VA 22902-3200 401 McIntire Road, North Wing Charlottesville, VA 22902-4579 Telephone:434-296-5832 WWW.ALBEMARLE.ORG RE: LZC2021-00012 - Parcel ID 059D2-01-00-010B1 (1.05 acres), Owner — 1010 EDNAM LLC 400 LOCUST AVE STE 3 CHARLOTTESVILLE VA, 22902 Albemarle County (the "Property") Mr. Shevlin: In response to a request for a Letter of Zoning Compliance for the above -referenced Property, please be advised of the following: • The Property is currently zoned Commercial Office ("CO") and R-4 Residential as described in Sections 23 and 15 of the ("Zoning Ordinance"), respectively. The Property is subject to the Entrance Corridor ("EC"), the Airport Impact Area ("AIA") and Steep Slopes Overlay Districts as described in Section 30 of the Zoning Ordinance. • This alignment of zoning districts has been in effect since 1977 when the CO Zoning was approved in the current configuration and includes Parcels 10B and 10132.The zoning was approved with ZMA1977-00021 on November 2, 1977. The Zoning Map Amendment application does not contain proffers. No other ZMA applies to the Property. • The uses of the Property are outlined in Section 23 of the Zoning Ordinance. The current use is a permitted use in the CO zoning district. The residential portion of the Property has no physical development approved and because of the configuration it may not actually be possible to develop with a residential use. • The Property has been developed per the following site plan; SDP1982-00012 approved on August 5, 1982. • There is a variance on the Property, VA1982-00082. This was to allow the reduction of the distance between curbing so as to allow length of parking spaces and the width of travel ways to be smaller than the Zoning Ordinance required in 1982. • To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no violations or alleged violations or regulations applicable to the Property, whether pending. contemplated or having already occurred, (ii) no fees due or pending with respect to any matter before the County Zoning Office; and (iii) no pending application for rezoning of the Property, or for a special or conditional use permit or variance in connection with the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property is pending, or, to the best of my knowledge, overtly threatened. March 25, 2021 LZC2021-00012 Page 2 • The Property is now recognized as one or more separate parcels of land under the subdivision ordinance of Albemarle County, may be conveyed, leased, or mortgaged as one or more separate parcels and currently complies with such subdivision ordinance and other applicable subdivision laws. The Property is not subject to any conditions or special limitations imposed by Albemarle County in connection with any subdivision approval of the Property. • In the event of casualty, the Property may be rebuilt substantially in its current form (i.e. no loss of square footage, same building footprint) subject to the approval of a building permit in compliance with new building codes, zoning or subdivision requirements (such as bulk standard requirements, height, setback requirements, and site plan complaince). • Copies of any relevant records may be obtained via the noted links or by using the Community Development Department Records Public Access link below.
