Good afternoon Charles & David,
The County Attorney has verified that the plat can now be approved. Charles submitted a revised page to the application
that addressed the one remaining comment.
You may now submit hard copies of the plat for signature. Please submit two hard copies of the plat with notarized
owner signatures for County approval. Once will be returned to you and the other will be kept for County records.
Also, please be aware that a signed hard copy of the attached declaration will need to be submitted with the copies of
the plat that will be signed by the County. We will make a copy od the declaration to put in our file for this application,
and h hard copy will be returned to you. Once the plats have been signed and approved by the County, the declaration
will need to be recorded with the plat at the Clerk's office.
Our office is open to the public on MWF from 9 AM- 4 PM so you can drop the plat and declaration off when you are
able to. Please send me an email once the plats have been dropped off.

Yes. For future reference, see County Code § 14-212(13): "The subdivider shall place a restrictive
covenant on the lots created by the family subdivision prohibiting the transfer of the lots so created to a person
who is not a member of the inmlediate family for the retention period after the date of recordation. The restrictive
covenant shall be subject to review and approval by the county attorney before it is recorded."

FYI, below was my previous exchange with Christopher Perez about the proposed Barnett Family
Division. As noted below, County Code § 14-212(A)(1) requires that the intended grantee be a qualifying
member of each trustee's inmiediate fanrily.
According to the attached List of Heirs, Charles Lewis Barnett is the son of Alice Baber Barnett
(deceased). If Rachel Lydia Barnett is the granddaughter of Alice Baber Barnett (as the Trust instrument
indicates), Rachel cannot also be the granddaughter of Charles (Alice's son). Rachel nright be Alice's
granddaughter through another child, other than Charles.
In short, we'll need documentation of how Charles Lewis Barnett and the intended grantee are
related. Thanks.

The provision I find most confusing is #2: "if there is more than one trustee, the intended grantee is a qualifying
member of each trustee's immediate family."
The term "member of the immediate family" means the natural or legally defined off -spring, grandchild,
grandparent, or parent of the owner of property.
Therefor if one of the trustees is Mike's sister Martha Washington Barnett (hypothetical name), Mike's
granddaughter won't be eligible because Martha has no relation stated in the ordinance as a qualifying family
member? Is this correct?

Good question. County Code 14-212(A)(1) provides:
"Land owned as part of a trust for estate planning purposes may be considered to be owned by the current
owner or a member of his or her immediate family upon consideration of the following factors:
(i) the title to the real property is in the name of one or more of the trustees;
(ii) if there is more than one trustee, the intended grantee is a qualifying member of each trustee's
immediate fanuly;
(iii) if there is more than one trustee, all of the trustees agree in writing to the family subdivision;
(iv) under the trust instrument, the trustee(s) retain complete control over the trust assets; and
(v) the trust instrument allows the trustee(s) to convey real property."
In short, I'll need to see the Trust instrument to verify that the above conditions are met. It would
especially help if Mr. Barnett would point out the specific provision(s) of the Trust that address each of these
requirements. Thanks.

The above referenced family division seeks to divide a parcel of land as a family division for the granddaughter of one of
the owners, Charles L. Barnett; however, this property is owned by the Alice Baber Barnett Revocable Trust. To which
the plat has Charles L. Barnett as the signature listed as a trustee of the Alice Barber Barnett Revocable Trust.
I know family divisions are possible for property in a Trust, but the specifics elude me as I have never had one. I assume
you will want the trust's article of approval, which lists all trustees. Is this correct? What else will you need to determine
if this is eligible for a family division? Also, is it possible for a single member of the trust to sign the plat, or do all
trustees need to sign off on this division?

I know family divisions are possible for property in a Trust, but the specifics elude me as I have never had one. I assume

if this is eligible for a family division? Also, is it possible for a single member of the trust to sign the plat, or do all
trustees need to sign off on this division?

FYI, below was my previous exchange with Christopher Perez about the proposed Barnett Family
Division. As noted below, County Code § 14-212(A)(1) requires that the intended grantee be a qualifying
member of each trustee's inmrediate fanlily.
According to the attached List of Heirs, Charles Lewis Barnett is the son of Alice Baber Barnett
(deceased). If Rachel Lydia Barnett is the granddaughter of Alice Baber Barnett (as the Trust instrument
indicates), Rachel cannot also be the granddaughter of Charles (Alice's son). Rachel might be Alice's

The term "member of the immediate family" means the natural or legally defined off -spring, grandchild,

Therefor if one of the trustees is Mike's sister Martha Washington Barnett (hypothetical name), Mike's
granddaughter won't be eligible because Martha has no relation stated in the ordinance as a qualifying family
member? Is this correct?

(iv) under the trust instrument, the trustee(s) retain complete control over the trust assets; and

(deceased). If Rachel Lydia Barnett is the granddaughter of Alice Baber Barnett (as the Trust instrument

The term "member of the immediate family" means the natural or legally defined off -spring, grandchild,

Therefor if one of the trustees is Mike's sister Martha Washington Barnett (hypothetical name), Mike's

The above referenced family division seeks to divide a parcel of land as a family division for the granddaughter of one of
the owners, Charles L. Barnett; however, this property is owned by the Alice Baber Barnett Revocable Trust. To which
the plat has Charles L. Barnett as the signature listed as a trustee of the Alice Barber Bamett Revocable Trust.
I know family divisions are possible for property in a Trust, but the specifics elude me as I have never had one. I assume
you will want the trust's article of approval, which lists all trustees. Is this correct? What else will you need to determine
if this is eligible for a family division? Also, is it possible for a single member of the trust to sign the plat, or do all
trustees need to sign off on this division?

I received the revocable trust document attached to this email, and I believe this was submitted from you or
David Linke in order to address Chris Perez's comment #1(attached). I forwarded thr trust to the County
Attorney to verify that this would address the comment, but there are still issues. Please see below:
County Code § 14-212(A)(1) requires that the intended grantee be a qualifying member of each
trustee's immediate family.
According to the attached List of Heirs, Charles Lewis Barnett is the son of Alice Baber Barnett
(deceased). If Rachel Lydia Barnett is the granddaughter of Alice Baber Barnett (as the Trust
instrument indicates), Rachel cannot also be the granddaughter of Charles (Alice's son). Rachel might
be Alice's granddaughter through another child, other than Charles.
• Further documentation is needed to confirm of how Charles Lewis Barnett and the intended grantee
are related.
Until this is addressed, the plat cannot be approved. Do you have any other documentation showing your
relation to Rachel?

FYI, below was my previous exchange with Christopher Perez about the proposed Barnett Family
Division. As noted below, County Code § 14-212(A)(1) requires that the intended grantee be a qualifying

The provision I find most confusing is #2: "if there is more than one trustee, the intended grantee is a qualifying
member of each trustee's immediate family."
The term "member of the immediate family" means the natural or legally defined off -spring, grandchild,
grandparent, or parent of the owner of property.
Therefor if one of the trustees is Mike's sister Martha Washington Barnett (hypothetical name), Mike's
granddaughter won't be eligible because Martha has no relation stated in the ordinance as a qualifying family
member? Is this correct?

"Land owned as part of a trust for estate planning purposes may be considered to be owned by the current
owner or a member of his or her immediate family upon consideration of the following factors:
(i) the title to the real property is in the name of one or more of the trustees;
(ii) if there is more than one trustee, the intended grantee is a qualifying member of each trustee's
immediate family;
(iii) if there is more than one trustee, all of the trustees agree in writing to the family subdivision;
(iv) under the trust instrument, the trustee(s) retain complete control over the trust assets; and
(v) the trust instrument allows the trustee(s) to convey real property."

In short, I'll need to see the Trust instrument to verify that the above conditions are met It would
especially help if Mr. Barnett would point out the specific provision(s) of the Trust that address each of these

Hi Andy,
I took over this family division plat (SUB202100027) from Chris Perez now that he is gone. He had some review
comments that needed to be addressed (his last comment letter is attached).
Please see his comment #1. Chris asked for evidence that the owner, Mike Barnett, and his granddaughter
qualify for this family division (new lot will be owned by granddaughter, named Rachel Lydia Barnett). The
owners provided me the revocable trust agreement exhibit (attached) to address this comment. Do you agree
that this will suffice to prove that the granddaughter is eligible to own the lot through this family division?
Chris' comment #5. The template he references for the restrictive covenant is not attached to his comment
letter PDF, so I can't verify what exactly Chris sent to them. But they submitted the attached PDF that I've titled
"Declaration" and I believe this is what they submitted in order to address comment #5. If they record that
document with the plat, will that address the conditions of approval required by Section 14-212 for family
divisions?
There are no other comments remaining for the plat to be approved aside from those two comments. Please let me

Attached is the soil work and plat that the applicant submitted for the above referenced subdivision of TMP
07100-00-00-01000. The lot is being divided into two lots (Parcel "W" @ 2acres) and the residue @ 36.11
acres). Because this is a family division and the residue is over 5 acres it does not require VDH approval. But
the 2 acre lot does. Please review the attached plat and soil work.
Due to COVID-19 and social distancing rules we are all working from home and are supplying electronic

Attached is the soil work and plat that the applicant submitted for the above referenced subdivision of TMP
07100-00-00-01000. The lot is being divided into two lots (Parcel "W" @ 2acres) and the residue @ 36.11
acres). Because this is a family division and the residue is over 5 acres it does not require VDH approval. But
the 2 acre lot does. Please review the attached plat and soil work.
Due to COVID-19 and social distancing rules we are all working from home and are supplying electronic
copies of the soil work for your review. This Friday is my last day with the County, as I will be moving to
NOVA for another Planning position. Please forward your review comments to Cameron Langille (CCed to this
email).
