To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned R-15, Residential. The permitted uses of the Property are
provided in Section 18 of Chapter 18 of the Albemarle County Code ("Zoning
Ordinance"). The Property is subject to the Entrance Corridor, Airport Impact and Steep
Slopes Overlay Districts described in Section 30 of the Zoning Ordinance.
The current use on the property is a permitted use within the zoning district.
• The Property is subject to Site Development Plan, SDP-0000-00264, dated April 1969
and amended in January of 1971, and to Variance VA-2011-00001 for reduction in lot
frontage and building setbacks.
• The Property, also known as the Barracks West development was originally developed
as the Old Salem Apartments in accord with the noted site plan. At that time the Property
was zoned Residential-R-3. The development has previously been determined to be
legally nonconforming because it was developed prior to the adoption on December 10,
1980 of the current Zoning Ordinance. Prior to the Property being condominiumized it
contained 18.357 acres, and contains a total of 364 dwelling units. This is a gross
density of 19.82 dwelling units per acre. At the time the Property was developed the
maximum density in R-3 was 20 units per acre. The Property is served by 598 parking
spaces. The current Zoning Ordinance limits the density in the R-15 district to 15
dwelling units per acre and requires 2 parking spaces per unit containing 2 or more
bedrooms, both the density and amount of parking provided have previously been
determined to be legally nonconforming.
• The abutting properties are zoned RA, Rural Areas, R-4, Residential, R-6, Residential,
and R-15, Residential.
To the best of my knowledge, the Property is currently in compliance with all
applicable requirements of the Zoning Ordinance. A review of our files found (i) no
violations or alleged violations or regulations applicable to the Property, whether
pending, contemplated, or having already occurred, (ii) no fees due or pending with
respect to any matter before the County Zoning Office; and (iii) no pending
application for rezoning of the Property or for a special or conditional use permit or

variance in connection with the Property. Further, no proceeding to challenge the
zoning or other governmental approval or use of the Property is pending or overtly
threatened to the best of my knowledge.
• In the event of casualty, the Property may be rebuilt substantially in the same form upon
satisfaction of all nonconfoming regulation, required building permits and site plans, as
applicable.
• Copies of any relevant records may be obtained via the noted links or by using the
Community Development Department Records Public Access link below. If unable to
find the records, then a request through the department's Records Manager, Paul
Bjornsen, at pbiornsen(a)albemarle.org may be made. If the request is not based in
Virginia, it will take longer to fulfill.
