To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned Planned Residential Development ("PRD") ") per ZMA1999-
00010, approved September 20, 2000, with proffers (Linked), The permitted uses of the
Property are provided in Section 19 of Chapter 18 of the Albemarle County Code
("Zoning Ordinance") and exclude eight different uses and restrict two other uses as
listed in the proffers. The Property is subject to the Airport Impact, Entrance Corridr, and
Steep Slopes Overlay Districts described in Section 30 of the Zoning Ordinance.
The use of the Property for multi -family rental housing is a use permitted by -right in the
PRD zoning district without the necessity of obtaining a conditional or special use permit,
variance, or other legislative approval.
A Site Development Plan (SDP200100020) was approved October 18, 2001 for 264
dwelling units with 512 parking spaces to serve the complex. There have been various
amendments to the site plan approved, resulting in the present development.
To the best of my knowledge, the Property is currently in compliance with all
applicable requirements of the Zoning Ordinance. A review of our files found (i) no
violations or alleged violations or regulations applicable to the Property, whether
pending, contemplated, or having already occurred, (ii) no fees due or pending witl-
respect to any matter before the County Zoning Office; and (iii) no pending
application for rezoning of the Property or for a special or conditional use permit or
variance in connection with the Property. Further, no proceeding to challenge the
zoning or other governmental approval or use of the Property is pending or overtly
threatened to the best of my knowledge.
If the Property contained physical development approved with a site plan, then in the
event of casualty, the Property may be rebuilt substantially in the same form upon
satisfaction of all required building permits and site plans, as applicable.
