(the "Property")
To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned Planned Residential Development (PRD), with an underlying density
of Residential, R-15. The permitted uses of the Property are provided in Section 19 of
Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The Property is subject to
the Airport Impact and Steep Slopes Overlay Districts described in Section 30 of the Zoning
Ordinance. Multi -family apartments are permitted by right in this zoning district.
The development of the Property was approved by site plan under the old zoning ordinance
adopted April 15, 1968. These parcels were subsequently zoned to PRD without an
application plan as part of the County's comprehensive rezoning in 1980. Absent an
application plan which usually sets density and design standards for the planned residential
district, the project itself, as currently developed, becomes the standard. Therefore, the
Property complies with the Zoning Ordinance as a Planned Residential Development and
may continue as it exists. However, any change in density, design, or use would require
compliance with the current Zoning Ordinance. The zoning of abutting properties can be
seen on the linked zoning map.
The Property is subject to site plan SDP-204, which show development of: 126 dwelling
units in 21 structures with 215 parking spaces; 72 dwelling units in 12 structures with 108
parking spaces, and; 42 dwelling units in 7 structures with 63 parking spaces, The site plans
were approved in 1969, 1970 and 1971, respectively.
• To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no violations or
alleged violations or regulations applicable to the Property, whether pending,

contemplated, or having already occurred, (ii) no fees due or pending with respect to
any matter before the County Zoning Office; and (iii) no pending application for
rezoning of the Property or for a special or conditional use permit or variance in
connection with the Property. Further, no proceeding to challenge the zoning or other
governmental approval or use of the Property is pending or overtly threatened to the best of
my knowledge.
If the Property contains physical development approved with a site plan, then in the event of
casualty, the Property may be rebuilt substantially in the same form upon satisfaction of all
required building permits and site plans, as applicable.

Development Department Records Public Access link below. If unable to find the records,
then a request through the department's Records Manager, Paul Bjornsen, at
pbiornsen(a)albemarle.org may be made. If the request is not based in Virginia, it will take
longer to fulfill.
