RE: SUB-2021-44 Victorian Heights- Preliminary Subdivision Plat
Mr. Collins:
The Agent for the Board of Supervisors hereby grants administrative approval to the above referenced
preliminary subdivision plat.
This approval shall be valid for a period of five (5) years from the date of this letter, provided that the
developer submits a final plat for all or a portion of the site within one (1) year after the date of this
letter as provided in the Section 14-226 of the Code of the County of Albemarle, and thereafter
diligently pursues approval of the final plat.
The final plat will not be considered to have been officially submitted until the following items are
received:
1. A final plat that satisfies all of the requirements of section 14-303 and sections 14-304 through
14-318 of the Code, and the conditions attached to this letter.
2. Applicable fee outlined in the application.
3. All lots must access from internal streets (Chapter 14, Section 404). To meet this requirement
easements will be required to allow lots 1-15 to access the street located on the residue lot. No
easements are shown as required by Chapter 14, Section 302(A)6
4. The dimensions and area of the residue lot are not shown as required by Chapter 14, Section
302(A)8
5. This subdivision is proposed as a bonus/cluster development. A cluster development requires a
minimum of 25 percent of the total land area of the cluster development shall be in common
open space. (Chapter 18, Section 2.2.3) Common open space may not be individually owned.
(Chapter 18, Section -3.1) Therefore, the common open space must be designated as a
separate lot. The dimension and area of common area is not shown as required by Chapter 14,
Section 302(A)8.
6. The deed book and page number of the instrument whereby the property was created, as
recorded in the office of the clerk of the circuit court of the county is not shown as required by
Chapter 14, Section 320(A)11
7. Show SWM facility and drainage easements. These easements will need deeds.
8. Retaining walls that cross lot lines will need easements and maintenance agreements/deed.

9. Trees cannot not be in any easements.
10. Based on the travelway width and the presented ROW width, no parkings signs will be required
to establish the fire apparatus travel way so it remains unobstructed
11. There is a dead end on the east side of the plans that appears to be longer than 150 feet. Clarify
this distance and if 150 ft or longer, provide an appropriate turn around
12. Submit a PDF and hard copies of the utility plan to ACSA for review.
13. RWSA approval will be required. See attached comments from RWSA for more detail.
14. Approval of the offsite sewer extension will be required prior to utility plan approval.
15. Offsite sewer easements will be required.
16. Utility plan approval will be required prior to final plat approval.
17.
This site will require two (2) road names as noted in the screenshot below. Road A will
need a name and Road B will need a name.

18. Provide right/left turn analysis for Woodburn Lane.
19. Provide additional detail and typical section for the parallel parking and the widening of
Woodburn Lane.
20. Sidewalk must wrap around the left side of the proposed entrance on Berkmar Drive and cross
the private travelway to tie into sidewalk.
21. Provide sight distance profiles for both public street entrances.
22. The required intersection sight distance on Woodburn Road is 390 feet.
23. Change labeling of dedication of right of way from VDOT to County of Albemarle.

24. Refer to VDOT's Road Design Manual, appendix F-pg., F-120, for commercial entrance designs
along highways with curb and gutter.
25. Show geometry on proposed entrances, 25ft., min. width, and 30'f., radii.
26. Show on proposed taper a 12 foot offset from edge of pavement to end of radii for entrance
onto Berkmar Drive.
27. Provide more detail on grading sheet. (See VDOT comments)
28. Provide drainage profiles on proposed drainage structures.
29. Final site plan mush show conformance with VDOT Road Design Manual Appendices B(1) and F,
as well as any other applicable standards, regulations or other requirements.
Please submit 8 copies of the final plat to the Community Development Department. The assigned Lead
Reviewer will then distribute the plat to all reviewing agencies (for ACSA, please submit 3 copies of
construction plans directly to them, as stated in their comments). Once you receive the first set of
comments on the final plat, please work with each reviewer individually to satisfy their requirements.
The Department of Community Development shall not accept submittal of the final plat for signature
until tentative approvals for the attached conditions from the following agencies/reviewers have been
obtained:
