The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed. (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further
review.): [Each comment is preceded by the applicable reference,which is to the Subdivision/Zoning
Ordinances unless otherwise specified.
1 [ZMA2013-14,ZMA2000-9] Sheet V2 depicts a small area of land on the southwestern end of Open
Space C,which is below the 20' public access easement, the site plan depicts this area as HOA
dedicated open space with the public access easements through it. Revise to be in conformity with the
site plan.Please work with Scott Collins to coordinate the final subdivision plat and the final site
plan. Rev 4. Comment addressed.
2. [ZMA2013-14,ZMA2000-9] Sheet V3 depicts a small area of non-shaded land on the southern end
of Open Space C,which means it's not part of the SWM, forest, and open space easement; however,
sheet V2 includes this area as part of the publically dedicated land to the County. Please review these
sheets and ensure they are accurately depicted and match the intent of your proposal. Rev 4.
Comment addressed.
3. [ZMA2013-14, ZMA2000-9] Ensure the open space areas depicted on the final subdivision plat and
the final site plan match. Currently the proposed acreages of Open Space dedicated to public use and
to the HOA do not:match. Specifically the plat lists HOA Open Space A as 4.172 acres but the site
plan lists it as 6.90 acres Also,the plat has County Dedicated Open Space Al as 5.473 acres but the
site plan lists it as 9 55 acres Also,the plat has County Dedicated Open Space C as 10 727 acres but
the site plan lists it as 6.23 acres. Also, the plat has HOA Dedicated Open Space B as 1.531 acres but
the site plan lists it as 6.90 acres.Please work with Scott Collins to coordinate the final subdivision
plat and the.final site plan Rev 4. Comment addressed.
4. [Comment] The road plan depicts public drainage easements at the entrance of Lewis and Clark
Drive (where it connects to Rte. 29-specifically, I am talking about the areas associated with the
culvert pipe under the entrance of the road and the outfall areas on either side of it),however these
easements are not being dedicated to public use on the final plat;rather,they are being dedicated to
the HOA as open space.
Please revise the final plat and the final site plan to match the road plan, as these areas are part of the
public right-of-way and shall be dedicated to public use as they are needed for road maintenance
purposes. Rev 4. Comment addressed.

5. [14-314] Provide deeds for areas to be dedicated to public use for review and approval by
the County Attorney Also,provide deeds for all public access easements. Rev 4.Comment not
addressed.
6. [14-317] Provide instrument evidencing maintenance of all improvements that are not to be
maintained by the County or other public agency. Rev 4. Comment not addressed.
7. [Comment] The plat should be held till the Final Site Plan,WPO Plan, and Road Plan are further
along in their reviews and closer to approval to ensure that the easements and features associated with
the proposal are approvable and match these other plan sets. Rev 4. Comment addressed.
8. [ZMA2013-14,ZMA2000-9] Revise the)statement of consent to include reference to TMP 32-22P in
the signature block. Rev 4. Comment addressed.
9. [ZMA2013-14,IX,9.1] Provide all temporary construction easements to allow Stormwater Basin#10
to be redesigned and enlarged to accommodate the school lot Stormwater Rev 4. Comment
addressed.
10. [14-414, 14-311,4.1] Public Water and Sewage System. Lot 1 is served by an offsite public water and
the public sewer connections.Prior to final subdivision plat approval the sewer and water connections
serving lot 1 shall be built or bonded.
11. [ZMA2013-14,ZMA2000-9] Proffer 5.3.1(c). Phase III Road Improvements. Prior to subdivision
plat approval proffer 5.3.1(c) shall be complied with by receiving road plan approvals,posting the
associated bonds, and obtaining the associated permits required to construct the phase III road
improvements.
(c) Phase 111 Road Imnrovements. Prior to approval of a subdivision plat or
site plan for any development of the Neighborhood Investments Property or any portion thereof,
Owner shall obtain all associated permits and post all associated bonds required for the
construction of the following road improvements (collectively, the "Phase III Road
Improvements")to the extent any such road improvements have not already been completed:
(1) Northernmost Entrance(opposite Lewis Clark Drivel on U.S
Route 29:
(i) U.S.Route 29 Southbound—construction of left toot lane
with taper.
(ii) Northwest Passage from U.S. Route 29 to the south
property line of Tax Map 32,Parcel 22K as shown on the Application Plan.
(iii) U.S.Route 29 Northbound—construction of a right hand
turn lane,the geometries of which will be subject to VDOT approval.
(iv) If the traffic signal to be constructed by others is in place
prior to Owner commencing work on this Nonhemmost Entrance,and such traffic signal only
includes three legs,Owner shall add the fourth leg to the signal,which shall include additional
mast arms,signal heads and ancillary equipment necessary to support Northwest Passage's use
of the intersection, as determined by VDOT If such traffic signal is not in place and the
vehicular traffic generated by the Project causes the VDOT signal warrants to be met,and VDOT
requires that a traffic signal be installed as a condition of the entrance permit,Owner shall install
such traffic signal.
12. [ZMA2013-14 Proffer 5.3.1(c), SP2006-34 Conditions] The final subdivision plat shall not be
approved until SP2006-34 conditions#4 and#2 have been satisfied.
Condition#4• County approval of a grading and erosion and sediment control plan prior to issuance of
a grading permit for modification of the existing stream crossing Condition#2. County and VDOT
approval of final design plans and hydrologic/hydraulic computations for the stream crossing.
Proffer 5.3.1(c)stipulates that prior to the approval of a subdivision plat that the Owner must obtain all
associated permits and post all associated bonds required to construct the phase III road improvements.
The grading and erosion and sediment control plan cannot be approved by the County until the final
design plans and hydrologic/hydraulic computations for the stream crossing are approved by VDOT and
the County. Please submit the final design plans and hydrologic/hydraulic computations for the stream
crossing to VDOT and the County for review
13. [ZMA2013-14,ZMA2000-9 Application Plan] The application plan requires fee simple dedication
of land to the County to the northeastern most tip of the property. Revise the plat to add a minimum
of 20' strip of land to Open Space B1 to connect to the TMP 32-22K1. See below exhibits from
application plan and from plat.

Engineering—Matthew Wentland
1. A Deed of Dedication will need to be signed and recorded for the SWM facility easements and the SWM
Forest and Open Space easements. This will filled out by the County and forwarded to the applicant when the
plat is nearing approval. It is recommended the County fill out the draft of the deed as to shorten review time.
Please note that the revised Stormwater Maintenance Agreement(with the VSMP plan)will have to be
completed first.
2. Provide language in the deed(or other documentation)that will allow the requrred work(such as the
mitigation)to be done in the portion being deeded to the County.
