Subject: SUB202100017 Minims Final Plat — Two -Lot Division
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once
the following comments have been addressed: [Each comment is preceded by the applicable reference, which is
to the Subdivision/Zoning Ordinances unless otherwise specified.]
[14-302 (A)(4), 14-302 (A)(5), and 14-303 (L)] Please show all existing easements and state their recorded
instrument number across each property affected by this plat. State the easement type, width, and whether
the easement is public or private. Rev. 1: Comment addressed.
2. [14-302 (A)(10) and 14-4001 In order for new Parcel C and the residue of TMP 72-19 to be assigned one
(1) and two (2) development rights, respectively, as noted on Sheet 1, both parcels must measure a minimum
of two acres and contain a building site as defined by Section 14-4.2.1 and 14-4.2.2 of the Zoning Ordinance.
Please address the following:
a. Parcel C must measure a minimum of 2 acres that are within the boundaries of TMP 72-19 as it
existed on December 10, 1980. Currently, the 2 acres shown for Parcel C include land that was
within the boundaries of TMP 72-20. This is because two boundary line adjustments have been
done since December 10, 1980 (see plat in DB 2204, page 389 & DB 1620, page 387) to add
acreage from TMP 72-20 to TMP 72-19. Rev. 1: Comment addressed.
i. Please either draw the December 10, 1980 boundaries of TMP 72-19 on the plat, or
provide an exhibit showing the December 10, 1980 boundaries of TMP 72-19. Certify
that the proposed 2 acres of Parcel C are entirely within the December 10, 1980
boundaries of TMP 72-19. This is needed to verify that Parcel C can be subdivided using
one of TMP 72-19's development rights. Rev. 1: Comment addressed.
ii. Please be aware that it is likely that the proposed southern parcel boundary of Parcel C
may need to be shifted further south along the frontage with Miller School Road in order
to incorporate a full 2 acres of land that was within the December 10, 1980 boundaries of
TMP 72-19. Rev. 1: Comment addressed.
3. [14-302 (A)(11)] Please revise Note 41 on Sheet 1 so that it states the most recent recorded instrument for
TMP 72-19. This is DB 2802, page 604. Rev. 1: Comment addressed.
4. [14-302 (A)(15] Please state the names and addresses of all holders of any easements affecting the property.

5. [14-302 (13)(1)] Please add a date of last revision. Rev. 1: Comment addressed.
6. [14-302 (B)(5)] Please revise Note 8 on Sheet 1. Parcel C and the residue of TMP 72-19 are located within
the EC Entrance Corridor Overlay District. Rev. 1: Comment addressed.
7. [14-302 (B)(7)1 Revise Note #15 on Sheet 1 so that it states "Parcel C and the residue of TMP 72-19 are
located within the Stockton Creek Water Supply Watershed." Rev. 1: Comment addressed.
8. [14-302 (13)(10)] Albemarle County GIS shows a Water Protection Ordinance (WPO) buffer at the rear/east
of TMP 72-19. Please show and label the limits of the WPO stream buffer on Sheet 2. On Sheet 1, add a
note stating: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle
County Water Protection Ordinance." Rev. 1: Comment addressed.
9. [14-303 (C) and 14-303 (E)] Please provide boundary line measurements with bearings in degrees, minutes
and seconds along the entire perimeter of the residue of TMP 72-19 on Sheet 2. Curvilinear data shall
include radius, central angle, arc length, and tangent distances and may be shown either directly on the
corresponding boundary or surveyed line or in table form. Rev. 1: Comment addressed.
10. [14-303 (1)] Please provide A definite bearing and distance tie between not less than two (2) permanent
monuments on the exterior boundary of the property and further tie to existing street intersection where
possible and reasonably convenient. Rev. 1: Comment addressed.
11. [14-303 (L)] Please identify the location and dimensions of each public utility, drainage and sight distance
easement outside of a street right-of-way; for each existing easement, include a note stating the deed book
and page number. Rev. 1: Comment addressed.
12. [14-303 (0)] Please state the owner name under the Owner's Approval signature lines on Sheet 1. Rev. 1:
Comment addressed.
13. [14-303 (0)] Under the signature lines in the box titled "Approved for Recordation" on Sheet 1, please state
"Agent for the Board of Supervisors." Rev. 1: Comment addressed.
14. [14-308.1)] Prior to approval of this final plat, the applicant must submit a fee of $355.00 in order for the
County to conduct a Tier II Groundwater Assessment for the proposed division. Please submit the $355.00
and staff will initiate the Tier II Groundwater Assessment. Results will be forwarded to the applicant upon
completion of the assessment. Rev. 1: Fees have been paid for the Tier II Groundwater Assessment.
The assessment has been initiated but results are not vet complete. Once the assessment is complete,
results will be forwarded to the applicant. No further action or revisions are needed in order to
address this comment.
15. [14-309 and 14-3101 Health Director approval of the proposed subdivision is required prior to final plat
approval. Once the December 10, 1980 boundaries of TMP 72-19 are shown on the plat, staff will forward
the plat to VDH for review. As noted in comment #2 above, Parcel C and the residue of TMP 72-19 must
contain a building site measuring 30,000 square feet that contains adequate area for two subsurface
drainfields on each lot. See Section 18-4.2.land 18-4.2.2 of the Zoning Ordinance for further information
on building site requirements. Rev. 1: Comment addressed, see attached VDH approval letter.
a. Please show the location of drainfields for both Parcel C and the residue of TMP 72-19 on the
plat. Currently, only one drainfield is shown and this is not enough information to verify that a
building site exists on each lot. Rev. 1: Comment addressed, see attached VDH approval
letter.

RE: Review of Proposed Subdivision Plat and attached Soils Information for Individual Onsite
Sewage Systems as part of a division of Tax Map 72 Parcel 19 located in Albemarle
County, Virginia (SUB2021000017).
Dear Mr. Langille:
On June 4, 2021, the Comity of Albemarle requested the Virginia Department of Health (via the Albemarle
County Health Department) review the proposed subdivision plat identified above. This letter is to inform you
that the above referenced subdivision plat is approved for individual Onsite Sewage Systems in
accordance with the provisions of the Code of Virginia, the Sewage Handling and Disposal Regulations,
and local ordinances.
This request for subdivision review was submitted pursuant to the provisions of § 32.1-163.5 of the Code of
Virginia which requires the Health Department to accept private soil evaluations and designs from an
Authorized Onsite Soil Evaluator (AOSE) or a Professional Engineer working in consultation with an AOSE for
residential development. This subdivision was certified as being in compliance with the Board of Health's
Regulations by: Steven K. Thomas, CPSS #3401000006. This subdivision approval is issued in reliance
upon that certification.
Pursuant to § 360 of the Regulations this approval is not an assurance that Sewage Disposal System
Construction Permits will be issued for any lot in the subdivision identified above unless that lot is specifncall)
identified on the above referenced plat as having an approved site for an onsite sewage disposal system, and
unless all conditions and circumstances are present at the time of application for a permit as are present at the
time of this approval. This subdivision may contain lots that to do not have approved sites for onsite sewage
systems.
This subdivision approval does pertain to the requirements of local ordinances.
