RE: SUB202100057 Rivanna Village Phase 2 — Easement Plat
Dear Andrew,
We have received your comments regarding the above referenced project dated May 24, 2021 and
offer the following responses:
1. [14-302(B)1] Provide the date of the last revision of the plat on future submittals of this plat.
Response: Revision date added.
2. [14-302(B)5] Clarify the ZMA that applies to this easement plat and its subject property, for
note #5 on the cover sheet. The cover sheet of the plat currently states that the plat is in
accordance with the NMD of ZMA2004-00007 (which appears to be for Belvedere). However,
the application form for this plat (as well as the County's GIS) states that the rezoning for this
property is ZMA2013-00012.
Response: Note updated.
3. [14-302(B)10] Provide the following note on the cover sheet of the plat: "The stream buffer(s)
shown hereon shall be managed in accordance with the Albemarle County Water Protection
Ordinance ()hPO)." In addition, show this WPO buffer on all applicable sheets of the plat.
Response: Note added.
4. [14-303(A)] Revise the statement of consent to division on the cover sheet of the plat to include
a description of the land that is being platted with this plat.
Response: Statement updated.
5. [General Comment] Deeds for the easements are required. These deeds will be prepared by
the Engineering Division and will be required to be recorded along with the easement plat.
Response: Will await deeds from Engineering.
6. [Advisory Comment] There appear to be several proposed lots located within the stream
buffer. Although this is an easement plat, and those lots are not being created with this plat, it is
important to be aware for the preliminary and final plats of the requirement that lots cannot be
located within the stream buffers.
Response from Engineer: "The WPO stream buffer in this area will not respect the proposed
site plan improvements. These lots were vetted and approved during the WPO plan review and
approval. We can address it again at the subdivision plat level but it is believed to have been
addressed."

7. [Advisory Comment] Approval of this easement plat does not guarantee approval of the future
site plan(s), road plan(s), and final plat(s) that are required to be submitted for this development.
Those applications must still be submitted, reviewed, and approved by the County. Those
applications must also meet their individual requirements. See comment below as well.
Response: Noted. Approval of site plan is hinged on approval of this easement plat.
8. [Advisory Comment] The easements and rights -of -way provided on this plat may need to be
revised depending on the final layout of the development once a final site plan and a final
subdivision plat are granted approval.
Response: Noted.
Engineering Division Comments:
1. Vl
a. Note: Once all plat reviewers comments are addressed and final revision date is set, Engineering
will format deeds for SWM facility and public drainage easement dedication for Applicant review
and notarized signature. Applicant to record deeds with easement plat, either prior to or with the
final subdivision plat.
Response: Will await deeds from Engineering.
2. V2
a. Recommend dimension lines for L5 (IF -to -IF) to clarify L5 is not to Leaning PF.
Response: Dimension added to leaning PF for clarity.
b. Increase size of endpoint between C3 and L 1, similar to other endpoints.
Response: Node size increased.
c. Provide deed bk.-pg. ref. to US Rt. 250 public RW.
Response: Reference added.
d. Provide deed bk.-pg. ref. to Village Park, Steamer Drive, and Sedgewick Lane public RW.
Response: Refence added.
e. Furnish linework to indicate access easement connects Lazy Branch and Cattail Court.

f. Reposition bearing labels, so readable; see below:

4. V4
a. Provide/label temporary construction easement or letter of permission, consistent with Road Plan
sheet 30.
Response: Easement added to sheet V4 / V10. Letter of agreement attached.
b. Revise plat as needed to accommodate additional property owner signatures, if needed.
Response: No additional signature needed. See attached letter.
5. V6: Provide EC line -curve data (EC4, for example).
Response: Added to sheet V16.
6. VT Provide 10' Private Wall Maintenance Access Easement leader line to easement, similar to
leader line on V6.
Response: Leader added.
7. V9
a. Beginning with this sheet, check matchline references, which appear to be carryovers from earlier
sheets in plat.
Response: Matchlines updated.
b. Provide /label SWM facility access easement from Lazy Branch Lane to BMP G3, consistent with
Road Plan sheet 32. Image, below:
Response: Access easement added.
c. DE5 (tie) label obscures SW14 label; please uncover SW14 label.
Response: Label adjusted.
d. Label Cattail Court.
Response: Label added.
e. Provide endpoint: DE2-DE3.
Response: Added.
f. Provide public drainage easement for storm pipe at end of Terrapin Trace. Image, RP sheet 28:
Response: Added.
g. Provide tie to IF on boundary between Pinewood Drive Lots 14, 15, and DE or DE2, similar to
tie provided for RW26 to an IF at 119.25' boundary endpoint, shown on V9. Otherwise, it is quite
difficult to trace DEs along Cattail Drive. See DE 17 (tie), VI 1.
Response: Tie added.
h. Please provide tie between DE and DE8, and between DE8 and DE10.
Response: Additional ties added.
i. Unless change in direction of easement calls is clearly apparent, provide visible endpoints between
all RW calls and easement line segments for comparison with approved WPO and ROAD plans,
and future lot /parcel owner benefit.
Response: Nodes added throughout.
j. Provide visible endpoints between all RC-RW transitions since precise location is not apparent.
This is particularly important to county and lot owners.
Response: Nodes have been added throughout. The right of way will be dimensioned again at
the time of subdivision platting which will be much clearer for all involved. At the moment it is
just to provide context and something tangible to tie the easements to.

8. V10
a. Provide leader lines to each public drainage easement, or revise label to read `variable width
public drainage easements' at intersection of Butterfield Lane and Terrapin Trace.
Response: Label updated.
b. Please provide DE39 or DE40 tie to exterior boundary, for reason listed elsewhere.
Response: Tie added to DE39.
c. Please clarify slight offset at blue circle boundary location. Image, below:
Response: The iron does not fall at the corner, rather on line. See updated label on sheet V2.
d. Provide sufficient public drainage easement width, Lots 1-22/I-23; please ref. ACDSM Easement
width diagram. 24" DIA pipe at depth 11.4' requires Min. easement width =27'. Also, please see
review item V12.a., below.
Response: Width has been updated.
Note: No part of a structure/no improvements may occupy a public drainage easement. With final
subdivision plat, please resolve spatial conflict that appears to exist between public drainage
easement and dwellings on Lots I-22 and 1-23. Image, RP sheet 28.
Response: The site plan will be adjusted as needed.
e. Provide off -site grading easement needed to construct Terrapin Trace cul-de-sac. RP sheet 29.
Response: The parcel shown on the road plan is incorrect. That parcel was added to TMP 93A1-
4R1 with the phase lA plat recorded in DB 5032 PG 445. I have removed the light line taken
from the road plan that was causing confusion.
f. Provide /label SWM facility access easement from Mossy Rock Road to BMP 12, consistent with
Road Plan sheet 33.
Response: The access shown falls within the SWM easement. I have relabeled it as "Variable
Width Public SWM Facility and Access Easement".
g. Provide off -site grading easement for TMP 80-58A, consistent with proposed grading shown on
RP, sheet 29.
Response: Easement added to sheet V10 / Vl.
9. VI
a. Coordinate all BMP/SWM facility access easements with linework shown on Road Plan
(SUB2019000156). For example, see below:
Response: Access easements have been added where missing. Labels of easements whose
access is from the right of way have been updated. (See V 10.f above)
b. Recommend label private drainage easement across Lots G-25 thru G41.
Response: Leader added to both easements.
c. Provide /show SWM/BMP forest/open space (FOS) easement (across plat sheets) where depicted
on Road plan or approved VSMP/WP0201800007, consistent with these plans. If recorded,
please provide deed bk.-pg. ref. to recorded FOS easement. Image from RP sheet 31.

10. V 12
a. Revise public drainage easement width, Lot J-38, per ACDSM easement diagram, image /link
below, and Road Plan design storm profile (SUB201900156, sheet 67); 20' width is insufficient.
Dwelling shown on Lot J-38 of approved WP0201800007 encroaches on this public drainage
easement. No portion of a structure, looter, or constructed improvements may occupy drainage or
SWM facility easements. 24" DIA pipe at depth 14' requires Min. easement width =32'.

Response: Easement widened to 32'. Site plan will be updated as necessary.
b. Provide /label SWM facility access easement from cul-de-sac, Mossy Rock Road, to BMP J142,
consistent with Road Plan sheet 35. Image, below:

c. Similarly to item V 12.a., above, check and revise public drainage easement width as needed, Lots
J-35, J-36. 30" DIA pipe at depth 11.75' requires Min. easement width =28'.
Response: Easement has been widened and brought to attention of design team.
11. V13
a. Provide /label BMP J3 access, consistent with Road plan, SUB201900156, sheet 36.
Response: Label updated to indicate access included in easement.
b. Revise 20' public drainage easement across Lots J-6 thru J-I I to indicate private drainage
easement.
Response: Label revised.
c. Provide /show SWM/BMP forest/open space (FOS) easement across plat sheets where depicted on
Road plan or on approved VSMP/WP0201800007, consistent with these plans. If recorded,
please provide deed bk.-pg. ref. to recorded FOS easement. Image from RP sheet 36.
Response: Added a sheet to show easement (V15).
12. V 14
a. Provide off -site construction easement required to construct Lazy Branch Lane cul-de-sac. 7'
offset distance, edge of walk to PL is insufficient to construct improvements. Image, RP sheet 37:
Response from Engineering: Cul de sac in question is already constructed. This cul de sac has
already been adjusted to be >5' from adjacent property which to my recollection was required to
not require off -site easement. I would have to review past review comments to confirm.
b. Provide /label BMP J5 access, consistent with Road plan, SUB201900156, sheet 37.
Response: Access easement has been added.
13. V 15: Please check -revise duplicate DE40 table values.
Response: Labels and tables updated.
