Virginia State Code requires that notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore,at least two fees for public notice are required before a Special Use Permit may be heard by the Board of Supervisors. Applications reviewed by the Board of Zoning Appeals,however,only require one public hearing and therefore require just one fee for public notice. The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner notification to be between$400 and$450 per hearing. The purposes for a pre-application meeting are to:(i)provide the applicant and the county a common understanding of the proposed project;(ii)inform the applicant about the proposed project's consistency with the comprehensive plan,other relevant policies, and county regulations;(iii)broadly identify the planning,zoning and other issues raised by the application that need to be addressed by the applicant;(iv)inform the applicant about the applicable procedure;and(v)allow the director to identify the information the applicant must submit with the application,including the supplemental information delineated in subsection(c). Receiving the relevant supplemental information will allow the application to be comprehensively and efficiently reviewed (i)Common understanding of the proposed project • The applicant is proposing to construct a new church building on site with the following specifications: o 2-story metal church building approximately 42,900 square feet o 200 parking spaces, including parking underneath the building o Demolition of the existing church to occur after new building is complete (ii)Consistency with the Comprehensive Plan • The Places29 Master Plan designates the property as Urban Density Residential,which calls for residential uses at a density of 6-34 units per acre and allows for neighborhood-serving institutional uses,such as churches and schools as secondary uses. • In addition to conformity with the Land Use recommendations of the Master Plan staff will be reviewing your application for consistency with the principles of the Neighborhood Model. • With the overall design of the site we would encourage you to create a design that is in keeping with the principles for pedestrian access,interconnected streets and transportation networks, buildings and spaces of human scale,and relegated parking. (iii)Broadly identify the planning,zoning or other issues raised by the application to be addressed. This parcel is Zoned R-6, Residential which permits churches via special use permit(SP).There is already an SP for this site(SP200400045)for the existing church. But the addition of a new church will require an amendment to this SP.The following issues were discussed in the pre-app meeting and should be considered whith your SP application: 1 • Fire/Rescue will require a second entrance fora structure larger than 62,000 ft,inclusive of the parking area underneath the building. • There are safety concerns with the existing entrances and VDOT recommends closing one of the entrances.The applicant may submit a spacing exception application to request to keep both entrances; however,VDOT has stated that it may be difficult to justify the need for two entrances for this site. • Staff recommends the applicant explore a connection with CaTech to satisfy Fire/Rescue's second entrance requirement and to promote interconnectivity and improve access to the site. • Applicable setbacks for the structure are non-infill(25'maximum front setback). • Required parking is calculated based on the size of the sanctuary space. • There is a 35' height limit for the new structure. The following issues should be addressed with the site plan: • A fire hydrant will be required within 100 feet of the FDC connection. • A sprinkler system will be required for the structure. • The existing waterline connection may need to be upgraded depending on the demand created by the use. • Any disturbance to the managed slopes on site must comply with design standards in Section 30.7.5. • Redevelopment of the site will require compliance with current stormwater regulations. (iv)Applicable procedures • The proposed use requires the submittal of a SP application and additional information(see below). • The use will also require the submittal of a major site plan amendment.This can be submitted either simultaneously with the SP or after approval of the SP. • If you submit major site plan amendment and SP application simultaneously,the fee for the initial site plan will be waived (Section 35.2). ® Community Meeting: o The applicant is required by ordinance to undertake a community meeting process as part of the review of the SP requests.See attached Community Meeting Guidelines for more information. o The applicant should work with the Places29-Rio Community Advisory Council to use their monthly meeting as the Community Meeting for this project. o Staff will work with you to generate a list of adjacent property owners that should be notified about the Community Meeting. o Please keep staff informed of the community meeting location and time.Staff will attend the meeting to answer questions, but the applicant is responsible for facilitating the discussion. (v)Identify the information the applicant must submit with the application,including the supplemental information. • An SP application and fee of$1075. • The site plan amendment application(if submitting simultaneously with the SP). • The SP application should include the appropriate signature of the owner,the owner's agent,or a contract purchaser(see separate handout regarding authorized signatories). • The latest recorded plat(s). • Include the attached SP checklist with your application submittal. Virginia State Code requires that notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore,at least two fees for public notice are required before a Special Use Permit may be heard by the Board of Supervisors. Applications reviewed by the Board of Zoning Appeals,however,only require one public hearing and therefore require just one fee for public notice. The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner notification to be between$400 and$450 per hearing.
