To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned Residential - R-15. The permitted uses of the Property are provided
in Section 18 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The
Property is subject to the Airport Impact Area, Steep Slopes and Entrance Corridor Overlay
Districts as described in Section 30 of the Zoning Ordinance.
• The Property is subject to the approved site plans SDP2009-00091 "Arden Place Final' and
the most recent plan SDP2011-00040 "Arden Place Minor." It appears the property has been
developed in accord with these plans.
• The multi -family apartments ("Current Use") are a permitted use of the Property.
• There are no additional proffers or conditions associated with the Property.
• There are no outstanding building or zoning violations on file. This office does not keep track
of fire violations, you can reach the County of Albemarle Fire and Rescue at (434) 296-5833
to see if they have any fire violations on file.
• All governmental permits and approvals necessary for the construction, use, operation and
occupancy of the property have been issued and are in full force and effect.
• To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no violations or
alleged violations or regulations applicable to the Property, whether pending,
contemplated, or having already occurred, (ii) no fees due or pending with respect to
any matter before the County Zoning Office; and (iii) no pending application for
rezoning of the Property or for a special or conditional use permit or variance in
connection with the Property. Further, no proceeding to challenge the zoning or other
governmental approval or use of the Property is pending or overtly threatened to the best of
my knowledge.
• If the Property contained physical development approved with a site plan, then in the event
of casualty, the Property may be rebuilt substantially in the same form upon satisfaction of
all required building permits and site plans, as applicable.

Development Department Records Public Access link below. If unable to find the records,
then a request through the department's Records Manager, Paul Bjornsen, at

longer to fulfill.
