HomeMy WebLinkAboutSUB202000195 Agreements 2020-11-02 FIRST AMENDMENT TO DECLARATION OF PROTECTIVE COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS b� THIS FIRST AMENDMENT TO DECLARATION is made this .z day of /1/410\l'el , 2020, by and between STANLEY MARTIN COMPANIES, LLC, a Maryland limited liability company ("Declarant") and SPRING HILL VILLAGE OWNERS ASSOCIATION,INC., a Virginia non-stock corporation("Association"). WITNESSETH : WHEREAS,Declarant is the owner of certain real property in Albemarle County,Virginia on which it will develop a planned community called Spring Hill, and has subjected said real property to covenants and restrictions by Declaration dated September 1, 2020, of record in the Office of the Clerk of the Circuit Court for Albemarle County,Virginia,in Deed Book 5382,page 138 (the"Declaration"); WHEREAS, the parties desire to amend the Declaration to include certain additional easements. NOW, THEREFORE, Declarant and Association declare that the following amendments are hereby made to the Declaration: The following sentence is hereby added at the end of Section 7.01(i)(i): "In addition, Declarant or the Association, as appropriate, shall be solely responsible for selecting and maintaining all landscaping in those areas labeled"New Var.Width Landscaping and Maintenance Easement" and "New 10' Landscaping and Maintenance Easement" on that plat prepared by Roudabush, Gale & Assoc., Inc, dated October 28, 2020, entitled "Plat Showing Public Access Easements & Landscaping and Maintenance Easements Spring Hill Village Subdivision 1 . T Scottsville District, Albemarle County, Virginia,"recorded in the Circuit Court Clerk's Office of Albemarle County,Virginia in Deed Book ,page . All other terms of the Declaration remain in full force and effect without amendment.
