This is because they can do a private street with the Rural Division. We have not required them to do a two step. William D. Sudduth III—Rural Division and Boundary Line Adjustment I reviewed SUB2020-76 (attached)and provided a comment to Roger Ray Associates about a private street not being approvable via a boundary line adjustment pursuant to Sec 14-232. Gwen wrote back challenging this reading based on previous conversations with you and Bill about this being permitted.I figured I'd do her the courtesy of following up with 1 you as she requested;however, I belir - hat your email, provided below, was merciy guiding her on how to submit such a large plat with multiple actions going on with it.Your initial guidance in the email doesn't seem to tell her that a BLA could approve a private street.Did either of you discuss this aspect of the proposal in detail w/them? Regardless, your initial guidance doesn't count as a review nor does it trump the ordinance but I figured I'd ask you before responding to her. The best sheet to view the item under question is sheet 3 of the plat. All is not lost for this private street, as I gave them the option to submit this as a two-step procedure by combining portions of TMP 22-9, TMP 22-14 and parcel X on this plat, then recording it and then submitting a two-lot subdivision with a private street. That looks to be the Rural division which includes the groundwater fee as well. Make sure ou also provide the necessary maintenance agreement for the private street so that it can be reviewed properly Francis 2. These parcels are all under the same ownership, except for Parcel X, containing 1.02 acres. The acreage of each adjustment under the same ownership is not applicable since the plat shows the total acreage of each lot. 3. Ok. 4. Ok.
