Box 2013 Charlottesville, VA 22902-0013 Dear Dan: The purpose of this letter is to clarify and amplify a telephone conversation I had with you some months ago concerning a right of way that exists between property owned by Mr. Allen Kindrick and Earlysville Forest Drive in Earlysville Subdivision. At that time I told you in a telephone conversation that I had viewed the easement document and it stated that Mr. Kindrick had limited use of that right of way for access to a single family dwelling and for farm vehicles. It is my recollection that that document also stated that any use over and above that which occasioned the need for upgrading of any of the roads in the Earlysville Forest Subdivision would be done at the expense of Mr. Kindrick. The County is in no way a party to this easement agreement. If Mr. Kindrick were to propose any intensification of use of that easement the County's normal review process would involve consultations with the Virginia Department of Transportation. If, at that time, you informed us that that use would necessitate the need for upgrading any of the roads in Earlysville Forest Subdivision, the County of Albemarle would require that Mr. Kindrick accomplish this upgrading or provide other means of access. It appears, therefore, that not only the private easement agreement, but also normal County procedure would require that any additional traffic over this very minimal level on the roads in the Earlysville Forest Subdivision would come under review of the County and the Virginia Department of Transportation.
