Christopher I just had Mrs. Finley and John Finley come in to sign the plat and they wanted to change Note#18 with the division rights. I knew Mae Finley on parcel 17-25E4-had 2 division rights but I did not know how many rights John Finley had on parcel 17-16.The 25 Acre parcel can never be subdivided even if it had division rights.Once the 25 Acre parcel is sold _____ Mrs. Finley will need to use one of her division right to divide off her 39 Acre parcel from her son John's Parcel 17-16. I know all this is confusing but this is the history that will help explain the process. Mae Finley had a interested buyer for her residence but not the entire farm.The existing branch that we used for the new property line has steep rocky banks that is physically imposable to cross.When we surveyed the branch the 25 acres exceeded the 16 acre limit.To use the 16 acre limit with the house,this left 9 acres with the farm that was physically isolated.Thus John met with someone in the planning department to learn what could be done to meet the ordinance and not have 9 acres left that no one could access.John was advised by whom ever he met with to do a BLA and use the creek for the division line and join his parcel with the 25 acre parcel as one.Then he could subdivide the 25 acre parcel as a new lot.Thus he still needs to subdivide off the 39 acre farm as a new parcel.To subdivide the plan is to use one of the two remaining division rights. I am sorry for all the changes but we are getting close. Christopher - The Finleys have a:sale of the 25.933 Ac parcel in early December.With the below plat this would still require a second plat of division to be submitted and approved by this date. With this not being feasible I would like to discuss a second option. If I take the plat below and swap Parcel A with residue parcel then the sale of the residue parcel could take place in early December:The second plat would still occur but not under an unrealistic time frame.
