Tucker County Planner County of Albemarle 414 East Market Street Charlottesville, Virginia 22901 Re: Boar's Head Inn Addition Site Plan Dear Mr. Tucker: I am enclosing herewith a site plan for the Boar's Head Inn addition noting the landscaping, walkways, and details of the courtyard planting plan as submitted by Meade Palmer's office in Warrenton, which indicates utilities and grading plan, too. I am also enclosing the bid for the landscaping as contracted for with Ivy Nurseries. You will notice that the first bid of approximately $20,000 was based on the planting plan dated January 30, 1980. The present contract price is for approximately $10,000 and reflects the elimination of approximately half of the original planting. There also have been a few other minor changes in walks, paving, and fencing of the courtyard, but no major differences in things like grading, drainage, utilities, etc. We trust that these changes from the originally approved site plan can be approved on an administrative level, but if this is not possible, please let me know and I will appear before the commission to explain what we are attempting to achieve. County of Albemarle OF 414 East Market Street 4 ALBEMARLE , j '' Charlottesville, Virginia 22901 T �%,�> Re: New Addition - Boar's Head Inn Site Plan and Final Occupancy Permit Dear Mr. Tucker: It is my understanding that there are still two items which remain unresolved relative to the final certificate of occupancy for the addition to the Boar's Head Inn. This letter will be addressed to these two items, and if this is not a correct understanding, please let me know as soon as possible so that we won't have any delay on our final occupancy permit. The first item pertains to the realignment of the parking on Berwick Road across from the new addition. The plans at present show perpendicular parking and it is my understanding that this was to be angular parking. If this is still to be a condition, then we will see that this is taken care of immediately - marking off the lines to show the appropriate type of parking. The second item refers to the intersection of Berwick Road and Wellington Drive, where the new exit road from the parking area of the new wing enters Berwick. I respectfully request that Wellington Drive not be relocated from its present position for various reasons. One is the location of utilities, water and sewer, which are installed along this road. Since the road is already on the outer limits of the fifty foot right-of-way granted to Wellington, any further movement to the west would possibly encroach on private property outside of the right-of-way. In attempting to align these two roads, we have moved the exit road as far to the east as we can without encroaching on the property lines of Ednam Village. Please understand that this is intended only to be an exit from the parking lot, not an entrance, and 95 percent of the traffic from the parking area will turn right or west towards the Boar's Head Inn. There will be very little traffic, if any, going across Berwick, or turning into the parking area from Berwick. (At the present moment, until construction is finished, we are using this as an exit and entrance, but only for a small portion of the opened rooms.) Tucker June 13, 1980 Page Two Re: New Addition - Boar's Head Inn Site Plan and Final Occupancy Permit plan was presented to the Planning Commission, the question of the realignment of road at this intersection was referred to in a very informal sort of way with the County Engineer stating that it would be his opinion that it would be nice to have the two roads directly opposite each other. It has always been my opinion that this was never actually made a condition of the approval of the site plan. Because we have moved the road from the parking area as far as we can towards Ednam Village, we sincerely hope that after you view the site as it exists, you will be able to see that this should not present any traffic problems and will be acceptable as built. I particularly noted the contents of Mr. Donald A. Gaston's letter to Johnson, Craven & Gibson under date of August 25, 1978, and Mr. Rogan's letter to the Planning Department under date of September 13, 1978. In my judgment, unless this drainage problem is solved to the complete satisfaction of the County Engineer, then the County has the power (and not only the power, but the duty) to withhold the occupancy permit for the Boar's Head Inn Addition until it is solved. I note that in his letter of September 13, 1978, Mr. Rogan states in paragraph 10 that this matter "should not be considered within this request". However, solution to this problem was in fact one of the conditions imposed by the Planning Commission when it approved the Boar's Head Inn Addition, and this was never appealed by the applicant within the time limit prescribed in the ordinance. Therefore, it is in my judgment final and binding. Again, I do not feel that the County has any business attempting to negotiate an agreement between two adverse parties. It does have f Mr. Robert W. I have never seen an assemblage of all the documents on this matter and I would like for you to collect, at your convenience, for my review, all of the pertinent documents and then have one of your secretaries call me so I can come to your office and see them. My purpose is to make sure my impression of the facts is correct; subject to review of these files, my impression is as follows : (1) That the Boar' s Head Sports Complex underwent site plan review and approval was conditioned, among other matters, on adequate provision to protect neighbors from drainage. (I would like to review this approval and any actual plans for handling the drainage, which were made part of the approval) . (2) That this condition either was not fulfilled by Rogan, or if fulfilled, it did not adequately do the job of protecting the neighbors from excess drainage. The question of whether this original condition was met by Rogan or not, is of the essence since if he never met it, we have the power to require him to Mr. Robert W. Tucker, Jr. Mr. J. Ashley Williams Page 2 December 4, 1979 do so or withhold occupancy permits, etc. , whereas if he met the condition and it simply did not work, we cannot hold him responsible for this. (3) That thereafter, Rogan sought site plan approval for the Boar' s Head Inn Addition, and approval of this was conditioned on his going back and correcting the drainage defects arising from the Sports Complex construction. The question of whether he met this condition according to its original terms, is again of the essence. (4) That the County Engineer' s Office has, subsequent to (3) above, drawn several sets of plans in an attempt to reach a plan agreeable to both Mr. Rogan and Dr. Twyman, the result being that a plan acceptable to Twyman is agreeable to Rogan only if Twyman pays for half the construction. My preliminary conclusions are as follows : A. The County has no standing to require an agreement or to enforce one between Rogan and Twyman. It only has standing to enforce conditions which were imposed on an approval of site plan as a part of the County' s police power. B. Therefore, if plans were drawn as part of the conditions imposed on approval of the Sports Complex, or later the Boar' s Head Inn Addition, or both, then either Rogan has complied with these plans or he has not. If he has, we cannot impose any additional requirements on him; if he has not, then of course we can require him to do so. C. If no plans were actually drafted, and instead the Planning Commission made its approval conditional on drainage facilities "satisfactory to the County Engineer" or "according to plans to be drafted and approved by the County Engineer" , or some such language, then the thing for us to do is draft plans according to the County Engineer' s best judgment, and stop trying to draft these plans with a view toward agreement by the other parties. In other words, for us to enforce a set of plans, they have to be the product of the County' s police power, based on the judgment of its engineer, rather than on an agreement between Rogan and Twyman, since such an agreement appears unlikely. Kurt Gloeckner assures me that he has provided all technical data required by Site Plan Ordinance - Article 17. 9. A new landscape plan to be discussed later is being prepared at this time. 10. Drainage from the tennis courts area of the Sports Club should not be considered within this request since this falls under the Boar's Head Sports Club and an erosion control plan has already been submitted and approved. The problems which have arisen have caused this item to be included in this one of the Boar's Head Inn site plan. However, these can be handled with minor maintenance. Proposal: Addition of 97 hotel/motel rooms, 2,500 square feet additional dining room facility and 106 additional parking spaces. Staff Comments: This project is a continuation of an existing commercial complex which will generate additional traffic and create congestion especially cen- tered around the intersection of Berwick Road and Wellington Drive. Wellington Drive should be realigned to the proposed development to form a perpendicular cross street with stops signs on both sides. Site drainage has caused some problem from the existing layout in the vicinity of the proposal and the addition should be engineered to con- sider all site drainage directed toward adjacent properties. The critical factor of this development is it's impact on the on-site sewage treatment facility. It is imperative that the capacity is adequate to handle this new effluent.
