This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final site plan for all or a portion of the site within one (1) year after the date of this letter as provided in Section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final site plan. The final site plan will not be considered to have been officially submitted until the following items are received: 1. Afinal site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code. 2. Applicablefee. Please submit digital copies, or at least 12 paper copies, of the final plans to the Community Development Department. The assigned Lead Reviewer will then distribute the plans to all reviewing agencies (for ACSA, please submit 3 copies of construction plans directly to them, as stated in their comments). Once you receive the first set of comments on the final site plan, please work with each reviewer i ndividually to satisfy their requirements. [14-302(A)(4)] Private easements. Indicate on the plat whether the "New 48' Access Easement" is public or private. 2. [14-302(A)(5)] Greenway easement. This parcel is also subject to a 50ft Greenway Easement, per DB 3580 PG 497 (see attached deed book document for reference). Locate and label this easement on the plat. 3. [14-302(A)(8)] Proposed lots. Please be aware, the final plat will need to note the original parcel acreage, prior to subdivision. 4.[14-302(A)(9)] Building sites on proposed lots. The plat should address whether a building site exists on each of the proposed lots. If the required building site exists, the plat should provide the following note: "Lot 1, Lot 2, and the residue of TM P 76-55A each contain a building site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance." 5. [14-302(A)(16)] Dam break inundation zone. Provide a note on the plat that states that the subject property is located in a State Dam Break Inundation Zone. 6. [14-302(B)(5)]Zoningnotes. a. On the cover sheet, "Zoning" notes should state that: "The property is subject ZMA201200007 and its associated proffers." b. Preserved steep slope areas on the property should be located on at least one of the plat maps. c. Albemarle County GIS indicates the subject property is also subject to Airport I mpact Area overlay district. Please revise the overlay district notes to include this overlay. d. Please revise the special use permit information to be provided within the "Zoning" notes, instead of the "Overlay District" notes. 7. [14-302(B)(7)] Reservoir watershed; agricultural//forestal district. Please state whether the parcel is in a water supply watershed. Also, provide a note to indicate whether the parcel is within an agricultural//forestal district (Note: Moore's Creek is not a water supply watershed and this parcel is not within an agricultural//forestal.) 8. [14-302(B)(9)] Flood plain. On the plat map, locate areas of the property that lie within the flood hazard overlay district. 9. [14-302(B)(10)] Stream buffers. Due to the presence of stream buffers on the property, please provide the following note on the plat, in accordance with the water protection ordinance: "The stream buffer shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." 10. [14-317] Maintenance instrument. Please be aware, a maintenance instrument, evidencing the perpetual maintenance of the proposed private street will need to be reviewed and approved by the County Attorney's Office prior to final plat approval. PRIVATE STREET REQUEST Staff hereby authorizes, under Sec.14-233(B)(1), the private street requested with this preliminary platfor a parcel in the development area based on the following findings dictated by 14-234(C) (ordinance language shown in bold italics): 1. The private street will be adequate to carry the traffic volume which maybe reasonably expected to be generated by the subdivision. The adequacy of the travelway was reviewed and approved with SDP201700012, the final site plan for the subject parcel. Staff has no reason to believe that the proposed subdivision will change the adequacy of the travelway in supporting the expected traffic volume to be generated by the development. The applicant, in this case, is simply proposing to subdivide the parcel such that each approved building is relegated to an individual lot. To facilitate the subdivision, the applicant needs private street authorization to provide a principle means of access to the new lots, as required by Sec.14-401(F). 2. The Master Plan does not provide for a public street in the approximate location of the proposed private street. 3. The fee of the private street will be owned by the owner of each lot abutting the right-of-way thereof or by an association composed of the owners of all lots in the subdivision, subject in either case to any easement for the benefit of all lots served by the street, Prior tofinaI plat approval an instrument evidenci ng the maintenance of the private street will need to be submitted to the County for review and approval by the Cou nty Attorney's Office, in accordance with Sec.14- 317 of the subdivision ordinance. The approved and signed maintenance agreement must be recorded with the final plat. 4. Except where required by the commission to serve a specific public purpose, the private street will not serve through traffic nor intersect the state highway system in more than one location; and Based on the location of the proposed private street shown on the preliminary plat, the private street will not serve through traffic nor intersect the state highway system in more than one location. The street will only interest 5th Street/Rt 631 and only in one location. 5. If applicable, the private street has been approved in accordance with section 30.3, flood hazard overlay district, of the zoning ordinance and other applicable law. Portions of the subject property are located in a flood hazard overlay district. Albemarle County Engineering staff reviewed the plat and had no concerns regarding the establishment of the private street. The plat indicates a maximum building height of 65 ft., the required width for a fire apparatus access road for any building over 30 ft tall is 26 ft but plans only show 24 ft in road profile. Please ensure access roads for fire apparatus meet required width based on building height. 2. The plans are not clear on exact type of building (s) going on the subdivided lots. There is onlyone access route suitable to meet the requirements as an emergency access road and initial assessment is this project may need an additional access point besides the one proposed.
