RE: Public Recreation Area
Earlysville Forest PUD
Dear Fred:
A condition of the rezoning petition for Earlysville Forest PUD
required that "the public recreation area shall be dedicated
prior to any site plan or subdivision approval. " The subdivision
plat for Section One of Earlysville Forest was signed for
recordation in May, 1981. Sheet 2 of the plat depicts Parcel R
as "Public Recreation Area" consisting of 8. 56 acres (attached) .
County tax records currently list ownership of Parcel R to the
Earlysville Forest Land Trust (i.e. - developer) . My questions
to you are as follows:
1. Did recordation of the subdivision plat with the notation
"Public Recreation Area" constitute fee simple transfer of
Parcel R to the Board of Supervisors?
2. If the answer to Question 1 is "no" , what additional actions
are necessary to complete transfer?
3 . I have received inquiry from the YMCA as to usage of a
portion of Parcel R for a swimming pool. Under the terms of
dedication for "public recreation" usage and given the fact
that the YMCA is not a public agency would this be a
permissible usage? (I recall that Mr. St. John offered
opinion when the Board was considering location of the WPED
radio tower in Mint Springs Park) .
I have in hand a rezoning petition to amend the Earlysville
Forest PUD which is tentatively scheduled for Planning Commission
review on February 18, 1986. An early response to my inquiry
would be greatly appreciated.
