Since the sewer lateral can be placed parallel with the storm in the same corridor of disturb to the public storm by-right use. Frank's recollection of why the current design was acceptable was conversation early in the design indicating the sanitary line maintained. Talking with ACSA today Richard the ACSA reviewer confirmed ACSA would not be able to take ownership of that other parcels and they can run a lateral to the main. Frank and I discussed if Chris's understanding could be applied to either allow the currently proposed sewer line parallel to the of the sewer lateral parallel to the existing storm channel. The fact that the existing channel provides a corridor that has alrea disturbance in that corridor to maintain or rebuild the channel is allowable by right. Could we install the new sewer lateral par corridor covered by that ex. by-right corridor of use/disturbance for the ex. channel. Please let us know your determination if these or other understandings could provide an acceptable way to proceed without n As you know a special use permit would have schedule implications at this point in the project possible delaying the plan apprc month. Storm piping: since this includes runoff from the public right-of-way, it qualifies as a public facility and can be routed tl preserved slopes should be preserved to the maximum extent practicable [30.7.4.b.1.c(iii)], so it is expected that the e property will be utilized if possible. 2. Sanitary lateral:the lateral is private unless the ACSA accepts it. ACSA does not maintain private laterals and utilities tt ACSA/RWSA(or some other public entity) are considered private and do not meet the definition of a "necessary public meeting last week, the lateral can be installed under the critical slopes by boring and encasing it in a sleeve.The sleevc lateral in the future as needed without disturbing the critical slopes. Boring the lateral under the critical slopes shouldr therefore does not require a special use permit (by-right). It was also determined that using the neighbor's sanitary ou requirement for a special use permit since it is serving an existing use and the disturbance was previously approved. When do you expect the remaining VDOT and Site plan approval letters or comments to be ready? However, all of this is very approximate pending survey and further design. The main question is whether the proposed sewer lateral from the site through the preserved slopes is considered a by right u use permit. Up to this point from the comments and the initial conversations we were under the impression this is a by right L permit. It seems it should be by right either under the section necessary public facilities, necessary to allow the use of the lot as to not maybe under the distribution facility section. The site is separated from the sewer main by the preserved slopes so to not allow the sewer lateral to connect through the pr.( leave the owner of the parcel no option to develop the parcel other than to get a special use permit. Please let us know if you can give us a determination on this situation or if you have any questions.
