Dear Cameron Langille:
We have reviewed all of your comments from April 15, 2021 and made the necessary revisions.
Please find our responses to the comments below in bold lettering.
Albemarle Countv Planner— Cameron Langille (ADDlicable Comments from Initial Site Plan
Action Letter— March 8, 2021):
1. [32.5.2 (a)] On Sheet 1.0 or the notes, please state all applicable supplemental
regulations from Section 18-5.1.60 that apply to the drive -through window.
a. Please be aware that the applicant has a filed a special Exception (SE) request to
vary the requirements of Section 18-5.1.60 (d). The SE request is going before
the Board of Supervisors (BOS) at the March 17, 2021 BOS meeting. If the Board
approves the SE request, please be sure to include the exact language from the
condition that is proposed with the SE: "The drive -through window may open for
business no earlier than 5:30AM and must close no later than 10:OOPM daily."
Drive -through specific notes have been added to Sheet C1.0.
Rev. 1: Please revise the note on Sheet C1.0 so that it states "SE202000029 approved by
Albemarle County Board of Supervisors on March 17, 2021. The following condition
applies to drive -through window hours of operation: The drive -through window may be
open for business no earlier than 5:30 AM and must close no later than 10 PM daily."
The note has been revised as requested. See Sheet C1.0.
2. [32.5.2 (a)] Please revise the zoning note so that it states that portions of the property
are within the Managed Steep Slopes Overlay District.
The Zoning note has been updated on Sheet CO.0.

ENGINEERING I DESIGN I TECHNOLOGY
3. [32.5.2 (a)] Please update the property labels for all adjacent properties on Sheet 2.0 so
that the labels state the zoning districts for those properties.
Zone information has been added to the property labels on Sheet C2.0.

4. [32.5.2 (a)] According to Albemarle County GIS, there is a parcel located north of the
site, identified as TMP045B1-05-0A-010A0, that is not shown on the site plan. Please
show these property boundaries, and state the zoning district, owner name, and
recorded instrument number for the parcel.
This County owned adjacent property has been added to the plan set.

5. [32.5.2 (d)] Please adjust the symbology used for areas of Managed Steep Slopes on all
applicable drawings. It is difficult to distinguish the western edge f where Managed
Steep Slopes are located.
A hatch has been added to make the steep slopes more clear throughout the plan set.

6. [32.5.2 (e)] Identify the types and sizes of the existing landscape features as described in
section 32.7.9.4(c).
A legend has been added to Sheet C2.0 to indicate that these trees are 8-10" ornamental
trees.

7. [32.5.2 (e)] On the existing conditions and landscaping sheets, provide labels identifying
whether the existing wooded areas are composed of evergreen, deciduous or a mix of
types of trees.
The wooded area is a mix of evergreen and deciduous trees. A label has been added to Sheet
C2.0 and 1-1.0.

8. [32.5.2 (i)] On all applicable drawings, please state the recorded instrument number for
the 18' access easement at the front of the parcel. Indicate whether the access
easement is public or private.
The recorded instrument number has been added to this 18' access easement throughout the
plan set.

9. [32.5.2 (i)] Please show and label Seminole Lane on all applicable drawings. State
whether it is a public or private street and state the recorded instrument number that
created the street right-of-way (ROW).

The label and added information has been adjusted to display on all drawings.

10. [32.5.2 Q)] Please show and label all existing water, sewer, and drainage easement on
the property. State the easement type (e.g. ACSA water easement), the easement
dimensions and the recorded instrument (deed book/page) for each existing easement
in the easement labels.
All easements and associated information are shown on C2.0. Note that there is not currently
an ACSA water easement.
Rev. 1: Comment stands pending ACSA confirmation that all existing ACSA easements are
shown.
We have confirmed with Richard Nelson at ACSA that there are no existing ACSA easements
on the project site.
11. [32.5.2 (k)] Please update labels for all proposed water, sewer, drainage, and
stormwater easements on the final site plan and state the easement type and width.
a. Prior to final site plan approval, an Easement Plat Application must be
submitted, reviewed, approved, and recorded. Once recorded, the final site plan
will need to be updated so that all new easement labels indicate the recorded
instrument number of the plat (deed book and page).
Proposed easements have been added to the plans. The Easement Plat Application
will be submitted to the County under separate cover.
Rev. 1: Comment stands, easement plat must be submitted, reviewed, approved, and
recorded prior to final site plan approval. Once the easement plat is recorded, the new
easements must be shown with their type, width, and recorded instrument number. Per
Engineering Division comments, public drainage and SWIM easements will require a
deed of dedication. Once recorded, the instrument number for the recorded deeds of
dedication must also be stated in the public easement labels.
Acknowledged. An Easement Plan Sheet (C4.1) has been added to the plan set for
clarity, and coordination is underway to get the Easement Plat prepared. Once
approved and recorded, we will add the recordation information to the plans.
12. [32.5.2 (1)] Please show and label all existing utility easements on the property. State the
easement type, dimensions, and the recorded instrument (deed book/page) for each
existing easement in the easement labels.
All easements and associated information are shown on C2.0.

13. [32.5.2 (n)] Prior to final site plan approval, please update the dumpster enclosure detail
so that it indicates the height of the screening wall.
The height of the screening wall has been added to the detail on Sheet C1.3.

14. [32.6] The final site plan must comply with all applicable requirements of Section 32.6
prior to approval.
Acknowledged. Section 32.6 has been reviewed for compliance.

15. [General Comment] Prior to final site plan approval, a Water Protection Ordinance
(WPO) application must be reviewed and approved. WPO202100003 is currently under
review, please see Engineering comments for further information.

16. [32.5.2 (p), 32.7.2.1] The proposed entrances shall be designed and constructed as
required by the standards of the Virginia Department of Transportation. VDOT approval
of the proposed entrances to the site shall be required prior to final site plan approval.

17. [32.5.2 (n)] Any proposed outdoor lighting must be shown on the site plan. A
photometric plan and lighting cut sheets must be provided with the final site plan.
Proposed lighting must comply with requirements of Sections 32.7.8 & Section 4.17 of
the Zoning Ordinance.
a. [4.17.4] Provide a luminaire schedule identifying each type of outdoor luminaire
proposed. Include the manufacturer name, model number, lamp type (e.g. LED,
incandescent, etc.), wattage/lumens emitted, and pole/mounting height. Include
a column in the schedule that identifies the symbology used for each fixture on
the lighting plan. State the number of each outdoor luminaire provided by type.
Rev. 1: Please revise the symbology used for the proposed outdoor luminaires.
They are very difficult to see on the Lighting Plan and staff can't verify the total
quantity of each outdoor light provided. It appears there may be five (5) single
asymmetric wide beams luminaires provided, not two.
Print settings have been adjusted to be more readable. Building mounted lighting has
been added to the photometric schedule.
b. [4.17.4] Provide manufacturer cut sheet for all outdoor luminaires that will emit
3,000 lumens or greater. Be sure that the cut -sheets identify that these
luminaires will be equipped with full -cutoff fixtures.
All lighting fixture cut sheets are provided on Sheet L4.0.
c. [4.17.4] Provide a table with photometric data for each luminaire type. Please
be aware that Albemarle County requires photometric plans to use a Light Loss
Factor (LLF) of 1.0 to calculate footcandle measurements on site plans.
Rev. 1: Comment not addressed. LLF uses in 0.085. Please use LLF of 1.0 and
recalculate footcandle measurements.
The Lighting Design Plan, as well as the schedule, has been updated with an LLF of 1.0.
d. [4.17.4 (b)(1)] Footcandle measurements at property lines along roads or
properties within residential zoning districts cannot exceed 0.5 footcandles.
Rev. 1: Comment stands pending revisions specified in comment # 17d above.
The Lighting Design Plan has been updated with an LLF of 1.0. The footcandle
measurements at the property lines do not exceed O.S.
e. [4.17.4 (b)(2)] Add a note to the lighting plan stating, "All outdoor lighting,
regardless of the amount of lumens, shall be arranged or shielded to reflect light
away from adjoining residential districts and away from adjacent roads."

f. [4.17.4 (b)(1)] Add a note to the lighting plan stating "The spillover of lighting
from luminaires onto public roads and property in residential or rural areas
zoning districts shall not exceed one-half foot candle."

g. [4.17.4 (a)] Add a note to the lighting plan stating "All outdoor luminaires
emitting 3,000 lumens o greater shall be equipped with a full -cutoff fixture."
A lighting plan and details are included with this submittal.

18. [32.7.9] Please provide a landscaping plan that complies with all requirements of
Section 32.7.9 on the final site plan. This includes the following:
a. Please update the landscape schedule so that column is provided that states the
canopy area per individual landscaping species, and then a separate column
stating the total canopy per species based on the quantity of each tree or shrub
species provided. The canopy areas per species must match the Plant Canopy
Calculations table hyperlinked below. Currently, some of the canopies do not
match the list.
An additional column has been added to demonstrate individual and then total
canopy area.
Rev. 1: Comment not fully addressed. Per the Plant Canopy Calculations table, the
canopy for individual London Plane trees is 479 sq. ft. Please revise.
The caliper and canopy areas listed have been updated. See Plant Schedule on Sheet
L2.0.
b. Staff suggests revising the caliper of trees provided in the landscape schedule so
that they match c ode requirements. For example, street trees are required to be
installed at calipers between 11/2 and 1 % inches. But the street trees are
proposed to be installed at 3.5" caliper.
The ARB guidelines request 3.5" caliper trees.
Rev. 1: Comment addressed.
c. [32.7.9.4 (c)] Existing landscape features as described in this Code section.
These are 8-10" ornamental trees which are all proposed to be removed.
Rev. 1: Comment not fully addressed. In order to gain the canopy bonus for total tree
canopy provided on site, the Conservation Checklist needs to be included on the plans
and signed by the owner. Please add this on the next submittal.
The signed Conservation Checklist has been added to Sheet L2.0.
d. [32.7.9.5] Update the street trees required calculation. Four (4) street trees are
required, not three (3) as currently stated. Add an additional street tree to the
landscape plan.
Per coordination with ARB, there are now 5 street trees proposed.
Rev. 1: Comment addressed.
e. [32.7.9.8] Minimum total landscaping canopy for the site area. 10% of the site
must be canopy area. Site area is calculated as described in Section 32.7.9.8 (c).
Please provide a calculation on the landscaping plan identifying the percentage
and sq. ft. of required and proposed canopy area. Be sure the calculation s
identifies where the 9,353 sq. ft. of canopy is coming from.
Additional detail on the canopy calculations has been added to Sheet L2.0.
Rev. 1: Comment partially addressed, please update the total canopy provided once the
total canopy for the proposed London Plane trees has been updated, per comments
#18a above.
The canopy area and subsequent calculations have been updated. See Sheet L2.0.
f. All proposed landscaping must be species identified on the Albemarle County
Approved Plants List.
Acknowledged. These proposed plants are on the Albemarle County Recommended
Plants List.
Rev. 1: Comment addressed.
g. Canopy areas for specific tree and shrub species can be obtained from the Plant
Canopy Calculations table.
Canopy areas have been updated to match those listed in the referenced table.
Rev. 1: Comment not fully addressed, please state the canopy coverage area for the
Winterberry shrubs in the Plant Schedule on Sheet L2.0.
The Plant Schedule on Sheet L2.0 has been updated.
New Comments Final Site Plan:
19. [32.6.2 (c)] See Engineering Division Comment #5. Please show all off -site grading needed,
including grading in the Virginia telephone easement. If grading is needed on adjacent
properties, then off -site construction easements will need to be obtained from adjacent
property owners prior to final site plan approval. These easements can be shown on the
easement plat mentioned earlier in the comment letter.
a. Please be aware that any off -site easement will need to obtain owners approval. Those
owners will need to sign the easement plat prior to County approval.
A quit claim is being pursued for the existing Virginia telephone easement. The
retaining wall design is included with this submittal and due to the low wall heights
along the southern portion, tie backs are not required along this property line. Taking
this into consideration, we do not believe a construction easement is necessary,
however, we have recommended that our Client obtain a letter of permission for any
encroachment that may occur during construction.
20. [32.6.2 (i)] Please see Inspections Division comments. ADA accessible spaces must be provided
in locations as specified by the Building Code. Accessible space may need to be relocated.
The accessible parking spaces were moved two spaces to the north. Due to the gutter as well
as the proposed inlet in the corner, that northern most parking space was avoided for
consideration as an ADA space. In our experience, due to the depression of a curb inlet, it is
uncommon that an ADA space is constructed within the slope requirements when attempting
to incorporate a curb inlet.
21. [32.7.3 and 4.12.4 (c)] Staff have received the request to modify the minimum number of
parking spaces required, and this has been forwarded to the Zoning Administrator for review.
Planning staff will forward any comments or approvals from the Zoning Administrator once their
review is complete.
a. If the request is not approved, then additional parking spaces will be required.
We received the notice that the request had been approved. A note has been added
to Sheet C0.0 stating this.
CDD ARB — Khristopher Taggart — Comment dated 04-09-2021:
1. This plan will be reviewed by the ARB on May 17, 2021. Comments will be provided
after that meeting.
Acknowledged. The ARB review comments have been received, reviewed, and addressed. The
comment response letter has been submitted to the ARB with the updated site plans and
architectural plans. These documents are available to you upon request.
Albemarle County Transportation Planning — Dan Butch:
1. As this was a Traffic Study for a SDP I simply reviewed the study for any
recommendations. The study concluded the redevelopment will have a minimal to no
impact on adjacent US29 and Hilton Heights Intersection and continue to operate in the
same LOS with minimal increase/delay. No improvements are recommended/required
for the intersection to accommodate vehicular traffic generated from the
redevelopment. Therefore, I have no additional comments.

Albemarle County Engineering— Emily Cox— Comment dated 04-13-2021:
1. WPO202100003 must be approved before final site plan can be approved.
Acknowledged.
2. Public drainage easement should be labeled as SWM facility easement as it appears to
be encompassing the SWM facility.
The easement name has been updated and an Easement Plan Sheet C4.1 has been added to
the plan set for clarity.
3. Easement should extend to include this pipe:
Based on our research, all indications point to the 12' Drainage Easement (to the north of the
project site) being public. We have reviewed old deeds and plats and understand that
originally, a 20' drainage easement was put in place to convey stormwater draining from a
few upstream lots in the Carrsbrook neighborhood to the ROW of Route 29. Later, it was
replaced with the (current) 12' Drainage Easement, which connects the 20' drainage easement
east of the adjacent gas station back to the ROW. This indicates that the easement is meant to
be contiguous through these properties. Additionally, the connecting piece was explicitly
dedicated to Albemarle County. Based on the above evaluation, we understand that this
easement would be considered public and we do not believe an additional easement would
be needed to connect to the existing inlet.
4. SWM facility easement must be recorded before this final site plan can be approved.
Acknowledged.
S. Please show permission for the proposed work offsite on all adjacent parcels as well as
in the Virginia telephone and telegraph company easement. Even if work is in an
easement, please show that the proposed work is allowed in that easement.
All work to be performed within property, right of way, or easements. Telephone easement to
be abandoned with quit claim.

1. The accessible parking space shall be on the shortest route available.
The accessible parking space (and adjacent striped area) have been moved two spaces to the
north. Due to the gutter as well as the proposed inlet in the corner, that northern most
parking space was avoided for consideration as an ADA space. In our experience, due to the
depression of a curb inlet, it is uncommon that an ADA space is constructed within the slope
requirements when attempting to incorporate a curb inlet.

Albemarle Countv Service Authoritv — Richard Nelson — Comment dated 05-26-2021
1. The existing service line to the 5/8" meter does not meet ACSA specs for a 1.5" meter.
The existing service will need to be abandoned and a 4" tap made for the new service.
Refer to attached detail.
The proposed water service layout has been revised to account for this update.
2. RWSA will need to review and approve the new tap on their water main.
Per conversations with ACSA, the proposed water service is proposed to come off of the
existing fire line to stay out of Route 29.
3. Callout unused portion of existing sewer lateral to be abandoned.
This callout has been added to Sheet C2.1.
4. ACSA GIS indicates the existing sewer lateral is 6".
The existing sewer lateral pipe label and style have been updated accordingly.
5. A backf low will be required. Confirm if this will be outside or in the building.
The backflow preventer will be located inside the building, as confirmed by the architect.
6. A grease interceptor will be required. Confirm if this will be outside or in the building.
A grease trap (outside the building) has been added and the proposed sanitary sewer layout
has been adjusted to keep the grease trap away from the drive-thru aisle.
VDOT—Willis Bedsaul:
1. No objection, see attached.
