 Plat; and
WHEREAS, pursuant to Article VIII, General Provisions Section 8.05 of the Declaration of
Covenants, Conditions, Restrictions and Easements of record in the said Clerk's Office in Deed
Book 4946,page 11,the Declarant has the power to annex additional real property into the Property
on or before June 26,2022.
NOW THEREFORE, the Declarant hereby declares that all of the Additional Property is
and shall be held, occupied, encumbered and conveyed subject to the easements, covenants,
conditions and restrictions set forth in said Declaration of record in the said Clerk's Office in Deed
Book 4946, page 11, and Declarant does hereby grant and convey to itself and its successors and
assigns the following easements as described in the Site Plan and as shown on the attached Phase 3
Plat: (1) the Extension of Drumin Road 50' Private Access Easement and the New Burleigh Court
50' Private Access Easement (said private access easements to be established, utilized and
maintained pursuant to the terms of Section 9.10 of the Declaration); and (2) the Variable Width
Storm Sewer Easement (said easement to be established and maintained pursuant to the terms of
Section 9.05 of the Declaration).

The undersigned hereby acknowledge and consent to the recordation of the foregoing
Second Supplemental Declaration of Covenants, Conditions, Restrictions and Easements for
GLENMORE HIGHLANDS (the "Declaration") and to the imposition of the covenants, conditions
and restrictions set forth therein upon the Property and expressly acknowledge and agree that the
lien, operation and effect of the deed of trust recorded for the benefit of each of the undersigned is
hereby made subordinate to this Declaration and any supplements. The undersigned have joined
herein solely for the purposes set forth above and for no other or further purposes whatsoever. The
undersigned expressly disclaim any liability or obligation whatsoever with regard to the
preparation, drafting, substance or content of this Declaration.
