Ben,
You are correct SUB2020-165 is ready for recordation in the Clerk's Office. Please record it in the Clerk's
Office. I don't see any additional drainage easement depicts on this parcel as it relates to the site plan. I will say
the"proposed parking and access easement"will need some type of recordable instrument assuring
continuation of off-site parking whenever the parcel is subdivided, as required by Section 4.12.8(e) of the
Zoning Ordinance. But that can happen at the subdivision stage.
Section 4.12.8(e)Instrument assuring continuation of off-site parking If stand-alone parking or off-site shared parking is to be provided,the applicant shall submit
with the application for a site plan,site plan waiver or,if a site plan is not required,with an application for a zoning compliance clearance,an instrument that
restricts the use of that part of the land on which parking is provided to that use,and assures that a minimum number of parking spaces as required by this section
shall be established and maintained for the life of the use.The instrument shall be in a form that is suitable for recording,shall be subject to review and approval as
to fonn and substance by the county attorney,and shall be recorded in the office of the clerk of the circuit court of the county before the site plan or site plan
waiver is approved.As the parking requirements for the use or structure change,subsequent instruments may be submitted,reviewed,approved and recorded that
rescind or modify the prior instrument.

Can you confirm that no further deeds are needed for the drainage on this property?

Looking over the deed of dedication for the drainage easement,this deed has the easement to be public,as the deed is to
the County and has Jeff Richardson's signature page.However,the plat lists this drainage easement as private.The deed
needs to be changed to be private. This would explain why the County never reviewed this deed,nor does it need to.
As for the maintenance agreement easement deed.This maintenance agreement was already approved by the County back
in Dec and we held it till the final plat was ready for approval,which all we are waiting on now is ACSA approval of the
plat. The most recent version of the deed that you emailed me has additional changes beyond what was requested by the
County Attorney before we approved it back in Dec.Do you want to move forward with this revised deed and toss the
previously approved one?What has happened to change what was previously approved?

Got it. I'm not 100%certain which easement is SUB202000164, but, based on the context, it seems like the one that we
did not receive comments on.
If that's the case, I think we have our answer and we won't require anything further.

deed.

We sent revisions to two deeds to the county in November and we only received responses on one of them (see the
markup attached which we received on 12/2). I am also attaching the email where I sent the deeds to David to pass
along to you My understanding is that he delivered both deeds.

The County Attorney reviewed the revised deed and has some questions. As he understands it, the applicant
requested modified language back in November. The County responded with proposed final language, which
the applicant signed and returned in December. He believes an agreed deed was already signed by the applicant
and was pending only the County's signature and final recordation as of mid-December. He wants to know has
happened since then to change what the applicant previously signed and submitted to the County? Any idea
why that signed deed was not ultimately recorded?
