[Ch 14 Definitions] This application does not meet the requirements for a rural subdivision per Chapter 14: Rural subdivision. The term "rural subdivision" means a type of subdivision that is located in the rural areas which results in two or more lots for the purpose of transfer of ownership or building development, such that: (i) each lot created is at least five (5) acres in area, and (ii) each lot created has at least two hundred fifty (250) feet of frontage on an existing public street which is port of the primary system or secondary system of state highways. a. The segment of Catlin Road that touches TMP 43-22C is a private street and is not part of the primary or secondary system of state highways. The segment of Garth Gate Lane that touches TMP 43-22C is a private street and is not part of the primary or secondary system of state highways. Therefore, the new 95.85 acre lot and the residue of TMP 43-22C do not have the minimum 250' frontage on primary or secondary public streets and cannot be processed as a rural division. b. The application will be reviewed as a two -lot division under the provisions of Section 14-207 of the Subdivision Ordinance. 2. [General Comment] Per note #5 on the plat that was recorded in DB 4906 page 4, the parcel now known as TMP 43-22C "SHALL NOT HAVE ANY RIGHTS OF USE OF THE RIGHT OF WAY AND EASEMENT SET FORTH IN THE DEED OF GIFT RECORDED INDEED BOOK 797, PAGE 353." The deed in the DB 797 page 353 recorded instrument is the easement over the segment of Catlin Road that extends into the west side of the proposed 95.85 acre lot. DB 797 page 353 gave nonexclusive rights to the parcel now known as TMP 43-22C to use Catlin Road for ingress and egress to State Route 676. Per the BLA plat recorded in DB 4906 page 4, TMP 43-22C no longer has rights to use the Catlin Road easement. This means the new 95.85 acre parcel does not have rights to use Catlin Road for ingress/egress. Please add notes to the plat stating such. 3. [14-302 (13)(6)] Please revise the TMP numbers shown on the plat. The existing parcel is TMP 43-22C. The plat currently refers to the new 95.85 acre lot as "TMP 43-18D(1)." The new 95.85 acre lot should not be referred to as TMP 43-181)(1) because that TMP number has not yet been assigned. The new parcel may get a different TMP number once it is created. Please refer to the new parcel as something like "New Parcel A." a. Revise all notes on Sheet 1 that currently state TMP 43-18D(1) and replace the parcel name. This includes the plat title, the statement of consent to division, the area tabulation, etc. b. Revise callouts on Sheet 2 so that TMP 43-18D(1) is not used and replace with the parcel name. [14-302 (B)(5)] Please revise the zoning note on Sheet 1 so that it states that the new 95.85 acre parcel is zoned RA Rural Areas and FH Flood Hazard Overlay. 5. [14-400 and 14-403] Please show how the residue of TMP 43-22C will meet the minimum street frontage requirements of Section 18-10.4 of the Zoning Ordinance. Currently, the plat does not show the full exterior property boundaries of the residue of TMP 43-22C and it appears that it will not have any frontage along an existing public or private street. Please identify the proposed street frontage that the residue of TMP 43-22C will use. 6. [14-302 (B)(1)] Please add a date of last revision. 7. [14-309, 14-310 and 14-416] Health Director Approval. Health Department review and approval of this subdivision plat is required. Provide soils work for review or provide previous approvals. A primary and reserve drainfield is required on each lot in order for each lot to have a building site.
