RE: Special Exception Application, for Homestay Zoning Clearance Application,
Transaction number: #00019028.
To Whom It May Concern:
Herein we provide a completed special exception application, with the following
narrative. Specifically, we are seeking a zoning clearance and special exception for a
homestay use within the existing primary dwelling at 3393 Loch Brae Lane, Parcel
ID 05800-00-00-00311 ("Parcel Y"): The property is in a Rural Area (RA) and is 5.31
acres. The main structure is a five -bedroom home eligible for whole -home
homestays. Other structures on the property include a framed garage and two
framed sheds.
Albemarle County Code §18-5.1.480)(2)(v) requires a minimum yard of 125 feet
from all property lines for parking and structures used for a Homestay in the Rural
Areas (RA) zoning district County Code §18-5.1.48(i) (1) (ii) allows that setback to
be reduced if a special exception is approved by the Board after notice has been
provided to abutting property owners, per County Code §18-5.1.48(i) (2).
Per a land survey performed in July 2020 prior to our purchase of the home in
September 2020, the structure is 119.4' feet from a 30' private access easement on
neighboring Parcels X-3 to the Southeast, and 124.1' feet from Parcel X-2 to the
Southwest The use requires a special exception for the foregoing setbacks. Both
neighboring parcels, which were separated from Parcel Y in 1987, remain
undeveloped wooded properties with no structures, and the majority of those
properties consist of steep slopes and ravines.
The homestay complies with the 125-footset back from the Northeastern (Loch Brae
Lane) and Northwestern Parcel X-2 and Parcel X-1) property lines. The parking
locations comply with the 125-foot setback in all directions. The nearest houses on
Parcel X-1 and Acreage Parcel E-1 are each approximately 475 +/- feet away from
the homestay, and each is screened by 400 +/- feet of trees and vegetation.
Per County Code §18-5.1.48(i)(2), we are providing written notice/copies of this
application to the owners of the neighboring Parcel X-3 and Parcel X-2, per the

mailing addresses found in the Albemarle GIS and email addresses available on
public websites that correspond with the owners' names, and will seek supporting
letters, should the owners reply to our notifications. One owner has a recorded
address in North Carolina and the other in Massachusetts.
Given the foregoing, we seek granting of a special exceptions upon consideration of
the following:
(i) There is no detriment to any abutting lot; and
(ii) There is no harm to the public health, safety, or welfare.
