I understand, however, this BLA has been under review at the county for almost a year. I am not trying to cast blame as
to why it has taken so long and why the county was trying to impose criteria from a site plan that was not ready to be
approved on a simple BLA, but I would like to stress the importance that this has to be completed within the next two
weeks. If there is someone else that I should be talking with, let me know. But this has gotten to the point where it is
CRITICAL that is approved. We no longer have the time for reviewers to sit on this plat for another 45 days each cycle.

Good afternoon.
No, I do not expect for it to be approved in this round of review.
Only 1 of 4 of the reviewers has provided comments so far (since it was only submitted 3 days ago) and that reviewer
has a change that will be required.
As stated in a previous email, because of your most recent change and the plat no longer being associated with a site
plan the parking compliance with the existing uses must be evaluated by zoning, which is a new reviewer.
Also, as I think you are aware, we have a very heavy workload at this time and we are all backed up.
Once I have gotten comments from all 4 reviewers I will forward you the comments that will need to be addressed.

Thanks for the history.
Bill confirmed, if there are not previously approved site plans for either parcel, you are correct.
I will just confirm that none exist for either parcel during my review.
I know the buildings are old and likely built before it was necessary.
Bill did however say that I needed to ensure Zoning & Building Inspections will need to be part of the review.
Building Inspections has been part of the review of the plat from the beginning.
So that is already covered.
Zoning will be brought in to handle any zoning clearance and parking count related issues with this new submission,
since it will no longer be associated with a site plan.

Thanks Paty. There is no site approved site plan on this project, which is why we had to submit a new preliminary plat
for the project in lieu of a site plan amendment late last year. Furthermore, since no parking spaces are being created, a
site plan or LOR is not required. I had a similar scenario with the micro -site site which did not have a site plan because
the federal government built the the site and the building. Bill Fritz made the determination that a site plan was not
required when you are not adding/creating parking spaces. This should help on this case as well.

I apologize for not responding sooner, but we are extremely backup and I wanted to get my hands on
the existing site plans, which I have not done yet.
I will accept the resubmittal, however, one or more (depending on the previously approved site plans)
LORs will be required as well in order to correct any parking calculations and statements on the site
plans that were previously approved.
So, please keep in mind that will be a required step in reference to doing this BLA.

Correct. We are good with the no -build easement on the plat as well as the parking easement. Both of
these easements are necessary with the BLA. My plan is to keep these (2) easements on the plat, and
remove all the other "proposed" easements so we can get the BLA approved and recorded, and the plat
will no longer be dependent on a site plan that is not yet even approved.

I'll reach out to our managers and the other reviewers to ask.
Please note however that it is my understanding, at a minimum, if it is allowed to be done under this
project number you will not have only a BLA.
The items require by Inspections and Engineering associated with that boundary line being right along
that building edge and the existing retaining walls, would still be required which includes an easement.
I will also have to look into the implications with the parking easement, its impact the parking
calculations of any existing site plans. It is possible that would have to still be included too, but I need to
research that.
Questions (before I reach out to others):
1. With what I've stated above in mind, do you still want me to see if it would be possible?
2. Does this mean the associated site plan is being withdrawn, or only delayed?

Can we set up a zoom call this week. This seems to be going in a different direction, and we need to fix
it. What our client wants is simply to do a Boundary line adjustment plat. That is the way the project
started, but it seems to have changed over the course of the review process with the County asking for
easements associated with the site plan that is currently under review.
Any of the easements associated with the site plan that is currently under review will be done with a
separate easement plat. We do not wish to include any of that information with the current Boundary
line adjustment plat.
Let me know a time when we can all get together and discuss the project.

can you confirm whether most -recent BLA /easement plat addresses all review comments.
If so, please confirm date last revised and Engineering can format deeds. Engineering review comments
(SUB202000113) are addressed; see email 10/1/2020 4:30 PM). With date we can format deeds.

Thanks for your patience.
With SWM Maintenance Agreement recorded (10/6), with a plat date last revised, Engineering can format
deeds for SWM /public drainage and route for internal legal review, rip or to requesting Steven's help
obtaining notarized owner signatures on these documents.
Also, please note: WPO is not yet approved. WPO plan approval is required for site plan approval. It is our
understanding the deed of easements of stormwater management /public drainage ( 2 separate documents) will
be recorded with the BLA plat. Thanks, again

Thanks for the history.
Bill confirmed, if there are not previously approved site plans for either parcel, you are correct.
I will just confirm that none exist for either parcel during my review.
I know the buildings are old and likely built before it was necessary.
Bill did however say that I needed to ensure Zoning & Building Inspections will need to be part of the review.
Building Inspections has been part of the review of the plat from the beginning.
So that is already covered.
Zoning will be brought in to handle any zoning clearance and parking count related issues with this new submission,
since it will no longer be associated with a site plan.

Thanks Paty. There is no site approved site plan on this project, which is why we had to submit a new preliminary plat
for the project in lieu of a site plan amendment late last year. Furthermore, since no parking spaces are being created, a
site plan or LOR is not required. I had a similar scenario with the micro -site site which did not have a site plan because
the federal government built the the site and the building. Bill Fritz made the determination that a site plan was not
required when you are not adding/creating parking spaces. This should help on this case as well.

Correct. We are good with the no -build easement on the plat as well as the parking easement. Both of
these easements are necessary with the BLA. My plan is to keep these (2) easements on the plat, and
remove all the other "proposed" easements so we can get the BLA approved and recorded, and the plat

Please note however that it is my understanding, at a minimum, if it is allowed to be done under this
project number you will not have only a BLA.
The items require by Inspections and Engineering associated with that boundary line being right along
that building edge and the existing retaining walls, would still be required which includes an easement.
I will also have to look into the implications with the parking easement, its impact the parking
calculations of any existing site plans. It is possible that would have to still be included too, but I need to
research that.
Questions (before I reach out to others):
1. With what I've stated above in mind, do you still want me to see if it would be possible?
2. Does this mean the associated site plan is being withdrawn, or only delayed?

Can we set up a zoom call this week. This seems to be going in a different direction, and we need to fix
it. What our client wants is simply to do a Boundary line adjustment plat. That is the way the project
started, but it seems to have changed over the course of the review process with the County asking for
easements associated with the site plan that is currently under review.
Any of the easements associated with the site plan that is currently under review will be done with a
separate easement plat. We do not wish to include any of that information with the current Boundary
line adjustment plat.

I (and the others) was most concerned about parking requirements (possibly based on past zoning clearances) for the
parcels on either side of the proposed property line.
There is not, and there will not be, a site plan to ensure that parking requirements for the businesses are met.
They are proposing a parking easement, but I don't know the details of:
• How much parking zoning has previously said each business requires.
• How much parking they will share with the adjoining parcel (no deed has been submitted yet).
Is this not something we should be concerned about and ensure they have sufficient numbers of since there is no site
plan to address it?
With a BLA I would not normally get into parking counts, but this is a unique circumstance.

I have the Easement Plat listed above and attached that I need zoning review on.
If I should distribute to another person in zoning please just let me know.
I think you and I had some previous discussions on this site, so I thought you would be appropriate.
This plat is in its 4" round of review.
It was originally associated with a site plan the Chris was reviewing (SDP2020-44).
There has been some slow downs on the progress of that site plan review so the applicant is changing this plat to only
include the Boundary Line Adjustments and any easement plats that BLA is making necessary (see attached).
Because they are doing the BLA without a site plan, and because these buildings are old and it is my understanding (see
below) that no site plans have been previously approved for them, Bill Fritz said I should include Zoning as a review on
the plat so that you could ensure any parking and zoning clearance issues are checked.
I say my understanding is that no approved site plan exists for the two parcels because Chris has stated there is none
for TMP 60-25A and County View shows none for TMP 60-25B.
County View does show SDP1987-9 for TMP 60-25A, but there are no associated documents and I can't tell if it was
withdrawn, denied or approved until I'm back in the office again.
But Chris thought there were no previously approved site plan, and SDP2020-4 did start with an Initial Site Plan
(SDP2019-58).
Even if that older site plan for TMP 60-25A was approved I will at the very least need your input for TMP 60-25B.
I appreciate any help you can provide.

You've been copied on some emails in reference to the JPA Tower Easement Plat/BLA today.
This is the plat associated with your SDP2020-44 2415 Ivy Road Commercial Site Plan project.
I not only wanted to keep you in the loop, but I also have a parking questions for you.
Attached is the recent resubmission of the easement plat that includes the BLA that was shown on your site plan.
In those other emails I copied you on, Scott Collins now wants to do "only the BLA" but some easements will be
required with that.
Do you agree that the "New Access & Parking Easement" (highlighted on page 2 of the attached plat) would also be
required with the BLA?
Otherwise it will have parking implications for any existing site plans.
Since you have previously had your head in the associated existing site plans I wanted to as you if you agree the parking
easement would be required when doing this BLA.
Also, do you agree that at least an LOR would be required to ensure that property line is shown correctly and the
parking calculations acknowledge the off parcel parking?
Or do you consider any of this an overkill?

Correct. We are good with the no -build easement on the plat as well as the parking easement. Both of these easements
are necessary with the BLA. My plan is to keep these (2) easements on the plat, and remove all the other "proposed"
easements so we can get the BLA approved and recorded, and the plat will no longer be dependent on a site plan that is
not yet even approved.

Please note however that it is my understanding, at a minimum, if it is allowed to be done under this project number
you will not have only a BLA.
The items require by Inspections and Engineering associated with that boundary line being right along that building
edge and the existing retaining walls, would still be required which includes an easement.
I will also have to look into the implications with the parking easement, its impact the parking calculations of any
existing site plans. It is possible that would have to still be included too, but I need to research that.
Questions (before I reach out to others):
1. With what I've stated above in mind, do you still want me to see if it would be possible?

Can we set up a zoom call this week. This seems to be going in a different direction, and we need to fix it. What our
client wants is simply to do a Boundary line adjustment plat. That is the way the project started, but it seems to have
changed over the course of the review process with the County asking for easements associated with the site plan that is
currently under review.
Any of the easements associated with the site plan that is currently under review will be done with a separate easement
plat. We do not wish to include any of that information with the current Boundary line adjustment plat.

Please find attached a pdf copy of the Easement Plat Application & Checklist for SUB2020-113, a pdf copy of
the revised Boundary Line Adjustment and Easement Plat, last dated Revised September 16, 2020, and a pdf
copy of the SWM Facilities Agreement -Party Wall Easement deed.
The plat has been revised to reflect your 2nd round comments, dated Rev. 1: September 8, 2020 as follows:
Planning:
5a. The Easement Plat Application & Checklist is attached.
b. The additional fee was paid on September 15th (Transaction ID 0282945533968050W).

7a)i. This easement was removed from the plat as suggested by Scott Collins on 9/16/2020 (private sewer
lateral -not crossing any property lines -no need for easement).

3. The width of the New Public Drainage Easement has been increased to 20'.
4. The plat has been revised to reflect the New Stormwater Maintenance Facility Easement (1329 thru D35).
5. A 10' retaining wall & maintenance easement has been added to the plat (deed attached).
6. This plat does not create any new points on the boundary line adjacent to T.M. 60-25. Ownership
information is not required. It is shown as an additional reference only.
7. The title of the plat has been revised to also reflect the new easements.

1. The plat has been revised to call out the new ACSA waterline easement.

Yes, it is under SDP2020-44 Ivy Road Commercial Redevelopment Plan.
Chris P. is the planning reviewer coordinating it.
It doesn't help that they changed the name 0.
There has been only one round of review.
County View says that the Final Site Plan was distributed to you on 5/15/2020.
If you have sent your comments to Chris he has not yet put them up on County View.
I've attached a copy of the site plan submitted in May.
I'll wait for you to review SUB2020-113 (recently changed to an easement plat), based upon this, and look for a final
comment from you when you are able to do so.
Question: Do you think Dyon may have made the same oversight, of thinking it was still a BLA as it was first submitted?
His comment was "R WSA has no further comments on the plat."

ACSA easements. I was looking on CountyView to confirm if a site plan had been submitted with this, but could not find
