I went to put away the file for this item and then realized your property is currently owned by a LLC. This is very
problematic and prohibits the subdivision from qualifying for a family subdivision.Thus the family subdivision option
discussed in the last email is not an option either.How would you like me to proceed?Do you want to withdraw the
application currently in our office or do you want me to finish the review and take a formal action on the proposal,which
will be a denial.I am really sorry about this,but am glad I caught it before you went through all the trouble of submitting
a family division.
Please advise.

[14-302(B)(7),3-202(A),3-202(A)3] Per our conversations this afternoon I have reviewed the plat and it cannot be
approved because of it being in the Agricultural District. However, as discussed that provision of the ordinance does not
apply to a family subdivision.Because of this you have requested to switch this application to a family subdivision and
move forward with the review.Per our discussion you have owned the lot for a minimum of 4 years,you plan to sell/give
the lot to your son, and you understand the 4 year holding period on both lots after the division is approved/recorded.
Aside from this guidance I have not conducted a full review on the family subdivision proposal at this time but will
review it once the above has been completed.
In order to facilitate this I need you to withdraw the previous application(SUB2020-196)by sending me an email
requesting it be withdrawn. I then need you to fill out the family subdivision application,LINK here and attached.I spoke
with my supervisor and we are willing to roll over the fee you already paid into this new application.You will only be
responsible for the difference which is a$516 fee*.
Once the revised plat,application&associated family division documents, and fee is paid intake will assign this a new
subdivision application number and we'll move forward with the review. Please request the withdrawal no later than
Dec 19th otherwise I will have to tak( action on the current submittal.
*Here is the math explaining the difference:you paid$581 already, the family division is$742 +$355 fee for a Tier II
groundwater study Thus the difference owed is$516
