Yes, once the plat is approved you need to pickup the plat and then take it and the signed/notarized Declaration
of Coy& Restrictions to the Clerk's Office for recordation. I believe you have the notarized copy of the
Declaration as I utilized an electronic word doc to receive County Attorney approval of that document. About
your VDOT question, I just asked them and they said: that's standard VDOT language in every letter,you are
good to go. You've already been approved on the permit application process.

I believe they have 90 days to review these proposals;however,typically they provide their reviews much quicker.Based
on the amount of time that has passed since we last checked in with them I feel its appropriate to touch base with them for
a status update.I'll contact each of the departments and see when they anticipate completing their reviews...this will also
help ensure they have everything they need to conduct their review.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section has reviewed the Price Family- Subdivision Plat, dated March 23, 2020, revised April
02,2020 as submitted by Commonwealth Land Surveying, LLC, and find it to be generally
acceptable.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The

1. [14-212]Affidavit. Provide a completed,signed,and notarized affidavit verifying family relationship of grantor
to grantee.The affidavit that was submitted with the application was not notarized. Please revise this document
and provide a signed and notarized copy of this form.Notably the daughter of the property owner qualifies for
the family subdivision based on her status as an immediate family member',however,the son-in-law is not an
immediate family member and shall be removed from the affidavit and not be part of the division.The son-in-
law is only permitted to be part of the division for purposes of securing any purchase money and/or construction
loan,including bona fide refinancing,or if the lending institution requires in writing that the spouse of the

I have "in hand" the paperwork for the drainfields. The survey and paperwork show a primary
and reserve_drainfield on the two new lots as well as my existing and a reserve drainfield on the
residue lot I am retaining. The paperwork also shows a possible well sight on Lots 1 and 2
(and, of course I already have a well on the Residue Lot). One of the pages is too large for me
to scan and email; so can you tell me the best way to get the total packet to you? Jason Kyser,
who did this work, told me that I need to submit the original (blue ink, which I have signed)
- plus two copies (although, if this is all going to be processed electronically, I do not know why
additional copies would be required); and a cover page. I have scanned the 8x 11 pages, but do
- -not know how to handle the larger piece of paper. I have attached copies of what I can scan to
this email.
The VDOT work is near completion by the contractor for my daughter and son-in-law and as
soon as I get confirmation from them (and how we then get VDOT to verify its completion) I
can get that to you.

8x11) and then he copies a small section of that for each lot and attaches what he needs to
prepare to that. I can come by and get that and then get it to Jason; or, you can call Jason to let
him know it is ready; whatever is the best/easiest/fastest way to get it to him.

VDOT — I have hired the contractor for my daughter and son-in-law's home to take care of that
as he has experience in this type of situation. I am waiting to hear back from him on its
resolution. I had the area surveyed and it is basically just trimming back branches.
Drain Fields — I have spoken with Jason Kyzer, who did the work; and, I do not know why he
did not give me the complete paperwork for the two lots being divided out; and, I am just
waiting on him to come back out, find a secondary drain field on the acreage I am retaining and
completing the paperwork. Once that is done, Commonwealth Land Surveying will complete
the plats.

Soil Evaluation, it states:
EITHER provide documentation of previous Health Department approvals that each existing

the results of percolation tests or other methods of soil evaluation used to determine the
suitability of the soil for septic systems with conventional drain fields for each lot, so that the
agent can forward them onto the Health Department for review and approval.
I provided both the previous Health Department approval of the currently in use drain field for
"each" (i.e., the only) existing primary structure; AND the suitability of the soil for septic
systems with conventional drain fields for the two new lots.
It appears that the "OR" has been changed to an "AND." Had I not provided the information
for the existing structure, and complied with the "or" it would appear that I had met the
requirements.
If required, I will do it (another $585 expense); but, that requirement now seems inconsistent
with the previous "or" language.

Question: If you can answers IF VDOT says that improvemeinb need to be made at the
entrance point off of Secretarys Rd., would that be within a highway easement so no permission
would be required; or, would I be at the whim of the property owner who owns 115-8A (the
property where the gravel lane comes off of Secretarys Rd.)? I can't answer that at this time as I
don't have VDOT's review. But you are thinking on the correct lines of the various
possibilities.

and, to correct a typo in the notarization block. This document and the lending institution's
letter have been forwarded to the County Attorney for review.
I previously sent to you the information re the septic system requirements —please advise when
you are able if that is all that is needed.
Please submit this information and I'll forwarded it to VDH for their review.
Unless I am missing something, I think the last piece will be the VDOT determination. We
have contacted my daughter's builder for a contractor for that should VDOT provide a

requirement to improve the tallypoint. The plat was forwarded in VDOT, pending their
review.

1. [14-212]: My daughter has emailed their lender for documentation of the
requirement that both names be on the title/deed.

3. [14-302(A)(10), 10.3.1]: Our intent is to limit further division; as any further
division of the two 21 acre lots would exceed the 31 acre rule, so they will not be
further subject to division.
Understood. Please use the note I provided to accomplish this.
10. [14-316] Approval of entrance onto public streets. It was my understanding that,
as a family subdivision, I was not subject to road improvement requirements that
would normally apply to a division of land. Am I mistaken on that? Family subdivisions
are held to a lesser standard for private streets pursuant to Section 14-412. Namely you
will not be required to upgrade the entire private road to standards of a road that
serves 6 or more lots which must meet VDOT standards for a public street); however,
the one caveat to this is the entrance onto a public road,which still must meet VDOT
standards and if needed may need to be upgraded to meet their standards prior to plat

approval, we will see what W-u3T says once they review it. The enlisting entrance may be
adequate and not need an upgrade.

Affidavit that Christopher needs...not sure why the original that I dropped off at CDC
has not been provided to those working on the application.

Dear Mr. Perez:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
.Section has.reviewed the Price Family- Subdivision Plat, dated March 23, 2020,revised April
02, 2020 as submitted by Commonwealth Land Surveying, LLC, and offer the following
comment.
1. The entrance is required to be a low volume commercial entrance. This type of entrance
requires stopping sight distance be provided. Please demonstrate that these standards
can be met.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the VDOT Charlottesville Residency Land Use Section at(434)
422-9399 for information pertaining to this process. If you have further questions,please contact
Willis C. Bedsaul at 434-422-9866.

Thank you. I just sent you 3 emails as I had not realized my earlier email to you with 4
attachments was stuck in my Outbox. These items have been received and sent to VDH
electronically.
NOW I think I have submitted everything; and, we are just waiting on VDOT review. Correct. I
received the County Attorney review and he approved the restrictive covenants and the lenders
paperwork. Please submit signed and notarized copy of the restrictive covenant. Thanks
Question: If you can answer it. IF VDOT says that improvements need to be made at the
entrance point off of Secretarys Rd., would that be within a highway easement so no permission
would be required; or, would I be at the whim of the property owner who owns 115-8A (the
property where the gravel lane comes off of Secretarys Rd.)? I can't answer that at this time as I
don't have VDOT's review. But you are thinking on the correct lines of the various
possibilities.

Please-find addressed the revised restricted covenants form to include the date of this latest Plat;
and, to correct a typo in the notarization block. This document and the lending institution's
letter have been forwarded to the County Attorney for review.
I previously sent to you the information re the septic system requirements —please advise when
you are able if that is all that is needed.
Please submit this information and I'll forwarded it to VDH for their review.
Unless I am missing something, I think the last piece will be the VDOT determination. We
have contacted my daughter's builder for a contractor for that should VDOT provide a
requirement to improve the entry point. The plat was forwarded to VDOT, pending their
review.

I have a few questions and comments:
1. [14-212]: My daughter has emailed their lender for documentation of the
requirement that both names be on the title/deed.

2. [14-212(B)]: Will do.

3. [14-302(A)(10), 10.3.1]: Our intent is to limit further division; as any further
division of the two 21 acre lots would exceed the 31 acre rule, so they will not be
further subject to division.
Understood. Please use the note I provided to accomplish this.
10. [14-316] Approval of entrance onto public streets. It was my understanding that,
as a family subdivision, I was not subject to road improvement requirements that
would normally apply to a division of land. Am I mistaken on that? Family subdivisions
are held to a lesser standard for private streets pursuant to Section 14-412. Namely you
will not be required to upgrade the entire private road to standards of a road that
serves 6 or more lots which must meet VDOT standards for a public street); however,
the one caveat to this is the entrance onto a public road, which still must meet VDOT
standards and if needed may need to be upgraded to meet their standards prior to plat
approval, we will see what VDOT says once they review it. The existing entrance may be
adequate and not need an upgrade.
11. [14-309 & 14-310]: I have today reached out to a company to get that
accomplished.
12. [14-302(6)(1): Is this tied in with #3, above? yes

Do you know what happened to the hard-copy original of my Family Subdivision
Application that I dropped in the box at CDC? It has the only copy of the notarized
Affidavit that Christopher needs...not sure why the original that I dropped off at CDC
has not been provided to those working on the application.
Ms. Price sorry for the inconvenience, I'm teleworking due to Covid-19 and social
distancing rules. I do not have the hard copy file at this time. I am reviewing the
proposal based on the documentation that was submitted to me electronically by Steve
and yourself and what is uploaded to our County's project database. I've addressed the
issue in the latest comment response letter (attached). Hope this helps move things
along.

Please find attached the notarized Declaration.
To my understanding the two remaining items are:
VDOT —I have hired the contractor for my daughter and son-in-law's home to take care of that
as he has experience in this type of situation. I am waiting to hear back from him on its
resolution. I had the area surveyed and it is basically just trimming back branches.
Drain Fields — I have spoken with Jason Kyzer, who did the work; and, I do not know why he
did not give me the complete paperwork for the two lots being divided out; and, I am just
waiting on him to come back out, find a secondary drain field on the acreage I am retaining and
completing the paperwork. Once that is done, Commonwealth Land Surveying will complete
the plats.
I just wanted to update you on what is happening.
