The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [ZMA201800019] Per proffer #2 of ZMA201800019, access easements must be provided to TMP 04664-00-00-
005A0 and TMP 03200-00-00-029D0. These access easements should be provided where proposed private streets
connect to these two adjacent parcels.
a. Planning staff is working with the County Attorney's Office to obtain a template for the private access
easement agreement. This may be a separate deed that will need to be recorded with the final plat, or it
may be in some other form of instrument. The instrument template will be provided to the applicant at a
later time once it has been drafted.
2. [14-302 (A)(8)] Please label the open space parcel adjacent to the street entrance onto Proffit Road on Sheet 2.
State the acreage of the open space parcel.
3. [14-302 (B)(1)] Please add a date of last revision.
4. [14-302 (B)(5)] Please revise Note A on Sheet 1 so that it states, "AIA Airport Impact Area Overlay District"
5. [14-302 (B)(8)] Please add the minimum and maximum garage setbacks to the setback note on Sheet 1. Consult
Section 4.19 of the Zoning Ordinance for these setback standards.
6. [14-303 (H) and 14-421] Please fill in the blank in Note 2 on Sheet 1.
7. [14-303 (L) and 14-431] Please see attached Engineering Division comments. Some drainage easements and
stormwater easements that are currently labeled as private will actually need to be public. Please revise the
easement labels accordingly.
8. [14-303 (M)] Please see attached E911 comments. Plat must state all proposed street names prior to approval.
9. [14-303 (N)] Please add a note to the plat stating "The streets in this subdivision may not meet the standards for
acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of
Transportation or the County of Albemarle."

10. [14-303 (5)] Please see attached Engineering Division comments regarding required control points.
11. [14-311] Prior to final plat approval, Water Protection ordinance (WPO) plan must be approved. Please contact
the Engineering Division directly for WPO related questions.
12. [14-311, 14-410, 14-412, 14-422] Prior to final plat approval, road plan application must be approved. Road
plans are currently under review, application number SUB202100124.
13. [14-316] Please see attached VDOT comments. VDOT is requiring that the final site plan for this project,
SDP202100008, be approved prior to final plat approval. VDOT approval of entrance onto public streets is
required prior to final plat approval.
14. [14-317] Instruments evidencing maintenance of certain improvements required as part of the final plat approval.
The instrument must address all requirements specified in subsections of Section 14-317 of the Subdivision
Ordinance. Features that require instruments identifying ownership and maintenance responsibilities are as
follows:
a. All open space parcels to be owned by the HOA.
b. All private easements, including the proposed private street easements.
c. If the applicant will provide a draft of HOA covenants to cover these items, the County Attorney's office
has asked that the applicant complete the HOA Covenant checklist that is attached to this comment letter.
Submit a copy of the completed checklist with the draft covenants, if applicable.
15. [14-400] Please update note 8 on Sheet 1 so that it identifies whether this is a Standard level Cluster
Development, or a Bonus Level Cluster Development.
16. [14-302 (A)(13), 14-414 and 14-4301 ACSA approval required prior to final plat approval. Revisions to proposed
ACSA easements may be required, pending completion of ACSA review of the plat.
17. [14-431] Please see attached Engineering Division comments. All proposed public stormwater and drainage
easements will require a deed of dedication to be recorded with the plat. Deed templates will be drafted by
Engineering Division staff and provided to the applicant once all substantive revisions to the plat have been
addressed. Please contact the Engineering Division directly for questions related to stormwater and drainage
easement deeds.
18. [14-434 and 14-435] Prior to final plat approval, all on -site improvements required by the Subdivision Ordinance
must be completed (built) or bonded. This includes stormwater management facilities, drainage facilities, and
streets.
19. [Sec. 14-202.1] Provide owners notarized signature when final copies are submitted for County signature and
approval.

This site will require a three (3) new private road names. Per Sec. 7-200-B of the County's Road
Naming and Property Numbering Ordinance (Page 2 of PDF).
"It is intended by this article that all roads within the County which serve or are designed
to serve three or more addressable structures will be named; and that all addressable
structures within the County will be assigned property numbers.
See the screenshot below. Also note if Road A is in alignment (or less than 60ft) entrance
from the Proffit Road North development going in it will need to have the same name of
Acadia Dr as chosen for their project.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced Proffit Road Townhomes South Final Plat, as
submitted by Roger Ray & Assoc. Inc., dated June 8, 2021 and find it to be generally acceptable.
1) Site plan approval should be required prior to final plat approval.
A VDOT Land Use Permit will be required prior to any work within the right of way. The
owner/developer must contact the Charlottesville Residency land Use Section at (434) 422-9399
for information pertaining to this process.

Review of Private Improvement Maintenance Instrument
(Albemarle County Code § 14-317)
RE: SUB
Identify the specific provision(s) of the proposed Private Improvement Maintenance Instrument that meet
each of the following requirements of Albemarle County Code § 14-317(A:
1.Identify the plat to which the instrument applies; if the plat has been recorded, the
identification shall include a deed book and page number.
2. State that the improvement will be maintained in perpetuity.
3. State that the improvement will be maintained to a standard that, at a minimum, ensures that it
will remain in substantially the condition it was in when approved by the county if the
improvement was installed prior to the agent signing the plat or the condition it is to be in
when the surety was released as provided in section 14-436; for a private street, shared
driveway, or alley, the instrument also shall state substantially as follows: "The travelway shall
at all times be maintained so that it is safe and convenient for passenger automobiles and
emergency vehicles at all times except in severe temporary weather conditions."
4.If the instrument pertains to the maintenance of one or more private streets, alleys or shared
driveways, it shall define "maintenance" by stating substantially as follows: "For purposes of
this instrument, `maintenance' includes the maintenance of the private streets or alleys, and all
curbs, curbs and gutters, drainage facilities, utilities, dams, bridges and other private street
improvements, and the prompt removal of snow, water, debris, or any other obstruction so as
to keep the private street or alley reasonably open for usage by all vehicles, including
emergency services vehicles."
5.Describe the condition of the improvement when it was approved by the county if the
improvement was installed prior to the agent signing the plat or the condition it is to be in
when the surety was released as provided in section 14-436.
6.Identify the timing or conditions warranting maintenance of the improvement.
7.State a means to collect funds necessary for the cost of maintaining the improvement; at a
minimum, the means stated shall include the right of any landowner subject to the instrument
to record a lien against a non-contributing landowner, to bring an action at law to collect the
funds, or both.
8.Describe how maintenance costs will be prorated among the landowners subject to the
instrument (e.g., "equally," or on a percentage basis); if any lot within the subdivision may be
further divided, the instrument shall also describe how maintenance costs will be prorated
among the landowners after division.
9. State substantially as follows: "No public agency, including the Virginia Department of
Transportation and the County of Albemarle, Virginia, will be responsible for maintaining any
improvement identified herein."
