Hi all,
At this time, there are no plat -related comments. The following comments were provided by Zoning:
"Per Section 4.12.13f, I have consulted with the County Engineer and find that the modification to allow the
dumpster pad on Parcel 39 to be jointly used by both Parcel 38 and Parcel 39 meets the requirements outlined
in 4.12.13f. As there will be a recorded easement for shared -use of the dumpster, the public health, safety, or
welfare would be equally served by the modification, as the dumpster pad design and screening will be as
required by the Ordinance, the modification would not be a departure from sound engineering and design
practice, and the modification would not otherwise be contrary to the purpose and intent of this chapter.
One condition of approval is that they provide evidence of the recordation of the shared -use agreement."
In reviewing the shared use agreement provided, the agreement needs to be revised to meet the requirements of 14-
317. Please see the code section for more information, as there are several requirements, or the attached checklist
which itemizes the necessary elements to satisfy the code section. I also attached an example template provided by the
County for general private improvement maintenance agreements.
Below are some additional notes:
• The County does not need to sign the agreement. We only need to review it to confirm the regulations are
being met.
• The agreement should reference the dumpster and pad being developed per the proposed site plan
amendment (i.e. site plan titled --- prepared by --- and dated ---) in addition to relevant County requirements.
• The agreement should also explicitly include a provision that allows present and future tenants of TMP 60-38
onto TMP 60-39 to access the dumpster pad. This provision will work in lieu of an easement plat, that would
otherwise provide and ensure access.
