Re: SUB202100096 Belvedere Phase 5A Final Plat— Review Comments
Dear Cameron,
We have received the comments for the above referenced project dated July 16, 2021. Below
are responses to the comment letter:
1. [General Comment] This final plat application has been submitted under Section 14-207, which is a
final plat following final site plan approval. The final site plan for Belvedere Phase 5A, SDP202000036, is
not yet approved.
Prior to final subdivision plat approval, the final site plan must be approved.
Response: Approval received 7-23.
2. [14-302 (A)] The new segments of Fowler Street and Fowler Circle have not yet been dedicated to
public use.
Please address the following:
a. [14-302 (A)(14)] Please add a note to the plats stating the acreage of the rights -of -way of these
streets.
Response: Note added.
b. [14-426] Add a note to the ROW labels stating "hereby dedicated to public use."
Response: Label added.
3. [14-302 (A)(9)] Add a note to the first sheet stating that Lots 1-43 each contain a building site that
complies with section 4.2.1 of the Albemarle County Zoning Ordinance."
Response: Note added.
4. [14-302 (A)(14)] Add a note to the plat stating who will own and maintain the open space parcels.
Response: Note added.
a. [14-302 (A)(14)] The easement plat application that was approved for this project included a set of
Homeowners Association (HOA) covenants that were reviewed by staff and approved with the easement
plat. Have those been recorded? If so, please add a note to the plat stating the recorded instrument
number of the recorded HOA covenants.
Response: The approved HOA does have not been recorded. Since paragraphs 1 and 2 of the
5A Supp. Declaration identify lots by number and type, it really doesn't make sense to
record the Declaration except with the subdivision plat. That's how they have typically
been being recorded.
5. [14-302 (B)(5)] Please label all setback lines shown on Sheet V3.
Response: Labels added.
6. [14-303 (C)] Pending approval of the final site plan for Block 5A, lot sizes may need to change if they
are changed on the final site plan prior to its approval.
Response: Lots shown per approved site plan.

7. [14-303 (H)] If any monument required by this chapter will be installed after recordation of the final
plat, the certification of the professional engineer or land surveyor shall so note.
Response: See note 13 on sheet V1.
8. [14-303 (1) and 14-421] Please provide a definite bearing and distance tie between not less than two
(2) permanent monuments on the exterior boundary of the property and further tie to existing street
intersection where possible and reasonably convenient.
Response: All exterior boundary monuments are shown on sheet V2. Although the closest
intersection is visible on sheet V2, a distance has been added for further clarity.
9. [14-414] Prior to final plat approval, ACSA and RWSA approval of connection to public water and sewer
is required.
Response: ACSA and RWSA have both signed off on the final site plan.

if any further action is needed to address these items.
