Cabell Jones PO Box 1320 Richmond, VA 23218-1320 401 McIntire Road, North Wing Charlottesville, VA 22902-4579 Telephone:434-296-5832 WWW.ALBEMARLE.ORG RE: LZC2021-00024 - Parcel IDs 04600-00-00-0019131 (15.81 Acres), 485 CRAFTON CIRCLE, Owner BROOKHILL APARTMENTS LLC, 230 COURT SQUARE STE 202 CHARLOTTESVILLE VA, 22902 (the "Property") To Whom it May Concern: In response to your request for a Letter of Zoning Compliance for the above -referenced Property, please be advised of the following: The Property is within the boundaries of Albemarle County and is zoned Neighborhood Model District (NMD) per ZMA2015-00007, approved November 19, 2016, with proffers (Linked) and ZMA2018-00011, approved July 17, 2019, with proffers (Linked). The permitted uses of the Property are provided in the Code of Development adopted with the ZMA2015-00007, which includes multi -family residential apartments. The Property is subject to the Airport Impact, Entrance Corridor, and Steep Slopes Overlay Districts described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance.") The Property is subject to regulations or conditions or other special limitations imposed by the County in connection with ZMA2015-00007 and ZMA2018-00011. The Property and the current use, occupancy, operation, and improvements thereof comply with the applicable requirements of the zoning ordinance of the County and applicable rules and regulations of the zoning district, including, but not limited to, compliance with respect to the following: (i) setback of the buildings from the property lines, (ii) height of the buildings, (iii) parking requirements, and (iv) area, width or depth of the land as a building site. The Property is subject to SDP2018-00050 Brookhill Block 4 approved December 17, 2018, for 316 multi -family dwellings and required parking. The Property is recognized as one or more separate parcels of land under the County's subdivision ordinance, may be conveyed, leased, or mortgaged as one or more separate parcels, and currently complies with such subdivision ordinance and other applicable subdivision laws. The Property is not subject to any conditions or special limitations imposed by the County in connection with any subdivision approval of the Property. To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no violations or alleged violations or regulations applicable to the Property, whether pending, contemplated, or having already occurred, (ii) no fees due or pending witl- respect to any matter before the County Zoning Office; and (iii) no pending application for rezoning of the Property or for a special or conditional use permit or June 16, 2021 LZC2021-00024 Page 2 variance in connection with the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property is pending or overtly threatened to the best of my knowledge. • All governmental permits and approvals necessary for the construction, use, operation, and occupancy of the Property have been issued and are in full force and effect. • The physical development on the Property approved with the site plan, may in the event of casualty or destruction, be rebuilt substantially in the same form upon satisfaction of all required building permits and site plans, as applicable. • Copies of any relevant records may be obtained via the noted links or the Community Development Department Records Public Access link below.
