Dear John:
As we have discussed over a number of months, Earlysville
Forest Land Trust, in connection with its development of the
commercial area in Section One, needs to place septic fields in a
portion of the land now designated as Public Recreation Area.
We have previously discussed whether the recreation area has been
transferred to the public and the County Attorney has opined that
the land has been "dedicated. " [Enclosed is a copy of Fred
Payne's February 3, 1986 letter] Accordingly, we think the best
course to follow is to ask the Board of Supervisors to amend the
PUD to delete the word "public" from the description of the
recreation area and to grant whatever other consents might be
necessary to permit use of the recreation area for these septic
fields.
I have enclosed a copy of a May 29, 1986 plat of the
commercial area; of a sketch showing the area in which the septic
fields to serve the commercial area will be located; a copy of
the April 20, 1981 approval of ZMA-81-11; and a copy of the
Declaration of Covenants, etc. for Earlysville Forest.
We would like to put this matter before the Board of
Supervisors as soon as possible. Please let me know what
additional information you will need in order to place this
before the Board.
