Jonathan,
I spoke with Chris with the following determination.The private sewer lateral can be located within the 'public' storm
easement with a minimum 5-ft of separation between the two. However,you will need to provide a cross section on the
plans to show land disturbance is not required beyond the limits of the easement.

Note that the adjacent land owner will need to be a party to the public drainage deed of easement and plat.There will
also need to be a deed of easement and plat for the private sewer lateral, but the County will not be a part of that
deed/plat.

Chris and I spoke and have the following determination.
1. Storm piping: since this includes runoff from the public right-of-way, it qualifies as a public facility and can be
routed through the critical slopes.The preserved slopes should be preserved to the maximum extent practicable
[30.7.4.b.1.c(iii)], so it is expected that the existing outfall on the adjacent property will be utilized if possible.
2. Sanitary lateral:the lateral is private unless the ACSA accepts it.ACSA does not maintain private laterals and
utilities that are not maintained by the ACSA/RWSA(or some other public entity)are considered private and do
not meet the definition of a "necessary public facility." As we discussed in our meeting last week,the lateral can
be installed under the critical slopes by boring and encasing it in a sleeve.The sleeve will allow for replacement
of the lateral in the future as needed without disturbing the critical slopes. Boring the lateral under the critical
slopes shouldn't disturb the critical slopes and therefore does not require a special use permit(by-right). It was
also determined that using the neighbor's sanitary outfall is also allowed without the requirement for a special
use permit since it is serving an existing use and the disturbance was previously approved.

Chris,
Due to some difficulties in getting an easement from parcel 77-7 to the north,we are exploring the options to get an
easement from parcel 77-9A to the east.
Meeting with David and Frank to discuss the stormwater outfall the sewer connection to the downhill RSWA sewer main
also came up. The attached exhibit shows one possible routing for that connection. However, all of this is very
approximate pending survey and further design.
The main question is whether the proposed sewer lateral from the site through the preserved slopes is considered a by
right use or whether it requires a special use permit. Up to this point from the comments and the initial conversations
we were under the impression this is a by right use not requiring a special use permit.
It seems it should be by right either under the section necessary public facilities, necessary to allow the use of the lot as
to not cause unnecessary hardship or maybe under the distribution facility section.
The site is separated from the sewer main by the preserved slopes so to not allow the sewer lateral to connect through
the preserved slopes by right would leave the owner of the parcel no option to develop the parcel other than to get a
special use permit.
Please let us know if you can give us a determination on this situation or if you have any questions.

Chris,
RWSA has reviewed the final site plan for Lighthouse Instruments as prepared by Timmons Group and dated 7/10/2018,
with most recent revision dated 9/13/2018 and has the following comments:
Sheet C4.0:
1. Include the following RWSA sewer connection notes:
"All connections to RWSA manholes shall be watertight and made with a flexible rubber boot. All coring methods,
the coring contractor and all materials for construction shall be approved by RWSA in writing prior to
construction. RWSA Engineering Staff shall be present for all cores into the manholes. Bypass pumping may be
required at the sole discretion of RWSA staff. Grouting of the manhole bench or interior may be required,at the
sole discretion of RWSA staff,for a smooth transition of flow. Existing manholes shall be backfilled to original
grade to the satisfaction of RWSA. Contact RWSA Engineering a minimum of 3 business days in advance to
schedule a core of a manhole."
2. Show RWSA 30' sanitary sewer easement on this sheet(D.B. 369 P. 248).
3. RWSA needs to see the profiles for the proposed storm drains, since the pipe is shown to cross the existing
RWSA sewer main adjacent to MCI-MH-36 (between storm structures 102 and 104). RWSA will require a
minimum vertical separation of 18" between the existing sewer main and the proposed storm sewer line.
